A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM

WHEREAS, the Ci:y Planning Commission of the City of Anaheim did receive a verified Petition for Con-

Anaheim Hills Road, Anaheim, California 92806, Owners; SOUTHWEST PROPERTIES, INCOR-
PORATED, i:n care of Timothy Unger, Post Of£ice Box 5387, Orange, California 92669,
Agent of certain real property situated in the City of Anaheim, County of Orange,
State of California, as described in Exhibit "A" attached hereto and referred to
herein as though set forth in full
; and
WHGREAS,the CityPYanning Commission did hold e public hearing at the CityHall in the City of Anaheim
on September 5, 1973, at 2:00 o'clock P.M., notice of seid public hearing having been duly givr.n
es required by law and in accordance with the provisions of the Anaheim Municipel code, Chapter 18.64,to hear
and consider evidence Eor and egainst said proposed conditional use and to investigate and make findings and
recommendations in connection therewith; end
WHEREAS, said Commission, efter due inspection, investigetion, and study mede by itself and in its be-
half, and after due consideration of all evidence and reports affered at seid hearing, daes Eind and determine the
following focts:
1. That the proposed use is properly one for which e Conditional ~.1^e Permit is euthorized by Code Sect i or~
18.28.040(i) to wit: establish a 119-unit one and two-story planned residential develop-
ment with waivers of:
a. SECTION 18.08.440 - Requi'red frontaqe of lr.ts on a dedicated street.

b. SECTION 18.28.050(1)(a) - Minimum buildina site a:~a. (7200 square feet
required; 2050 square feet proposed)
c. SECTION 18.28.050(t)(B) - Minimum buildinq site width. ( 0 feet required;
2 feet proposed)

residential zone boundarv. (Wall required;

2. That since the Commission has recorccnended disapproval oP the reclassificatien
of subject property, the proposed development could not be accamplished ivithin ths site d~_
velopment stand'ards of the_zoning•on.subject.property.
3. That the proposed waivers 1-a, 1-b, and 1-c, above mentio~ed,are usualiy necessary
in the consideration of a planned residential development.
4. That the proposed use will adverseiy affect the adjoining la~d uses a~d the g~owth
and development of the area in which tt is proposed to be located. '.
5. That 5 persons appeared representing 25 persons present in the Council Chamber,
all in opposition; and that a petition signed by 140 persons was received all ir oppositio~.

ENVIRONMENTAL IMPACi REPORT FINDING:
fhet the Planning Comnission in connection with the filing of Environmental Impact Repc~t
No. 97 finds and determines that the E.I.R. Review Committee determined that the Report is
adeq~eate as an informative document and follows the City's establishad guidelines, and that
there would be/s°gnificant adverse environmental impacts; therefore, the Planning Commission
recomroends to the City Co~rcil that said report be adopted as the Council's Environmental
Impact Statement.

NOW, THEREFORE, BE IT RESOLVED that the Aneheim City Planning Commiesion does hereby deny subject
Petition for Conditionel Use Permit on the basis of the afocementioned findings.
