A RESOLUTION OF THE CITY PLaNNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITiON FOR VARIANCE NO.. 2517 BE GRANTED
WHEREAS, the City Plnnning Commission of the City of Aneheim did receive a veriEied Petition for Variance
fcom ~NNETH KEESEE, 19Z2 South Anaheim Boulevard, Anaheim, California 92805, Owner of certain
real property situated in the City of Anaheim, County of Orange, State of California, as des-
cribed in Exhibit "A" aCtached hereto and referred to herein as though set forth in full
' ; and
WHEREAS, tha City Plenning Commission did hold a peblic hearing at the City Hall in the City of Aneheim
on June 25, 1973, at 2:00 o'clock P.M., notice of said public heacing having been duly given as required
by lew and in sccordence with the provisions oE the Aneheim Municipal Code, Chapter 18.68,to hear and consider
evidence for end egainst said proposed varience nnd to investigate and meke findings and recommendations in connec-
tion therewith; end
WHEREAS, said Commissinn, after due inspection, investigation, and st does f rtd andtdetecminelthetfollowing
and after due consideration of all evidence and repods oEfeced at seid heacing,

1. That the petitioner cequests a variance from the Aneheim Municipel Code.as iollo~s:
SECTION 18.52.060(2) - Minimum front setback. (50 feet required; 12 feet proposed)
2. That waiver of the mi.nimum front setback is hereby granted'on the basis that a similar
waiver had been granted to developed property immediately adjaceiit to aub~ect property.
g; Thet there ece exceptional or extceordinary ciccumstances oc aonditions appliceble to the property involved
or to the intended use of the property that do not epply genecelly to the propecty or cless of use in the seme vlcinity
and zone.
4, That the requested veriance is necessary for the pcesetvation and,enjoyment of e substential propedy rig t
possessed by other property in the seme vicinity end zone, end denied to the propecty in question.
5, That the cequested verience will nut be meterially detrimentel to the public welfate or injurious to the pmp-
edy or impcovements in such vicinity and zone in which the property is loceted.
6. That the petitioner stipu7.ated to provide landscaping in the front of each industrial
building and to submit a landscape plan to the Development Services Department for approval.
7. That the petitioner stipulated to having no retail sales in the proposed complex.
8. That the petitioner stipulated to providing more landscaping on the oiCe and to aub-
mitting a landscaping plan showing the propoaed landscapi.ng.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Commission, in connection with an Exemption Declarstion Statue request, finde
and determices that the proposal would have no eignificant envirenmental impact and, therefore,
recommends to the City Council that no Environmental Impact Statement is necessary.

NdW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby
grant subject Petition for Variance, upon the following conditions which are hereby found to be
a necessary prerequisite to tha proposed use~of the subject property in order to preserve the
safety and general welfare of the Citizens of the City of Anaheim:
(1) That the owner(s) of subject propert,y shall deed to the City of Anaheim a strip
of lan3 50 feet in width from the centerline of the street along Anaheim Boulevard for street
widening purposes.
(2) That the ~idevalks shall be installed along Anaheim Boulevard as required by the
City Engineer and in accordance with standard plans and specifications on file in the office of
the City Engitteer.
(3) That the owner(s) of subject pro~Qrty shall pay to the City of Anaheim the sum
of $2.00 per front foot along Anaheim Boulevard for street lighting purposes.
(4) That trash storage areas shall be provided in accordance with approved plans on
file with the office of the Director of Public Works.
(5) That fire hydrants shall be installed and charged as required snd determined to
be necessary by the Chief of the Fi~a Department prior to commencement of structural framing.
(6) That all air conditioning fECilities ahall be pr.operly ahielded from view, and
the sound buffered from adjacent properties.
(7) That subject property shall be served by underground utilities.
(8) That the final parking plan shall be approved by the Bevelopnent Services Depart-
ment and any landscaped areas in the parking area shall be protected with sAx-inch high concrete
curbs, and concrete wheel stops shall be provided for parking spaces as required.
(4) That drainage of subject property shall be disposed of in a manner Chat is satis-
factory to the City Engineer.
(10) That appropriate water assessmenY. fee3 as determined by the Director of Public
Utilities shall be paid to the City of Anaheim prior to the issuance of a building permit.
(11) That aubject property shall be developed substantially in ac=ovidede howeveran.
and apecifications on file with khe City of Anaheim marked Exhibit No. 1 p ~
that =andscape planters shall be provided fronting the industrial buildings~ as atipulated to
by the petitioner.
(12) That a landscape plan shall be submitted to the Development Services Department
for approval indicating the manner in which thedecisionsema3e~by$thetDevelo~mentaServices Depart-
sceping, as stipulated by the petitioner. Any
ment on said plan mey be appealed to the Planning Commission and City Counc3l.
(13) That Condition Nos. 1 and 3, above menL•ioned, shall be complied with prior ta the
commencement of the activity author.ized under this resolution, or prior to the time that the
building permit is issued or within a period of one year froTen~te hereof, which~ver occurs
fi.rst, or auch further time as the Planning Commission may g
(14) That Condition Nos. 2, 4, 6, 7, 8, 9, 11, and 12, above mentioned, ahall be com-
plied with prior to final building nnd zoning inapections.
