A RESOLUTION OF THE CITY PLANNING COMMISSION OF~T 9 ~BE GRANTEDHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT
WHEREAS, the City Plenning Commission of the City oE Meheim cSid receive a verified Petition for Con-
ditionalUse Permitfrom ANAHEIM BAPTIST CHURCN, 305 east Broac~way, Anaheim, California 92805,
Owner; MEL TURNER, 317 East Bro~dway, An~heim, California 92805, Agent of certain real
property situated in the City of Anaheim, County of Orange, State of California described
as Lot No. 23 through 29, Block "C" of Center Tract
; and
WHEREAS, the CityPlenning Commission did hold e public hearing at the CityHail in the City of Aneheim
on August 20, 19]3~ at Z:00 o'clock P.M., notice of seid public hearing heving been duly given
as required by law and in eccordence with the provisions of the Meheim Municipel code, Cl~apter 18.64, to hear
and consider evidence Eor and egainst said proposed conditional use end to lnvestigate and meke findings and
recommend~tinns in connection therewith; end
WHEREAS, seid Commission, eEter due inspection, investigation, and study made by itself and in its bo-
helf, and eEter due consideretian oE all evidence and reports otEered at said hearing, does find and determine the
following fects:
1. Thet the proposed use is properly one for which e Conditionel Use Permit is authorized by COde Sect i on
1$.64,020(b and f} to establish a pre-school and Christian day school facility for a max-
imum of 50 pupils, with waivers of:
a. SECTION 18.04.030(13) - Minimum -equired nw~~ber of parkinq spaces.
(20 spaces required; s aces proposed)
b, SECTION 18.28.050(6)(5)(3){e)(3) -~Irouaht iron or other typas of open work
metal fences. (Chainlink fence not permit-
ted; ~F-foot h~igh chainlink fence proposed)
2. That 4laiver 1-a, above mentior,ed, is hereby granted on the basis that churches
which have been established in the downtown area have beEn granted parking waivers in the
past.
3, That l'a~ver 1-b, above mentioned, is hereby granted on the basis that although
subject property is ~oned R-3, and the zones site development standards require wrought
iron or open work metal fcrces, it has been established for a church, and a 5-foot high
chainlink is proposed as stipulated to by the pet~tioner.
4, That the proposed use will not adversely affect the ad,joi~ing land uses and the.
qrowth and development of the area in which it i:, proposed to be located.
5. That the size and shape of the site proposed for the use is adequate to allow the
full development of the proposed use in a manner not detrimental to the particular area
nor to the peace, health, safety, and general welfare of the Citizens of the City of
Anaheim.
6, That the gra~ting of the ConditiAnal Use Permit under the conditions imposed, if
any, will not be detrimencal to the peac:e, health, safety, and general welfare of the Cit-
izens of the City of Anaheim.

ENVIRONMENTAL IMPACT REPORT FINDING:
That tiie Planning Commission, in connection with an Exemption Declaration Status request,
finds a~d determires that the proposal.would have no significant environmental impact and,
therefore, recommends to the City Council that no Environment~l Impact Statement ~s neces~,-:+ry,
NOW, THEREFQP,E; BE IT RESOLVE~ that the Anaheim City Planning Commission does hereby
grant subject Petition for Conditionai Usc PPrmit, upon the following conditions which are
hereby found to b~: a neressary prerequisite to the propGS:.~ use of the subject property in
order to preserve the safety and general welfare of the Citizens of tfie City of Anaheim:
(1) That trash storage areas shall be provided in accordance with approved plans on
file with the uffice of the Director of Public Works.
(2) Thac the final parking plan shall be approved by the Development Services Di;partment,
and any landscaped areas in the parking area shall be protected with 6-inch 8~igh, concrete
curbs, and concrete wheel stops shall be provided for park3ng spaces.
(3) That subject property shall be developed substantially in accordance with plans and
specifications on file w~th the City of Anaheim marked Exhibit No. 1, provided however, that
th~; cha'.niink fence shall be a minimum of 5 feet high.
(4) That CoRdition Ncs. 1, 2 and 3, above mentioned, shall be complled with prior to
comme.ncement of the activity proposed.
