A RESOLUTION OF THE CITY PLANIIING COMMISSION QF THE CITY OF ANAHEIM
THAT PETITION FOR VARSANCE NO. 24~2 BE GRANTED
WHEREAB, the City Plenning Commission of the City of Anaheim did receive a veriEied Petition for Varience
from ~~IE VAN DUSEN, 700 South Euclid, Anaheim, California 92802, Owne:; RICHARD AND SANDRA
MC KINNEY, 5132 Fostor.ia, Cudahy, California 90201, Agent of certain real property situated
in the City of Anaheim, County of Orange, SCate of Califo:nia, described as Lot No. 90 of
Tract No. 2381
; and
WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of hneheim
on January 22, 1973 , et 2:00 o'clock P.M., notice of said public hearing having been duly given es required
by law and in eccordance with the provisions of the Aneheim Municipal Code, Chepter 15.68,to hear and consider
evidenrt:e for and egeinst said proposed variance end to investigete and meke findings and recommendations in connec-
tion the~ewith; and
WHEREAS, seid Commission, efter due inspection, investigetIon, and study made by itself and in its behalf,
and after due consideration of all evidence end reports oEfeced at seid hearing, does Eind a~d determine the fo?lowing
facts:
1. Thet the petitioner cequests a verience {rom the Aneheim Municipal Code:
SECTION 18.38.020 - Permitted uses. (To establ.ish a beauty t~alon and wig shop in
an existing residential structure)
2. That there are exceptional or extroordinery circumstences or conditions applicable to the pcoperty involved
or to the intended use of the property that do not apply genera!ly to the property or cless of use in the same vicinity
and zone.
3. That the requested veriance is necessary far the preservation end enjoyment of e substentie] praperty right
possessed by other property in the snme vicinity end zone, end denied to the property in question.
4. That the requested variance will not be meteriolly detrimental to the public welfare or injurious to the prop-
erty or improvements in sucn vicinity and zone in which the propecty is loceted.
5. That the petitioner stipulated the[ he would not liave more than two operators in the
propoaed business.
6. That the petitioner stipulated to a three-year time 7.imitation of the proposed use
in the existing structure to determine if any parking problems might occur; and if at the end
of the three years, it ia apparent that a parkfng problem exists, before the time limit may be
extended, modifications must be made to the property to pruvide additional parking spaces.

That the Planning Commission, in connection with an Exemption Declaration Status request, finds
'and determines that L•he proposal would have no signi£icant enviranmental impact and, therefore,
recomnends to the Cil-y Council that no ~nvironmental Impact Statement is necessary.

~ Petltio~ for Variance, upon the following conditions which a~•e heteby found to be a necessary precequisite to the Qro-
posed use of the subject property in order to preserve the safaiy end generel welfece of the Citizens of the City cE
Aneheim:
(1) That the owner(s) of subject property shall pay to the City of Anaheim tt~e sum of
15 cents per front foot along Euclid Street for tree planting purposes.
(2) That trash storage areas shall be provided in accordance with approved plans on
file with the office of the Director of Public Works,
(3) That the existing structure shall be brought up to the minimum sta:idards of the City
of Anaheim, includ3.ng the Uniform Building, Plumbing, Electrical,.Housing, Mechanical and Fire
Codes ~~~ adopted by the City of Anaheim.
(4) That all air conditioning facilities shall be properly shielded from vlew and the
sound buffered from adjacent properties.
(5) That the final parking pian shall be approved by the Development Services Department
and any landscaped areas in the parking area shall be protected with six-inch high concrete
curbs, and concrete wheel stops shall be provided far parking spaces.
(6) That subject property shall be developed substantially in accordance with plans and
specifications on file with the City of Anahein marked Exhibit Nos. 1 and 2 provided, however,
that only two chairs and two operators shall. be operating in this proposed establishment, as
stipulated to by the petitioner.
(7) That Condition No. 1, ebove mentioned, shall be complied with prior to the commence-
ment of the activity authorized unde; this resolution, or prior to the time that the building
permit is issued, or within a period o£ ~~a year from the date hereof, whichever occurs first,
or such fcrther Cime as the Plannir.g Cocmnission may grant.
(8) That Condition ivos. 2, 3, 4, 5, and 6, above mentioned, shall be complied with priox
to final building and zoning in~pections.
(9) That the proposed use is granted for a period o£ three years in order for the Plan-
ning Commission to determine whether any parking problema may result from the proposed use.
At the er.piration of the three-year period, and upon request by the peti.t.ioner, the Planning
Commission may grar.t an additional period of time if no parking problems er.ist. If there are
parking proUlems,. modifications will have to be made to the site to eliminate these problems
before the use may be extend~d.
