A RESOLUTION OF THE C1TY PLANNING COMMISSION OF THECITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2553 BE GRANTED
WHEREAS, the City Planning Commission of the City of Maheim did receive a verified Petition for Variance from
ANAHEIM HILLS, INCORPORATED AND TEXACO VENTURES, INCORPORATED, 380 Anaheim Hills Road,
Anaheim, California 92807, Owner; JAMES L. BARISIC, 380 Anaheim Hills Road, Anaheim,
California 92807, Agent of certain real property situated in the City of Anaheim, County
of Orange, State of Califar.nia, as de~cribed in Exhibit "A"'attached h~reEo end ieferred
to herein~es though set forth in full; and
WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anahcim on
Octobet 1, 7.973 at 2:00 o clock p.m., notice of sald public hearing having been duly given as required by law and
in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for and against said
proposed variance and to investigate and make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation, and study made by itseif and in its behnif, and aCter due
consideration of all evidence and reports offcrcd at said hearing, does find and determine the following facts:
1. That tlie petitioner requests variances from the Anaheim Municipal Code as follows to con-
struct a 108-unit apartment complex:
(a) SECTION 18.28.050(5)(B) - Maximum buildinR heifiht. (one-atory permitted;
two-story proposed)
(b) SECTION 18.28.050(10)(D), - Requirement L•hat carports be enclosed_on three
aides.
2. That Waiver 1-a, above mentioned, is hereby gr.anted.on the basis Chat due to the
terrain of subject property and propexty affected by Che height waiver, the sin~le fair.ily
homes would have a line of sight over the top of the apartment complex, and the apartment
complex in no way would be able to view the single family development.
3. That Waiver 1-b, above mentioned, is hereby granted on the basis that similar open
carports have been granted in the past L•o take advanCage of lan~?• •ping and view rather
than subjacting an area with a row of stucco or bricN wall ce.r•.:.r.t_.
4. That the petitioner proposed to locete a porCi,~q of ,ubjvEr.C pro~ertv'R slopes on

7. That the requea~ variance will not be materiel~etrimental to the
public welfare or injurious to the property or improvements in auah vicinity and
zone in which the property is located.
8. That three persons nppeared in opposition, one reprpsenting the Orange
Unified School District.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Commiesion in connection with the filing of Environmental Impact Report
No. 101, finds and detezmines that the E.I.R. Review Co~ittee determined that the Report
is adeauate as an informative document and follows the City's establiahed guidelines, and
that there would be no significant adverse er.vironmental impacts; and, therefore, the
Planning Cos~ission reco~ends to the City Council that said report be adopted as the
Council's Environmental Impact Statement.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Plunning Cormniseion doea hereby
grant subject PeCition for Variance, upon the following conditions which are hereby found
to be a necessary prerequieite to the proposed uae of the suUject property in order to
preserve the safety and general welfare of the Citizene of tile City of Anaheim:
(1) That the owner(s) of subject property shall pay to the City of Anaheim the aum
of 60 cents per front foot along Canyon Rim Road for tree pl~nting purposes.
(2) That trash storage areas shall be provided in acco:rdance with approved plar.s on
file with the office of the Director of Public Works.
(3) That fire hydrants ahall be inetalled and charged ae required and determined to
be necessary by the Chief of the Fire Department prior to cc~nrtaencement of atructural framing.
(4) That all air conditi~ning facilities ahall be properly shielded from view, and
the sound buffered from adjacent properties.
(5) That subject property shall be served by underground utilities.
(5) That the owner(s) of subject property ehall pay to the City of Anaheim the appro-
priate park and recreation in-lieu fees as determined to be appropriate by the City Council,
said feea to be peid at the time the buildit~g pe~it is iseued.
(7) That the final parking plan shell be epproved by the Development Servicea Depart-
ment, and any landscaped areas in the parking areas ahall be protected wtth aix-inch high
concrete curbs, and concrete whe~el stops ehall be provided for parking spaces.
(8) That thia Variance is granted sub3ecC to the completion of Reclassification No.
71-72-44, now pPnding.
(9) That drainage of said properYy ehall be diaponed of in a menner. satiafactory to
the City Engineer. If, in the preparation of the site, sufficient gradi.~~g is raquired to
neceasitate a grading permit, no work on grading will be permitted between October 15th
and April 15th unlesa all required off-aite drainege facilities heve been inetalled end
are operative. Positive asaurance ahall be provided the City that euch drainage facilitiea
will be completed prior to October 15th. Necessary right-of-way for o£f-eiCe drainage
facilities ahall be dedicated to the City, or the City Council ahall have initiated con-
demnation proeeedings therefor (the coata of which ahall be borne ty the developer) prior
to the commencemenC of grading operatioq~, The rer~uired drainage facilities sha11 be of

and specifications on file with the City of Anaheim marked Exhibit Nos. 1, Z, 3, an~ 4.
(13) That Condition Nos. 1, 8, and 11, above mentioned, shall be complied with prior
to the commencement of the activity authorized under this resolution, or prior to the time
that the building permit is issued, or within a period of one year from date hereof, which-
ever occurs first, or such further time as the Planning Commission may grant.
(14) That Condition Nos. 2, 4, 5, 7, 9, 10 and 12, .•bova mentioned, shall be complied
with prior to final building and zoning inspectionE.
