FILIPPO LEPORE, 3152 West Lincoln Avenue, Anaheim, Califo m ia 92804, Agent of certain real
property sit~ated in the City of Anaheim, County of Oranne, State of California, as described
in Exhibit "A" attached here*_o and referred to herein as though set forth in full

WHEREAS, the City, Planning Commission did hold a public hcaring at the City Hall in the City of Anaheim or.
Auaust 6, i 973 o at 2:00 o'clock P.M., notice of said public heering havin~ been duly given as required by
law and in accocdence with the ptovisions of i::~ i+naheim Municipal code, Chapter 18.64, to hear and considec evidence
for and agair.st said pcoposed conditionel use end to investiga:e and make findings and recommendations in connection
therewith; end
WHEREAS, said Commission, aftec due inspection, investiga:ion, and study mede by itself end in its behalf, and
efter due consideration of all evidence and ceports offered at said hearing, does find and ~etercr.ine the following facts:
1. Thet the proposed use is prr~erly one Eor which a Conditional Use Permit is authorized by Code Sect i on'
18.40.069!g) to wit: establi:n on-sale beer and wine in conjunction with a proposed restau-
rant in an existing shoppir.g center.
2. That the proposed use will not adversely affect. the adjoinzng land uses and the growth nnd development of
the area in which it is propused to be located.
3. That the size and shape ot the site proposed foc the use is adequate to allow the full development of the
pmposed use in a manner not detrimentel to the perticulac erea nor to the peace, health, safety, and general welfece of
the Citlzans of the City of Aneheim.
4. Tfiat the granting of the Conditional Use Pecmit under the conditions imposed, if uny, will not be detrinental
to the geace, health, safety, and general welfr,re of the Citizens of the City of Anaheim.
5. That the petitioner stipulaled to provi;]ing no live entertainment.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Commission, in connection with an Exemption Declaration Status request,
finds and determines that the proposal would have no significant environmental impact and,
therefore, recommends to the City Council that no Environmental Impact Statement is necessary.

, NOW, THEREFORE, BE 1T R~LVED that the Aneheim City Plenning C~ ission does heceby grant subject
Petition for Conditionel Use Permit, upon the following conditions wh~ch ace hereby found to be a necessery prerequisite
to the proposed use of the subject property in order to pcesecve the seEety and general welface ofthe Citizens oEthe
Clty of Aneheim:
(1) That the ewner(s) of subject property shall pay to the City of Anaheim the sum
o` $2.00 per fr'nnt foot along Topanga Drive for street lighting purposes.
(2) That the owne~(s) of subject property shail pay to the City of Anaheim the sum
of 60~ per front foot along Lincoln Avenue for tree plant.ing purposes..
(3) That ~~~ash storage areas shall be provided in accordance with approved plars on
file witfi the office of the Director of Public Works. ,
(4) That subJect property shall be developed substantially in conformance with plans
and speciTications on file with the City of Anaheim marked Exhibit No.. l.
(5) That Co~di:io:~ Nos. 1 and 2, above mentioned, sh311 be complied with prior to
the commencernent of the activity authorized under this resolution, or prior to the time
that the building permit is issued or within a period of one year from date hereof, which-
eveF accurs first, or such further time as the Planning Commission may grant.
(6) That Condittons No. 3 and 4, above rr~ntioned shall be complied with prior to final
building and zcring i~spection5.
(7) That serving of beer and wine shall be incidental to the serving of food, and that
no bar would be perm~tted,
(8) That no li~e entertainment shall be permitted as stipulated to by the petitioner.
