A RESOLUTION OF THG CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2524 BE GRANTED
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from PETE' S
ROAD SEAVICE, INCORPORATED, 1193 Bluo Gum Street, Anaheim, California 92806, Owner of certain
real property situeted in the City of Anaheim, County of Orange, Stste of California, de-
scribed as Thet portion of the North half of Lot; 7, Block 11, Golden State Tract, as sho~m
on a Map theroof reoorded in book 4, page 66, M~iscellaneous Maps, records of said Orange
County, described as follows: Beginning at the most Northerly corner of said Lot 7, said
corner being for purpos~ of this description, the intersection of the center line of
Coronado Street with the center line of Blue Gum Street, as shown on a MaA'filed in book
61, page 7, Record of Surveys, in the office of the County Reaorder of said Orang Caunty;
thence South 16~ 19' 43" East along the Easterly line of said Lot 7, beiiig said cente^ line
of Blue Gum Street, 329.97 fest to the Southerly line of said North half of Lot 7; thenco
South 73° 37' 51" West along said Southerly line, 200.00 feet; thence North 16° 19' 43'~~
West 329.97 feet to the Northerly line of said Lot 7, being said center line of Coronado
Street; thence North 73° 37' 51" East along said Northerly line 200.00 feet to the point
of beginning; EXCEPT the Southeasterly 160 feet theraof; and
WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on
July 9, 1973 , at 2:OL~ o'clock p.m., notice of said public hearing having been duly given as ~equired by law and
in accordance with the'provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and codsider evidence for and against said
proposed variance and to investigate and make findings and recommendations in connection therewitt~; and
WHERE~S, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due
considcration of all evidence and reports offered at said hearing, does find and determine the following facts:
1. That thc petitioner requests a variance from the Anaheim Municipal Code as f ollows , to permit the existing
repair of '~ruck tires as a conforming use:
a. SECTION 18.52 940 - Permitted,outdoor uses:(to oontinue outdoor repair
--- of truok tires).
b. SECTION 18.52•060(2-a-1) - Required front setback. (50-Poot front setbaok
' required; 20-foot setback proposed for 6-foot high
wall. )
2. That waiver 1-a, above mentioned, is hereby granted for this specific use of
outdoor repair oP truak tires only.
3. That waiver 1-b, above mentioned, is horeby granted on tho basis that the wa11
t:nuld te enalosing an existing use thereby upgrading tb.e area e,n3 its general appearance,
and shi.~:ld not be construed as estab].ishing a precedent for waiver of any other building
setback requests in the M-1 Zone.
4. That the petitioner stipulated to providing a landscape~ plan for the front
setback areas, and that the plan would be submitted to the Development Serviaes Department
for approval.
5. That there are exceptional or extraordinary cir.cumstances or oonditiona eppiicable
to the property im~olved or to the intended use o£ the property~ thet do not apnly genorally
to the property or cless of use in the same vicinity and zone.
6. Thet the requested variance is necessary for tho preservation and onjoyment of a
substantial property right possessed by other property in the same vicinity snd zone, e.nd
denied to the proper~Ly in question.
7. That the requested varience wi'l1 not be materially detrimental to the public wel-
faro or injurious to the property or improveoents in such vicinity and zone in which the

ENVIRONt~GENTAL IMPACT REPOhT FINDING:
Petitioner has requested oxamption from requirements for filing of an Environmental Impact
Report. Review of the request and the Environmental Impact Questionnaire indicates the
proposal would have no significant environme.tal impact. Staff would, therefore, recommend
exemption declaration status be granted.
NOW, THEREFORE, BE I? RESOL'JED that the Anaheim City Planning Comm~ssion does hereby
grant subject Petition for Uariance, upon the following condi~tions which are hereby found
to be a necessa*y prerequisite to the proposed use of the subject property in order to
preserve the safety and g'sneral welfare of the Citizens of the City of Aneheim:
(1) That street lighting facil:.tios along Blue Gum and Coronado Streets shall be
installed as required by the Director oY Public Utilities and in accordance with standard
plans and speo:fications on file in tha offioe of the Direotor of Public Utilities; and
that a bond i:: an amouni: and form satisfactory to the City of Anahei9 shall be posted with
the City to guarantee the i.nstallation of the above mentioned requirement.
(2) That trash storage areas shall be provided in accox•danoe with approved plans
on file mith the office of ',;he Director of Public Works.
(3) That a 6-foot mascnry wall shall be oonstruated along the so~ith and e:'~st
property lines.
(4) That the final parking plan shall be approved by the Development Services
Department, and any .landscaped areas in the parking area shall be protected with 6-inch
high, concrete curbs, and conorete wheel stops shall be provided for parking spaces as'
required.
(5) That subject property shall be developed substantially in conformanco with
plans and speoifications on file with the City of Anaheim, marked Exhibit I4o. 1.
(6) That Condition Nos. 1, 3, and 4, above mentioned, must be completed within
90 days of the approval of the resolution.
(7) Thai~ any storage of tires proposed behind the 6-foot masonry wall shall be no
higher than said 6-foot wall.
(8) That the use granted shall be for the outdoor repair of truck tires only.
(9) That a landscape plan for subject property sha11 be submittod to the Develop-
ment Serviaes Department for review and approval, as stipulated to by the petitioner. Any
docision made bv the Developmont Services Department on said plan may bo appealed to the
Planning Comraission and~or City Council.
