A RESOLUTION OF THE C1TY PLANNING COMMISSION OF THE CITY OF ANAHEIM
RECOMMENDING TO THE CITY COUNCIL OF THG CITY OF ANAHEIM THAT
PETITION FOR RECLASSIfiICATION N0. ~2'~3'49 HE APPROVED
WHEREAS, the City Planning Commission oE the City of Anaheim did initiate a verified Petition
for Reclassification of property situated in the City of Anaheim, County of Orange, State
of California, known as the Mohler D•rive Annexation, as described in Exhibit "A" attached
hereto and referred to herein as though set forth in full
; and
WHEREAS, the City Planning Commisston did hold e public hearing at the C(ty Hall in the City of Aneheim on
May 14, 1973, at .7t30 ~!:lock P.M. notice oE seid public hearing having been duly glven es required by
law end ln aceordaace with the p~ovisions of the Mehelm Municipal Code, Chapter 18.72, to heer end conslder evidence
foc end ageinst seld proposed recivssifice2lon end to investigate end make findings end recommendetions in connection
therewith; end
WHEREAS, said Commission, a(ter due inspection, investigAtion, end study mede by itself and in its behelf, end
efter due consideration of ell evidence and reporte o[fered et sald heering, does find and determine the following fects:

ENVIRONMENTAL IMYACT REPORT FINDING: '
That the Planning Commission, in connection with the filing of an Environmental Impact
Report, finds and determines that the EIR Review Committ2e determined that the Report ia
adequate as an informative document and follows the City's establiahed ~uidelinea, and
that there would be no signlficant adverse environmental impacta; and therefore, the
Planning Co~iesion recommends to ::he City Council that said report be adopted as the
Council~s Environmental Impact Statement,

All that certain land situated in the City of Anaheim, County of
Orange, State of California, described as follows:
Beginning at the northeasterly corner of that parcel of land
deeded to Michael J. Cibellis, et al, by deed reco~ded March 5,
1964 in Book 6950, page 509, Official Records; thence Easterly
along the southerly right of way line of the Santa Ana Canyon Road,
as described in deed recorded in Book 171, page 144, Official Records,
to the northwesterly corner of that parcel of land deEded to Gloria
Rowe by deed recorded February 16, 1968 in Book 8520, page 934,
Official Records; thence S 43'~° E,'307.7 feek; thence S 4~3° 21' 40" W,
424.36 feet; thence Southwesterly in a straight line to the point
of intersection with the westerly line of that certain 50-foot strip
of land conveyed to the Santa Ana Valley Irrigation Co. by deed
recorded October 9, 1947 in Book 1538, page 487, Official Records,
said point also fleing the intersection with the easterly right oE
way line of said parcel of land deeded to Michael J. Cibr.llis; Lhence
Northerly along said easterly line to the point of beginning.

NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Planning Commission does hereby
reco~end to the City Council of the City of Anaheim that subject Petition for Reclassi-
ficatior. be approved and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code
be amended to ezclude the above described property from the R-A, AGRICULTURAL, 20NE and
to incorporate said described property into the C-1, GENERAL COt~4SERCIAL, ZONE, upon the
fo2lowing conditions which are hereby found to be a necessary prerequisite to the proposed
use of subject property in order to preserve the safety and general welfare of Che Citizens
of the City o£ Anaheim:
(1) That a preliminary title report shall be furnished prior to the adoption of the
ordinance rezoning the property,'ahowing legal veatirg of title, legal description, and
containing a mep of the property,
(2) That dedication shall be mede t~~ the City of Anaheim of all streets within the
area, according to the Circulation Eleoient of the General Plan Highway Rights-of-Way,
prior to the adoption of the ordinance..s rezoning the property.
(3) That all engineering requirements of the City of Anaheim such as curbs and guttera,
sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall
be complied with as raquired by the City Engineer and in accordance with standard plans
and specifications on file in the office of the City Enginecr, at the time the property is
drveloped.
(4) That the owner(s) of subject property shall install atreet lighting on all streets
within the area as required by the Director of Public Utilities at the time the property
i3 developed.
(5) That electrical utilities shall Ue placed underground and dedicated to the City of
Anaheim in accordance witii the requiremenls of the Director of Public Utilities.
(6) That drainage of said property shall be disposed of in a manner satiafacl•ory to Che
City Engineer. If, in the preparation of the aite, aufficient grading ie required to aeces-
sitate' a grading permit, no work on grading will be permitted between November lst aud
April 15th unless all r.equired off-site drainage facilities have been installed and are
operative. Positive assurance shall be provided the City that such draiaage f.acilities
will be completed prior to November ist. Necessary righL•-of-way for off-site drainage facil-
iEics shall be dedicated to the City, or the City Council shall have initiated condemnation
proceedings therefor (the costs of which shall be borne by the developer) prior to commence-
ment of grading operations. The required drainage facilities shall be of t~ aize and type
aufficient to carry runoff waters originating from hlgher properties through said property
to ultimate dieposal as approved by the City Engineer. Said drainage facilities ahall be
the first item of conatruction and shaii be completed and be functional throughout the tract
and from the downatream boundary of the property to the ultimate point of disposal prior
to the issuance of any final building inspectiuns or occupancy perciits. The City shall not
accept any portion of such drainage facilities until the entire facility through the subject
property and to the point of ultimate dieposal is completed and operative. . The developer
shall maintain such facilities for a period of two yeara following installation and shall
post a faithful performance bond in a sufficient amount to guerantee such maintenance.
Drainage district reimbursement agreements may be made availeble to the developers of said
property upon their request.
(7) That ordinances reclassifying the property ehall be adopted as each parcel is ready
to comply with conditiona pertaining to such parcel provided, however, that the word "parcel"
ahall meatt presently existing parcela of record and any parcel or parcela appravcd by tFe
City Council for a lot split.
