A RESOLUTION OF THE CITY PLANNING COMMISSIQN OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE NO. 2358 BE GRANTED
WHEREAS, the City Planning Commission of the City of Aneheim did receive a verified Petition for Varience
from KATELLA REALTY, INCORPORATED, Attention of Melvin R. Schantz, 1741 Katella Avenue,
Anaheim, Californis 92804, and MRS. GEORGE E. OPSTELTEN, 1745 South Varna Street, Anaheim,
Califprnia 92804, Ownera; DEAN S, OLSEN, 1741 Katella Avenue, Anaheim, California 92804,
Agent of certain real property situated in the City of Anaheim, County of Orange, State of
CaYifornia, described as Lot 1 end 2 of Tract Na• 2176
; and
WHEREAS, the City Plenning Commission did hold a public hearing et the City Hall in !he City of Anaheim
on Mey 1, 1972, at 2:00 o'clcck P.M., notice of seid public heacing having been duly given es required
by lew and in eccordence with the provisiona ~f the Anaheim Municlpel Code, Chepter 18.68, to hear and consider ,
evidence for end ageinst seid proposed verience end to investigate and meke findings end recommandations in connec-
tion therewith; and
WHEREAS, said Commission, efter due inspection, investigetian, and study mede by itself and in its behelf,
and aEter due conslderation of ell evidence end reports ofEered at sald hearing, does find and determine the following
fects:
1. That the petitioner reauests a verier,ce from the Aneheim Municipal Code as followe:
a. SECTIOtI 18.40.070(2-a-1) - Minimum front c~tback. 10 feet required; 3 feet
and 8 feet propoeed)
b. SECTION 18.40.070(2-a-21 - Setback o oeite R-1 alon a local street. (10

2. That there are exceptionol or extraordinary circumstences or conditions appliceble to tue property involved
or to the intended use of the property that do not epply generally to the property or cless of use in the same vicinity
and zone.
3. That the requested variance is necessery for the preservation and enjoyment ef p substential property right
possessed by other property in ;he seme vicinity and zone, end denied to the property in question.
4. That the requested veriance will not be meterielly detrimental to the public welEere or injurious to the pmp-
~rty or improvements in such vicinity and zone in which the ptopetty ls loceted.
5. That three pereona appeared in opposition and that a letter wae received in oppoaition
~o the request for parking waiver.

NOW, THEREFORE, BE IT RESOLVED that the Aneheim City Plenning Commission daes heceby gcent subject
Petition for Varience, upon the following conditions which ere hereby found to be a neccasary prerequisite to the pm-•
posed use of the subject property in order to preserve the seEety and generel welface of the Citizens of the City of
Aneheim:
(:) That this variance ia granted subject to the completion of Reclassification No.
71-72-43.
(2) That aubject property shall be developed substantially in accordance with plans
end specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2.
(3) That Condition No. 2, above mentioned, shall be complied with prior to final
building and zoning inspectione.
