A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR C~JNDITIONAL USE PERMIT NO..~~- BE GRANTED
WHEREAS, the City Planning Commission of the City of Anaheim did ceceive a veriEied Petition foc Conditional

No. 201, Tustin, California 92680, Agent of certain r~al property aituated in the City of
Anaheim, County of Orenge, State of California, described as That portion of Lot 1 of Tract
No. 4261, as shown on a map recorded in Book 161, pages 41 to 43 incluaive of Miscellaneous
Mapa, records of said Orange Couttty, described as follows: Parcel No. 2, as ahown on a map
filed in Book 16, page 46 of Parcel Maps, in the office of the County Kecorder of said Orange
County

WHEREAS, the City Planning Commission did hold e public heacing et the City Hall in the City of Anehelm on
February 5, 1973, at 2:00 o'clock P.M., notice of aaid public hearing heving been duly given as required by
Ia~H and in acrncdence with the provisions of the Anaheim Municipal code, Chepter 18.64, to heer end consider evidence
for and egair.st said proposed conditional use end to investigete and meke findings and recommendations in connecUon
therewith; end
WHEREAS, said Commission, after due inspection, investigetion, and study mede by itselE and in its behalE, and
aEter due consideration oE all evldence end ceports offered at seid heering, daes find and detennlne the following facts:
1. Thet the proposed use is properly one for which e Conditionel Use Permit is authorized by Code Section
18.40.060(e) to wit: establieh a drive-in (drive-through) reataurant.
2, That the proposed use will not edversely effect. the edjointng lend uses and the gcawth and development of
the area in which it is proposed to be loceted.
3. Thet the size end shape of the site proposed for the use is edequete la ellow the [ull development ot the
pcoposed use in e menner net detrimentel to thc perticuler area nor W the peace, health, sefety, and general welfere of
the Citizens of the City of Aneheim.
4. Thet the grenting oE the Conditionel Use Pennit under the conditlons Imposed, if any, w11I not be detrimental
to the peace, health, saEety, nnd generel welfare oE the Citizens of the City of Aneheim.
5. That the petitioner stipulatied to repairing the existing six-foot masonry wall.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Commission, in connection with an Exemption Declaration Stetus requeat,
finds and determines that the proposal would have no aignificant environmental impact and,
therefore, recommends to the City Council that no Environmental Impact Statement ia neces-
sary.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Coimnission does hereby
grant subject petition for Conditional Uae Permit, upon the following conditions which are
hereby found to be a necessary prerequisite to the proposed use of the subject property in
order ~o preserve the safety and general welfare of the Citizens of the City of Anaheim:
(1) That street lighting facilities along Lincoln Avenue, Laxore Street and Embassy
Avenue shall be installed as required by the Direcm~'of Public Utilities and in accordance
with standard plane and specifications on file in the office of the Director of Public IItili-
ties; and that a bond in an amount and form satiafactory to the City of Anaheim shall be
post.ed with the City to guarantee the iiistallation of the above mentioned requirements.
(2) That the owner(s) of subJect property shall pay to the City of Anaheim the sum of
15 cents per front foot along Lincolr. Avenue, Laxore Street and Embassy Avenue for tree plant-
ing purposes.
(3) That trash storage areas ahali be provided in accordance with approved plans on
file with the office of the Director of Public Works.
(4) That fire hydrants shall be installed and charged as required and determined to
be necessary by the Chief of the Fire Department prior to commencement of structural framing.
(5) That alI air conditioning facilitiea ahall be properly s«ielded from view, and
the suund buffered from adjacent properties.
(6) That subject property shall be served by unoterground utilities.
(7) That the final parking plan shall be approved by the Development Services Depart-
ment, and any lsndscaped areas in the parY.ing area shall be protected with six-inch high con-
crete curba, and concrete wheel stops ahall be provided for parking spaces.
(S) That drainage of subject property shall be diaposed of in a manner that is satis-
factory to the City Engineer.
(9) That the walls along the south and west property lines ahall be repaired, as stipu-
lated to by the petitioner.
(10) That appropriate water aeaessment fees as determined by the Director of Public
Utilities ahall be paid to the City of Anaheim prior to the issuance of a bnildin~ permit.
(11) That subject property shall be developed substantially in accordance with plana
and specificationa on fi'.e with the City of Anaheim marked Exhibit Nos. 1, 2, 3, and 4.
(12) That plans for development of this facility sliall comply with the Health and Safety
Code relative to ptovisions for the handicapped.
(13) That Condition Nos. 1, 2, and 12~ above oentianed, aha11 be complied with prior to
the coimnencement of the activity authorized under thin resolution, or prior to the time that
the building permit is isaued, or within a period of one year from the date hereof., whichever
occurs first, or sush further time as the Planning Commiesion mey grant,
(14) That Condition Nos. 3, 5, 6, 7, S, 9, and 11, above m~ntioned, shell be complied
with prior ta final building and zoning inspectione.
