A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT ~Z-BE GRANTED
WHEREAS, the City Planning Commission oE the City of Anaheim did receive a verified Petition for Con-
ditional Use Permit from ALEXANDER HAAGEN DEVELOPMENT, 777 Silver Spur Road~ No. 224~
Rolling Hi12s Estates, California 90274, Owner; DR. G~NE E. HOFACRE AND DR. MICHAEL
E. TUR~1N0, 1407 Rose Drive, Placentia, California 92670, Ageats of certain real prop-
erty situated in the City o£ Aeaheim, County of Orange, State of California, described
as Lots 6, 7 and 8 of Tract No. 936 as per map recorded in Book 30 Pages 1 and 2 of
Miscelianeous Maps, in the officr.. of the County Recorder of said county. Except from
said Lots 7 and 8 that portion lying northerly of the southerly line of the land des-
cribed in the deeds to the State of California recorded May 18, 1948 in Book 1638 Page
365 of Official Records, recorded May 26, 1948 in Book 1643 Page 306 of Official Records
and recorded June 4, 1948 in Boek 1647 Page 532, of Official Records. A portion of said
land is included within the area shown on a map filed in IIook 74 Page 2 of Record of
Sur~•eys in ttie ciffice ot the Cnenty Recorder of said county

on December 10, 1973~ at 2:OQ'o'ciock a~.S1., notice of seid public hearing heving been duiy given
as cequired by law and in arc~r~la:ua wath it~,e Dfovpsions of the Anehein Municipal code, Chepter 18.64, to hear
and consider evidence for en;; ake~nst sr•f$ pn:posed :.onditional use and to investigate and make findings and

following facis:
1. That the prop~se3 uss~ i~s properly one for which e Conditional Use :°ermit is authotized by Code Section
18.40.060(1), to wit: establish a veCerinary clinic in a shopping'cenCer.
2. That the proposed use will not adverFely affecr the a3joining land uses and the
growth and development of the area in which t•: is ptoposed to:.be located.
3. That the size and shape of the site proposed for the ase is adequate to allow
the full development of the proposed use iu a~anner not det•rimental to the particular
area nor to the peace, health, safety, and genesal welEare of the CiCizens of the City
of Anaheim.
4. That the petitioner stipulated that the hours of operatian would not extend be-
yond 6:00 p.m.
5. That the petitioner stipulated thah there would Ue no outdoor facilities, and
any propo~ed animal runs or stalls wauld be located within the conf•ines of the building.
6. That the petitioner stipulated that the subject use would be operated within the
definition of "clinic',!' as set forth by the American Vet@rinary Association;and, as such,
would not permit overnight or any other boarding of animals, but would provide out-patient
care and services only.
7. That the petitioner stipulated that ttie construction of subject clinic wculd pro-
vide for sound attenuatioii similar to hospitals to insure that no "noisy" sounds would be
emitted _o the outside of the building strucCure.
:i. That the granting of the Conditione: Use Permit under the conditiona imposed, if
any, will not be det'rimental to the peace, health, safety, and general welfare of the
Citizens of the City of Anaheim.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Plann~ittg Commission, in connection with an Exemption Declaration Status request,
finds and deterr~ines that the proposal would hs~e no significant environmental impact and,
Cherefore, recommends tu the City Council that no Environmental Impact Statement is neces-
sary,

NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Plenning Commissioe doms hereby grant subject
petition for Conditionel Use Pe:mit, upon the following conditions which ere hereby Eound to be a necessary prerequislt-
to the proposed use of the subject property in order to preserve the sefety and generel welfsce of the Citizens oE the
City oE Aneheim:
(i) That the hours of operation shall not extend beyond 6:00 p.m., as stipulated to
by the petitioner.
(2) That there shall be no outdoor facilities, and any proposed animal runs or stalls
shall be located within the canfines oE the building, asustdpu~ated to~b~ the petYtioher~.:~'.i.••
(3) That the subject use shall be ~perated within the definition of "clinic," as aet
forth by ~he American Veterinary Association,and; as such, shall not permit overnight ~r any
other buarding of animals, but shali provide out-patient care and services only, as Stf.pulated
to by the petitioner.
(4) That construction of subject clinic would provide for sound attendetion similar
to hospitals to insure that no "noisy" sounds woul.d be emitted to the outstde of the building
sCructure, as stipulated to by the petitioner.
(5) That subject property shall be developed substantially in accordance with plans
and specifications on file with the City of Anaheim merked Exhibit Nos. 1 and 2.
