THAT PETITION FOR CONDITIONAL USE PERh1IT_l~$__BE GRANTED
WHEREAS, the City Planning Commission of the City oE Anaheim did receive a veriEied Petition for Con-
ditional Use Peimit from APIAHEIM HILLS-TEXACO VENTURES, INCORPORATED, 380 Anaheim Hills Road,
Anaheim, California 92806, Owner; GRANT COMPANY OF CALIFORNIA,.in care of Ron Dickerson,
1665 South Brookhurst Street, Anaheim Califor.nia 92804, Agent.of certain real property
situated in the City of Anaheim, County of Orange, State of California, as described in
Exhibit "A" ektached hereto and referred to herein as though seC forth in full

WHEREAS, the City Planning Commission did hold a public hearing at the City Hell in the City of Aneheim
on January 8, 1973, et Z00 o'clock P.M., notice of seid public hearing having been duly given
es required by lew and in eccordence with thc provisions of the Meheim Muuicipel code, Chepter 18.64,to hear
and considec evidence Eor end egainst seid proposed conditionel use and to investigate and meke Eindings end
recommerdations in connection thecewith; end
WHEREAS, seid Commission, after due inspection, investigation, and study made by itself end in its ba
half, and after due consideretion of ell evidence and repocts offeced at e~id hearing, does find and determine the
following facts:
1. Thet lhe proposed use is properly one for which a Conditionel Usc Permit is authorized by Code SecCion
18.64.020(1-e) to wit: eatablish an 84-unit one and two-story planned residential devel-
opment wit;~ waivers of:
a, SECTION 18,08.440 ' - Lot frontage requirement. (Lot frontage on a
dedicated street required; lot frontage on a
private street proposed)
b. SECTION 18.28.050(la) - Minimum building site area. (7200 square feet
required; building site areas to a minimum of
2176 square feet proposed)
c, SECTION 18.28.050(lb) - Minimum buildinR site width, (70 feet required;
34 feet proposed)
d, SECT70N 18.28.050(6-5-b-2) - Minimum distance between buildin~s. (24 feet
- required; a minimum of & feet proposed)
e, SECTION 18,28.050(11) - Required walls. (6-foot masonry wall required

2, That Waivers 1-a, 1-b, 1-c, and 1-d, above mentioned, are hereby gtanted on the
basis that other planned r,esidential developmente have been granted similar wai.vers i.n
the past,
3, That Waiver 1-d, above mentioned, is hereby granted on the basis that the R-A
2one boundary affected would be the Anaheim Hills Golf Course. ;
4. That the developer is proposing garage setb2cks less than or greater than the
required 6-10 foot garage setbacks (but less than the 25-foot setback) required of sub-
divisions having access drives perpend±cular to a public street, however, no waiver has
been asked for or advertised as the street proposed for circulation is a private street,

5, That the developer stipulated to providing bonding to insure improvement of
parking spaces for an additional 31 parking spaces within open areas in the event of
evidence of need for additional parking areas.
6. That the petitioner stipulated to preparing a special parking study to ascertain
the no:mal parking demands experienced by the developer in similar forms of development,
said study to be submitted to the Planning Commission for consideration prior to the
filing of a final tract map.
7, That the proposed use will not adversely affect the adjoLning land sses and the
growth and development of the area •ln which it is proposed to be located.
8, That the size and shape of the si.te proposed for the uQe is adequate to allow
the full development of the proposed use in a manner not detrimetttal to the particular
area nor to the peace, health, safety, and general welfare of the Citizens of the City of
Anaheim.
9, That the granting of the Conditional Use Permit under the conditions imposed, 4.`. '
any, will not be detrimental to the peace, health, safety, and general welfare of the
Citizens of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commissiun does hereby
grant subject Petition for Conditionel Use Permit, upon th~ following ccnditiona whic~ are
hereby found to be a necessary prerequisite to the proposed usa of the subject property in
order lo preserve the safety and general welfare of the Citizens of th~ City of Anaheim:
(1) That this conditional use permit is granted subject tn the completion of Reclasai-
fication No, 71-72-44 and Tentetive Map of Tract No. 7444, Revision No. Y, now pending.
(2) That the vehicular access rights, except at street and/or alley openinga, to
Nohl Ranch Road shall be dedicated to the City of Anaheim.
(3) That the owner(s) of subject property ahall pay to the City of Anaheim the appro-
priate park and recreation in-lieu fees as determined to be appropriate by the City Coiincil,
said fees to be paid at the time the building permit ia issued.
(4) That any proposed convenants, conditions, and restrictione shall be submitted to
and approved by the City Attorney's Office prior to City Council approval of the final
tract mep and, further, thst Che approved covenants, conditions, and res~rictions shall
be recorded concurrently with [he final tract map.
(5) That a final tract map of subject property shall be submiCted to and approved
Uy the City Council and then be recorded in th~ ofiice of the Orange County Re^_order.
(y) Thst prior to filing the final tract map, the applicar.t shall submit to the City
Attorney for approval or denial a complete synopoie of the proposeJ functioning of the
operating corporation including, but not limited to, the articles of incorporation by-
laws, proposed methods of management, bonding to insure maintenance of common property and
buildings, and such other information as the City Attorney may desir•e te protect the City,
'its citizens, and the purchasers of the projecL•.
(7) ThaC grading, excavation, and all other conatruction activities shall b2 con-
ducted in such a manner so ae to minimize the possibility of any silt originating from
this project being carried into the Santa Ana River by storm water originating from or
fiowing through thia pro~ect.
(S) That drainage of said property shall be dispoaed of in a manner satisfactory to
L•he City Engineer and shall include conatruction of drainage faci?itiea of a size and type
sufficient to carry runoff waters originatittg from higher properties aouth of Santa Ana
Canyon Road through said property to ultimate diaposal as approved by the City Engineer.
Reimbursement agreements may be made available to the developers of said property upon
their request.
(9) That fire hydrante shall be inetalled and charged as required and deter.mined to
be necessary by the Chief nf the Fire Department prior to commencement of structural fram-
ing.
(10) That subject property shall be deve?.oped su:.stantial~y in nccordance with plane
and specifications on file with the City of. Anaheim mnrked Exhibit Nos. 1, 2, 3, 4, 5, 6,
and 7.
(11) That Condf'tion Nos. 1, 2, 4, 5, and 6, above mentioned, shail be complied with
prior to the commer~cement of the activity authorized under this resolution, or prior to
the time that the building permit is issued, 4r within a period of one year. from date
hereof, whichever occurs first, or auch further. time as the Planning Commission may grant,
(12) T~iat Condition Nos. 7, 8, 9~ and 10, above mentioned, sha~l be complied with
prior to f!.nal h~::~ing and zoning inspectione,
(13) T~~~ the tract map shall be revised to ref7.ect the potential for 31 additional
parking spaces within open areas throughout the tract in the event of future needs; and
that a bond in an amount and form saL•isfactory to the City o£ i+naheim ahsll be posted to
guarantee the improvement of said parking spaces in the event o£ ~4 determinatian of park-
ing shortages, as atipulated to by ~he petitioner.

(14) That the boundaries of the tract map shall be revised to indicate that uo grading
•or construction would be performed on adjoining Cit;y of Anaheim properties, or in the alter-
nate, that an agreement be entered into in a manner and fotm satisfactory L•o the City of
Anaheim and approved by the City 9ttorney~s Office ~as to any grading which may encroach onto
City property adjoining said tract prior to the intr.oduction of a final tract map.
(15) That a special parkin.g study be conductedl to ascertain the nozmal parking demands
as experiettced by the developer in these forms of development, said study to be subpitted to
the Planning Commission for coneideration prior to the filing of a final tract map as stipu-
lated to by the petitioner.
