A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
RECOMMENDING TO THE C1TY COUNCIL OF THE CITY OF ANAHEIM THAT
PETITION FOR RECLASSIFICATION :50. 72"73"29 BE APPROVED
'AHEREAS, the City Planning Commission of the City of Anaheim did recelve e verified Petition for Reclessifice-
tionfrom EDWIN E. KETTLER, 501 West Ball Road, Anaheim, California 92501, Owner; ART SHIPKEY,
420 West Lincoln Avenue, Anaheim, California 92805, Agent of certain real property situated
in the City of Anaheim, County of Orange, State of California, as de~cribed in Exhi6it "A"
attached hereto and referred to herein as though set forth in full
; and
WHEREAS, the City Plenning Commission did hold a public hearing et the City Hell in the Clty of Anaheim on
January 8, 1973, at 2:00 o'clock P.M. notice of seid public hearing having been duly given as requiced by
lew end in accordence v~ith the provisions of the Aneheini Municipel Code, Chepter 18.72, to heer and consider evidence
for and against said pioposed reclessification end to investigate en3 meke findings end recommendations in connectlon
therewith; end
WHEP.EAS, seid Commission, aEter due inspection, investigetion, and study made bp itself end In its behelf, end
efter due consideretion of all evidence end reports offered at seid heering, does find end determine the following fects:
1. Thet the petitioner proposes a reclassification of tha above described property from the R-A., AGRICULTURAL,
ZONE to the C-2, GGNERAL COMMERCIAL, ZONE.
2. That the proposed reclassification is in conformance with land use development in
the ~eneral area, although it does not conform with the land use designation of the General
Plan.
3. That the propGSed reclessificetion of subject pcoperty Is nncessary end/or desireble for the orderly and p~o-
per development of the community.
4. That the pcoposed reclessificetion of subject property does properly relete to the zones and their permitted
uses locelly established in close proximity to subject property and to the zones and their permitted uses generelly esteb-
lished thcoughout the community.
5. That the proposed recl.assiEication of subject property requires the dedication and
improvement of abutting streets/alleys in accordance with tye Circulation ~lement of the
General Plan, due to the anticipated increase in traffic which will be generated by the in-
tensification of 'l.and use,
~NVIRONMENTAL IMPACT_ REPORT FINDING:
That the Planning Cotmnission finds and determines that the proposal would have no significant
environmental impacG and, therefore, recommends to the City Council that Exemption Aeclara-
tion Status be granted.

NOW, THEREFORE, BE IT RESOLVED that the Aneheim City Plenning Commission does hereby recommend
to the City Council of the City of Aneheim thet eubjee{ Petitlon for ReeleseiIIce}ion be appcoved end, by so doing,
thet Title 1&Zoning of the Aneheim Manicipel Code be amended to exclude the ebove described property from the
R-A, AGRICULTURAL, ZONE and to incorporate said described property into the C-;~, GENERAL
COMMERCIAL, ZONE upon the following conditions which are hereby found to be a necessary
prerequisite to the proposed use of subject property in order to preserve the safety and
general welfare of the Citizens of the City of Anaheim:
(1) That the owner(s) of subject property shall deed to the City of Anaheim a strip
of land 32 feet in width from Che centerline of the street along Palm Street including a
15 foot radius property line return for street widening purposes.
(2) That ali engineering requirements of the City of Anaheim along Palm Street includ-
ing preparation of improvement plans and installation of all improvements, such as curbs
and gueters, sidewalks, street grading and paving, drainage facilities, or other appurten-
ant work shall be complied with as required by the City Engineer and in accordance with
standard plans and specifications on file in the office of the City Engineer; that street
lighting facilities along Palm Street aad Ball Road shali be installed as required by the
Director of Public Utilities and in accurdance with standard plans and specifications on
file in the o.ffice of the Director of Public Utilitiea; and that a bond in an emount and
form satisfactory to the City of Anaheim shall be posted with the City to guarantee the
installation of the above mentioned requirements.
,(3) That the owner(s) of subject property shall pay to the City of Anaheim the sum
of 15 cents per front foot along Palm Street and Ball Road for tree planting purposes.
(4) That sub3ect pr.operty sha1Z be served by underground utilities.
(5) That the owners of subject property shall pay the water assessment fees as deter-
mined by the Water Superintendent.
(6) Prior to the introduction of an ordinance rezoning subject property, Condition
Nos. 1, 2, and 3, abeve mentioned, shall be completed. The provisions or rights..granted
by this resolution shall become null and void by action of the City Council unless said
conditions are complied with within one year from the date hereof or auch further time as
the City Council may grant.
(7) That Condition Nos. 4 and 5, above mentioned, shall be complied with prior to
final building and zoning inspections,
