WHEREAS, the City. Planning Commission did hold a public hearing at the City Hall ;n the City of Anahedm on
October 15, 1973, at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by
law and in accordance with the provisions of the Anaheim Municipal code, Chaptet 18.64, to hear and consider evidence
for and ageir.st seid proposed conditional use and to investigate and make findings end recor,~mendations in connection
there~.vith; end
WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and
after due consideration of ell evi~ence and reports offered at said hearing, does find and detettnine the fotlowing facts:
1. Thet the proposed use is properly one ior which a Conditional Use Pertnit is authocized by Code Section
18.40.060 (e) and (g) to establish a semi-enclosed restaurant with onusalc beer wiCh waiver
of:
a. SECTION 18.62.090(B)(2) - Minimum height of free-standi.ng sign. (EiQht feet
required; Q>'feet proposed)
2. That GTaiver i-a, above mentioned, is hereby granted on the basis that similar
waivers have been granted in the past where monumenC type si$ns have been proposed.
3. That the pcoposed use will not adversely affect. the adjoining land uses and the growth and development oF
the area in which it is prooosed to be loceted.
4• That the size ond shape of the site proposed for the use is adequate to allow the full development of the
pmposed use in e manner not detrimental to the par.tculer erea nor to the peace, health, safety, and general welfere oE
the Citizens of the City of Aneheim.
5• That the granting of the Conditionol Use Permit under the conditions imposed, if any, will not be detrimental
to the pence, health, safety, and general welfare of the Citizens of the Ctty oE Anaheim.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Commissian, in connection with an Exemption Declaration Statua request,
finds and determines that the proposol would have no significant environaiental impact and,
therefore, recommends to the City Coun~f,l that no Environmental Impect StaCement is necessary.

NOW, THEREFORE, BE IT RESOLVED thet the Anaheim Cicy Plenning Comm:~sion does hereby grant subject
Petition for Conditionel Use Permik, upon the followIng conditions which ere hereby found to be a necessery prerequisite
to the proposed use oE the subject property in ocder to ptesecve the sefety end general welfere of the Citizens of the
City of Aneheim: .
(1) That approp*iate water assessment fees as determined by the Director of Public
Utilities shall be paid to the City of Anaheim prior to the issuance of a building permit,
(2) That subject properCy shall be developed substantially in accordance with plans
and specificstions on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3, 4, 5, and
6.
(3) That Condition Nos. 1 and 2, above mentioned, shall be complied with prior to
the commencement of the activity authorized uader this resolution, or piior to the'time
that the building permit is issued, or within a peri.od of one year from date hereof, which-
ever occurs first, or such further time as the Planning Commission may grant.
