A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHE:M
THAT PETITION T'OR CONDITIONAL USE PERMIT 1399 BE 6RANTED' IN PART
WHEREAS, the City Planning Commission of the City of Aneheim did receive a verified Petition for Con-
ditianal Use Permit from WILL7'AM J, WETHERN, 606 South Arden Street, Anaheim, California
92802, Owner ~f certain real property situated in the City of Anaheim, County of
Orange, State of Cali..fornia, described as Lot No. 1 of Tract No. 2381
; and
WHEREAS, the City Planning Commission did hold e public hearing at the City Hall in the City of Anaheim
on May 14, 1973, at 2:00 o'cleck P,M., notice of said public hearing having been duly given
es cequired by law and in accocdance with the pcovisions ef the Anaheim Municipal code, Chapter 18.64, to hear
and consider evidence for and ageinst seid pronosed conditional use and to investigate and meke Eindings and
cecommendaGons in wnnection therewith; end
WHEREAS, said Commission, after due inspection, investigetion, and study mnde by itself end in its be-
half, and after due cvnsiderotion of all evidence and reports offeced et said hearing, does find and determine the
following Eacts:
1. That the proposed use is pmperly one for which e Conditional IIse Permit is authorized by Code Section
18.38.040(3) to wit: establish a retail optical laboratory •Ln 2 single-family structure
with waivers of:
a. SECTION 18.38.020 ; Permitted uses.
b. SECTION 18.38.050(7)(c) - Requirement Chat all signs be attached to a
buildinR face.
c. SECTION 18.62.08Q(B) - Types of siRns permitted. (Free-standing sign
not permitted; free-standing sign proposed -
Fence sign not permitted; fence sign proposed)
2. That Waiver 1-a is granted on the basis that similar uses have been approved in
this general area in the past and the proposed use would not be incomp2tible with the
area.
3. That Waivers 1-b and 1-c, nbove mentioned, are hereby denied on the basis that
granting the signing requests would be granting a privilege not enjoyed by other C-0
uees throughout the City and Chat signing within the C-0 Zone requirements woulc~ be
adequate.
4. That the proposed use, as granted, will not adversely affect the adjoining land
uses and the growth and development of the area in which it is Froposed to be locate3.
5. That the size and shape of the site proposed for the use is adequate to allow
the full development of the proposed use, as granted, in a manner not detrimental to
the particular area nor to the peace, health, safety, and general welfare of the Citizens
of the City, of Anaheim.
6. That the granting of the Conditional Use Permit, as granted, under the conditions
imposed, if any, will not be detrimental to the peace, health, safety, and general welfare
of the Citizens of. the City of Anaheim.
ENVIR~~NMENTAL IMPACT REEORT FINDING:
That I.he Planning Commission, in connection with an Exemption Deciaration Statua requeat,
finds and determines that the proposal would have no aignificant enviror~mental impact
and, t:herefore, recommends to the City Council that no Environmental Impact Statement is
necess,ary.

NOW, THEREFORE, BE 1T RESOLVED thet the Anehelm City Planning Commission does hereby grent/subject
petition for Conditionel Use Permit, upon the following conditions which ece hereby Eound to be a necessery prerequisite
to the proposed use of the subject property in order to preserve the seEety and generel welfare of the Citlzens of the
City of Aneheim:
(1) That the owner(s) of subject property shall pay to the City of Anaheim the sum
of 60 cents per front foot along Euclid Street and Alomar Avenue for tree planting purposes.
(2) That trash storage areas shall be provided in accordance with approved plans on
file with the offica of the Director of Public Works.
(3) That all sir conditioning facilities shall be properly shielded from view, and
the sound buffered from adjacent properties.
(4) That the existing structure shall be brought up to the minimum standards of the
City of Anaheim, including the Uniform Building, Plumbing, Electrical, Housing, Mechanical
and Fire Codes as adopted by the City of Anaheim.
(5) That subject property shall be developed subetantially in accordance with plans
and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2 provided,
however, that signing shall be in conformance with Code requirements.
(6) That Condition No. 1, above mentioned, shall be complied with prior to the com-
mencement of the activity authoriaed under this resolution, or prior to the time that the
building permit is issued, or wiY,hin a period of one yesr from date hereof, whichever occurs
first, or such further time as the Planning Commission may grant.
(7) That Coc~dition Nos. 2, 3, 4, and 5, atrove ment3oned, shall be complied with prior
to final building and zoning inspections.
