A RESOLUTION OF THE CITY PLANNING COMTIISSION OF THE CiTY OF ANAHEIM
THATPETITIONFORVARIANCENO. 2554 BE GRANTED
WHEREAS, the City Planning Commission of thc City of Maheim did receive a verified Petition for Variance from
JAMES W. AND RELUND M, CUMMINS, 1200 West Rowan Street, Anaheim, California 92801.
Ow^ers of certain real property situated in the City of Anaheim, County of Oranae, State
of California described as Lot 17 of Tract No. 2838, as per map recorded in book $0 pages
i4 ar,d 15 of Miscellaneous Maps, in the office of the county recorder of said county
WHEREAS, the City Planning Commission did hold a publlc hearing at the City Hall in the City of Anahcim on
Octobe r 1, t 973 , at 2:00 o'clock p.m., notiee of snld public hearing having been duly given as required by law and
in accordance with the provisions a[ the Maheim Municipal Code, Chapter 18.68, to hear and cohs(der evidence Cor and against said
proposed varia~ice nnd to investigate and meke findings and recommendations in connection therewith; and
Wt1EREAS, said Commission, aftcr due inspection, invesUgation, and study made by itself and in its behalf, and after duc
considcration oCall evidance and reports offered at said hearing, does find and determine the following facls:
I. ThatthepetiHonerrequeststhe fol lowing variances f~om the Anaheim Mur~icipal Code to
permit additions to the existing residential structure:
a. SECTION 18.20.030~3-a) - Rear vard setback. (2 feet required; feet pr~~posed)
b. SECTIUN 18.20.030(1-a) - Garaae setback. (Either 2 feet mi-imum or 6-1~ f ot
with automatic garage door opener permitted;~
setback existing)
c. SECTION 18.20.030~4-d1 - Dwellinq qround floor soace. (20a~6 square feet
minimum required; 1500 square fe_e.t; existing)
2. That Waiver 1-a, above mentioned, is hereby gra~ted on the ba<.~is that the property
is a corr,er lot, and the setback presently existing is only 8 feet from the garage to the
property line, while the petitioner proposes to add a 5-foot addition tc~ within three ~~-=t
of the property lfne, however, the total square footage of the rear yarcl (s more than required
by the Anaheim Municipal Code.
3. That Waiver t-b, above mentioned, is hereby granted on the ba,is that the garage
setback has been developed at 13~ feet for a number of years.
4, That Waiver 1-c, above mentioned, is hereby granted on the ba~sis that with the
proposed addition, the total square footage would be approximately 2335 square feet, there-
by meeting Code requirement.
5, That there are exceptional or extraordinary circumstances or ~~ondttions applicable
to the property involved or to the intended use of the property that do not apply generally
to the property or class of use in the same vicinity and zone.
6, That the requested variance is necessary for the preservation and enJoyment of a
substantial property right pnssessed by other property in the same vicinity and zone, and
denied to the property in question.

7. That the requested variance will not be materially detrimental to the public welfare
or irijurious to the property or improvements in such vicinity and zone in which thp pr~perty
is located.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Commission, in connection with an Exemption Declaration Status request,
finds and determines that the proposal would have no significant environmental impact and,
therefore, recommends to the City Council that no Environmental Impact Statement is neces-
sary.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City P'lanning Commission dues hereby
grant subject Petition for Variance, upon the following conditions which are hereby found
to be a necessary prerequis(te to the proposed use of the subject property in order to pre-
serve the general welfare of the Citizens of the City of Anaheim:
(,1) That subject proper`y shall be developed substantially in accordance with plans
and specifications on Tile with the City of Anaheim marked Exhibit Nos. 1 and 2.
