WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on
August 20, 9 973, at 7: 30 o'clock p.m., notice of said public hearing having been duly given as required by law and
in accordance with the provisions of the Maheim Municipal Code, Chapter 18.68,to hear and cottsider evidence for and againstsaid
proposed variance and to investigate and make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due
consideration of all evidence and reports offered at said laearing, does find and determine the following facts:
1. That the petitioner requests vaiiances from the Anah~i.m Municipal Code as follnws to estab-
lish 245 R-I zor.ed lots within three tracts:
a. SECTIUN 18.24.030(4)(a) - M:nimum Zot area. (7200 square feet required;
6000 square feet proposed)
b. SECTION 18.24,030(4)(a) - Minimvm lot width. (70 feet required; 33 feet
prcposed)
c. S;;CTION 2A.04.075 = Reaclrement that siaRle-familv residential struc-
tures rear on arteriai hi~hways.
d. SECTION 18.08.550 - Minimum 1ot width on cul-de-sac. (60 feet required;
15 feet proposed)
e. SECTION 18.24.030(T)(a) - ReUuired setback between front propertv line and
aK r~Ke• (6 to 10 or 25 feet required; 20 feet

2, That Wai/er l~e, &tove mentioned, ie hereby denied oa the basis that adequate
variations in setbacks can be provided within the lim;.t,~tions of the site development
standards of Che R-1 ZonE, and that the petitioner had not proven a hardship would exist
if said waiver were not grpnted.
3. That there are exceptional or extraordirary circumst~nces or conditions applicable
to the proper.~y involved or to the intended use of the proparty l.hat do not apply generally
to the property or class of use in the same vicinity and zone, due to the terrain of the
.land.
4. That tlie requested variance is necessary for the preservation and enjoyment of a
substantial pruperty rlght postessed by other property in ~he same vicinity and zone, and
denied to the property in question.

6. That the petitioner` stipulated to complying wiCh the~pad area requirements of
the RS-5000 zone.
7, That one person, representing members of a homeowners association, sppeared in
opposition,
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Commission in connection with the filing of Environmental Impact Report
No. 98, finds and determines that the E.I.R. Review Committee determined that the Repart is
adequate as an informative document and follows the City's established guidelines, and that
there would be no significant adverse environmental impacts; therefore, the Plannin;e
Commission recommends to the City Couacil that said report be adopted as the Council~s
Environmental Impact Statement.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Coimnission does hereby
grant in part subject Petition for Variance, upon the following conditions which aCe h~•reby
found to be a necessary prerequisite to the proposed use of the subject property in order
to preserve the safety and general welfare of the Citizens of the City of Anaheim:
(1) That this variance is granted subject to the approval of Tentative Tract Nos.
3375, 8376, and 8377 and Reclassification No. 71-72-44.
(21 That aubject property shall be developed cubstantially in accordance with plans
and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3, and 4
provlded, however, that garage setbacks she12 be in conformance with the site development
standards of the R-1 Zone.
(3) That all building pad areas shail be in conformance wiCh the formula established
for pad areas in the RS-5000 Zone, wherein for each additional bedroom ovar three, a mini-
mum of 850 square feet shall be provided, as stipulated to by the developer.
