A RESOLUTION OF THE CITY PLANNING COMAIISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT 1306 gg~ GRANTED IN PART
WHEREAS, the City Planning Commission of the City of Aneheim did receive a verified Petition for Con-
ditionel Use Permit from MAURICE GALE HARTMAN, ET AL, 16b92 I.andmark, Yorba Linda, Cali.fornia
92686, and ALFRED L. CANCLINI, ~/o Amigo Motel, 416 West Ba11 Road, Anaheim, Cali.forr.ia
92805, Ownere; CHARLES E. GIBBS, 833 Dover Drive, Suite 3, Newport Beach, Califox•nia
92660, Agent of certain real property situated in the City of Anaheim, County of Oran~e,
State of California, as deacribed in Exhibit "A" attached hereto and referred to herein
as though set forth in full

WH::REAS, the City Planning Commission did hold e public hearing et the City Hall in the City of Aneheim
on May 1, 1972~ at 2:00 o'clock P.M., notice of seid public heering having been duly given
es requi~ed by lew and in eccordence with the pcovisions of the Anaheim Municipel code, Chapter 18.64,to hear
and cor.sider evidence for end against seid proposed conditionel use end to investigete and make findings and
reccmmendations in connection therewith; nnd
WHEREAS, said Commission, efter due inspectiun, investigetion, end study mede by itself end in its Ue-
helf, and efter due considewtion oE all evidence and reports offered et said heering, does find end determine the
following fects:
1. Thet the pcoposed use is properly unP for which a Conditionel Use Permit is authorized by Code Section
18.64.020(2-c) to wit: expand an existing motel with waivera of:
a. SECTION 18.38.050(3-a) - Maximum building heiRht within 300 feet of a
sinrtle-familv residential zone. (2.5'feet alTowed;
18.5 feet propoaed)
b, SECTIQN 18.38.OS0 2-d-1 - Mininum aid~e setback. (10 feet required; 5 feet
propoaed)
c. SECTION 18.38.050(6) - 6-foot solid masonrv wall required where C-0 abuts
a residential zone. (No wall propoaed)
d. SECT70N 18.04.030(b-10) - Minimum number of parkinR stalls required._ (64
~ stalls proposed; 66 apaces required)
2. That Waivers la, lb, .lc and ld, above mentioned, are hereby denied on the Uasie
that elthough the exis:ing motel unita were permitted as two-story units, no waivere were
neceseary since the atructure was located so as to conform with code requirements nnd
that the petitioner had nut submitted substantiating evidence that he was being deprfved
of a privilege enjoyed by other properties in the same zone and vicinity.
3. That the petitioner etipulated to providing a six-'foot'masonry wall along the
south and west property linea.
4. That the proposed uae,as approved, will not adversely affect the adjoining land
uses and the growth and development of the area in which it is proposed to be loc:ated.
5, That the size and shape o£ the aite proposed for r.he use is adequate to allow
the full development of the propoaed use, as approved, in a msnner not detrimental to
the perticular area nor to the peace, health, safety, and general welfare of the Citizens
of the City of A.naheim.
6. That the granting of the Conditional Uae Permit, as approved, under the conditions
imposed, if aay, will not be detrimental to the peace, health, safety, an1 general welfare
of the Citizens of the City of Anaheim.

NOW, THEREFORE, BE IT 12ESOLVED that the Ar.eheim City Plenning Commission does hereby grent/subject
Petltion for Conditionel Use Permit, upon the following conditlons which ere hereby Eound to be a necessery prere~uislte
to the proposed use oi the subject property in order to preserve the sefety and genetal welfate of the Citizens of the
City oE Aneheim:
1. That the ownera of subject property shall pay to the City of Anaheim the sum of
$2.00 per front foot along Ball Road and Berry Avenue for street lighting purposes.
2. That the developer shall pay water assessment fees as ~etermined by the Director
of Public Utilities prior to the issuance of a building permiC.
3. That trash storage areas shall be provided in accordance with t~pproved plana on
file with the office of the Director of Public Works.
4. That fire hydrar.ts shall be inetalled as requlred and determined to be necessary
by the C~iief of the Fire Department.
S. That a six-foot masonry wall shall be constrncted along the west and south property
lines,
6. That all air conditioning facilities shall be properly shielded from view, and L•he
sound buffered from adjacent residential properties.
7. That subject property shall be developed substantially in accordance with plans and
specifications on file wieh the City of Anaheim marked Exhibit Nus. 1, 2, 3, 4 and 5 provided,
however, ttiat it is developed in accordance with the C-0 code requirements.
8. That Condition :Io. 1, above mentioned, shall be complied with prior to the commence-
ment of the activiLy authorized under this reaolution, or prior to the time that the building
Fermit is issued,or withiti a period of i80 days from date hereof, whichever occurs first, or
auch further time as the Planning Commiseion may grant.
9, That Condition Nos, 3, 4, 5, 6 and 7, ahove mentioned, shall be complied with prior
to iinal building and zoning inspeceiona.
