A RESOLUTION OF THE CITY PLANNING COIIIMISSION OF THE CITY 6F ANAHEIM
THAT PETITION FOR VARIANCE N0. 2511 _ B~; GRnNT~D
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Veriance
from DONALD W. AND ROBERTA G. ROBERSON, 714 North Ger_eva Street, Anaheim, California 92801,
Owners of certain real property situated in the City of Anaheim, County of Orange, State of
California, described as Lot 42 of. Tract 2390, as per map recorded in book 71, pages 11 to
14 inclusive of Miscellaneous Maps, records of said Orange County
; and
WHEREAS, the City Planning Commission did hold a public heeri~g at the City Hall in the City of Anaheim
on May 3U, 1973, at 2:00 o'clock P.M., notice of said public hearing having been duly given es required
by law and in eccordance with the provisions of the Aneheim Municipel Code, Chepter 18.68,to hear and consider
evidence for and egainst seid propased veriertce end to investigate and make findings and cecommendetions in connec-
tion thet~rtith; and
NHEREAS, said Commission, after due inspection, investigetion, and study mede b;r itself and in its behalf,
and after due consideration of all evidence and reports oEfeced at seid hearing, does find and detecmine the following
facts: ~
1. That the petitioner eeauests a vaciance Erom the Anelteim Municipal Cade as follows: '
SECTION 18.24.030(1-a) - Minimum garage setbeck. (Bet~veen 6-10 foot setback or
25 foot minimum setback permitted; 22 foot setback
proposed)
2. That the petitioner proposes to relocete the garage door and driveway and contruct
a new 2-story addition to the existing home. .
3. That there are exceptional or extreocdinery circumstences or conditions appliceble to the pecperty involved
or to the intended use of the property that Jo not apply generally to the property or cless of use in the same vicinity
and zone.
4. That the requested varience is necessery Eor the preservation end .enjoyment of a substential property :ight
possessed by otlier propecry in the seme vicinity end zone, and denied to the property in question.
5. That the requested veriance will not be materially detrimentel to the public welfare or injurious to the pmp-
erty or impcovements in such vicinity and zone in which the property is loceted.
6. That the petitioner'stipulated to providing automatic garage door upeners in- lieu
of the required 25-foot minimum setback.
ENVIRONME;NTAL IMPACT REPOAT FINDING:
That the Planning Commission, in connecti.on wii;h an Exemption Declaration Status request,
finds and determines th~.t the proposal would heve no significant environmental impaot and,
therefore, reaommenc's t;o the City Cour.cil that no Environmental Impact Statement i~ necessary.

~NOW, THEREFORE, BE IT RE~VED that the Anaheim City Plenning Co~sion does heceby grant subject
Petition for Variance, upon the following conditions which ere hereby found to 6e a necessery prerequisite to the pro-
posed use oi the subject property in order to pceserve the safety and general welfa:e ofthe Cikizens of the City of
Anaheim:
(1) That subjeat nronerty shall be developed substantielly in aocordance with plans
and specifiaetions on file with the City of Aneheim markbd ExhiUi~t Nos. 1 and 2,;provided
however, that an automatic garage door opener be installed, as stipulated to by the peti-
tioner.
