A RESOLUTION OF THE CITY PLANNING COMMISSIO:I OF14H~g CITY OF ANAHEIM
THAT PETITION FOR CONDITTONAL USE PERMIT BE GRANTED
WHFREAS, the City Planning Commission of the City of Anaheim did rer,eive a vecified Petition for Con-
ditional Use Pecmit from PALLMALL PRCPERTIES, INCORPORATED, 1430 West Broadway, Anaheim,
California 92802, Owner; DAVID "u. COLLINS, 1077 West Ball Road, Anaheim, California
92802, Agent of certain reel property si•tuated in the City of Anaheim, County of
Orange, State of Jalifornia, as described in Exhibit "A" attached hereto and referred
to herein as though set £orth in full'
; and
WHEREAS, the City Planning Commission did hold a public heacing at the City Hall i~~ the City oE Anaheim
on July 9, 1973 , A! :00 o'cloak P.M., notice of said public hearing having been duly given
as required by lavr ond in accocdance with :he pcovisions of the Aneheim PAunicipel code, Chapter 1R.64,to hear
and consider evidence foc and against seid proposed conditional use and to investi~ate and make findings and
recommendations in connection thetewith; end
NHEREAS, said Commission, after dce inspection, investigation, nnd siudy made by itself end in i:s be-
ha!f, and after due consideration of'a11 evideuce nnd reports offered et said hearing, does Eind and detcrmine the
following Eects:
1. That the proposed use is propecly one for which a Conditional Use Permit is eathorized by COde Section
18.63.040(b) and Section 18.63.040(a-2) to wit: establish a bi].lboard excesding allowable
area at other than an authorized location.
2. That i~i order to determixie whether any adverse effect will result Prom the
granting of the proposed use, the Planning Commission finds that a one yoar time limita-
tion should be established a£ter which time consideration may be given to whether the
v~aiver should be extended.
3. That granting of this existing off-site billboard shall not be considered as
establishing a precedent for similar billboards in other locations, nor shall the bill-
board be gr~.nted as a matter of right, but shali be only for the use which was permitted
by Variance No. 2349.
4. That the billboard has an extremely close proximity to the property being ad-
vertised end that ugon meeting the size requirement and a small change in location the
billboard would be a use permitted by aode.
5• That the proposed use will not adversely affect the adjoining .lend uses end
the growth and devolopment of the area in which it is propo~ed to be located.
6. That the size and shape of the site proposed for the use is adequate to allow
the full d~velopment of the proposed use in a manner not detrimentel to the particular
ares nor to the peace, health, safei;y, and general welfare of the Citizens of the City
of Anaheim.
7. Th~.i~ the gr3nting of the Conditional Use Permit under the conditions imposed,
if any, aill not be detrimental ~Lo the peace, heslth, safety, and genera3 welfare of thp
Citizens of the City of Anaheim.

ENVIRONy1ENTAL IMPACT REPORT FINDING:
Petitioner has requested exemption £ro.~ requirements for filing of an Environmental
Impact Report. Review of the request and the Environmental Impact C~aestionnaire indicates
the proposal would have no significant environmental imFact. StaPf would, therefore, rec-
ommend exemption declaration status be granted•
NOW, THEREFORE, BE IT RESOLUED thet the Anaheon theJfollowin~ aonditions whichhareby
grant subject Petition for Condi~erequisitePtomthe proposed use of the subject property in
hereby found to be a necessary p
order to preserve the safety and general welfare of tho Citizens of the City of Anaheim:
(1) That subject property shall be developed substantielly in conformance viith
plans and specifioations on file with the City of Anaheim, marked Exhibit No. 1.
(2) That the use shall be granted for a period ot one year in order that the
Planning Commission may determine whether any adverse effect will result, after whioh
time considerationmay be given to whether the waiver should be extended.
