that eimilar waivers have been previously approved by the Commission to allow development
of. the "postage stamp" lot concept of townhouse projects.
3. That Waiver 1-d, above-mentioned, ia hereby graated on the basis that the single-
£amily zone would be at a higher elevation than the proposed development and is separated
'by an extpnsive drainage easement whera the proposed development is at the same elevation,
ae illuatrated 8n the plan of the site and the topogYephy of the land; however, granting
of this waiver shall not establish a precedent for aimilar waivers unlesa r+ubatantiating
evidence has been presented to justi.fy waiver of the height limitation.

That the Planning Commission, in connection with the filing of EnvironmenCal Impact Report
No, 105, recommends to the City Council that said report be adopted as the Council?s fin-
vironmenral Impact Statement, with the specific Einding that *_he EIII is in complete and
total compliance with the Environmental Quality Act of the State of California; that the
repurt, in every way, follows the Cil-yTS Established Guidelines to the Requirements for
the Filin~; o£ an Environmeatal Impact Repott; and that Che Planning Commi.SSion has read,
analyzed and assimilatecl EIR No. 105 and, therefore, has made the aforementioned L-indings.

grant in part subjecb Petition for Conditional Use Permit, upon the following conditions

the time that the building permit is issued, or within a period of one year from date
