A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2527 BE DENIED
WHEREaS, the City Planning Commission of the City of Anaheim did receive a verificd Petition for Variance from
NORM'S RESTAU?tANTS, INCORPOkATED, 10801 National Boulevard, Los Angeles, California 90064,
Owner; JOHN CRAIG NEIDLINGER, 10801 National Boulevard, Los Angeles, California 90064,
Agant of certain real property situaeed in the City of Anaheim, County of Orange, State
of Caiifornia, as•described in Exhibit "A" attached hereto and referred to herein as though
set forth in full
WHEREAS, the City Planning Commission did hold a pu3lic hcaring at the City Hall in the City of Maheim on
July 23, 1973, at 2:00 o'clock p.m., notice of said public hearing ha~~ng been duly ~iven az required by ]aw and
in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for and against snid
proposed variance and to investigate and make Gndings and recommendatlons in connection therewith; and
WHEREAS, said Commission, aftcr duc inspectior., im~estigation, and study made by itself and in its behnlf, and after due
consideration of all evideace and rep~rts offered at said hearing, does find and determine the following facts:
1. That thc petitioner requests variances frem the Anaheim Municipal Code as followa:
a. SECTION 18.52.090(2) - Hei~ht of free-standin si n within 300-foot radiua
of residential use. (25 feet high pernitted; 50
feet high proposed)
b, SECTION 18.62.090(5) - Lo,^.ation of free-atandin~ si~n. (Within center 20%
of irontage required; within center 35% of fronta~e
proposed)
c, SECTION 18.62.160(b) - Restriction on ElashinK sign within 30Q-foot radius
of residential use. (None permitted; one proposed)
d, SECTIQN 18,62.160(a? - Hei ht of flashin si n. (25 feet high in any zone
unless 500 feet from residentiel use; 50 feet high
proposed)
2. That the petitioner hae not preaented substantiating evidence that a hardship
exiated and that he wes being deprived of a privilege granted to others.
3. That any hardship that might exist ie self-impuaed, aince the signing of subject
property could be accompliahed within the requirementa of the Sign Ordinance.
G. That there are no exceptional or extraordinary circumstances or conditions appli-
cable to the property involved or to the intended use of the properCy that do not apply
generally to the property or class of use in the same vicinity and zone,
5. That the requested variance is not necessary for the preservation and enjoyment
of a substantial property righC possessed by otVier property in the same vicinity and zone,
and denied to the property in question.

6. That the requested variance will be materially detrimental to the public welfare
or injurious to the property or improvements in such vicinity and zone in which the property
is located.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Co~aaiseion, in connection with an Exeoption Declaration Status request,
finds and determines that the proposal would have no significant environmentsl impact and,
therefore, recommends to the Ci~y Council Chat no Environmental Impact Statemeut is
necessary.
NOW, THEREFOR.., BE IT RESOLVED that the Maheim City Planning Commission does hereby deny subject Petition for
Variance on lhe basis of the aforementioned finds.
