PC73-39 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIDt THAT PETITION FOR CONDITIONAL USE PERMIT N0. ~_ BE GRANTED WHER~AS, the City Planaing Commission of the C:ty of Maheim did ~ecaive a verified Petition for Cc+nditional Use Pezmitfrom LOUIS AND SHARON MYERS, 533 North Dale Avenue, Anaheim, Califorr,ia 92801, Owner; BRAILLE INSTITUT~ OF AMERICA, 527 North Dale AvQnue, Anaheim, Califurnia 92801, Agent of certain real property situated ia the City of Anaheim, County of Orange, State of California, descri.bed as the south 82.50 feet of the north 247.50 feet of the easl 264.00 Eeet of the northeast quarter of the so~".hwest quarter of Section 1'L, Township 4 South, Range 11 West, in the Rancho Los Coyotes,.as shown apon map msde by C}arles T. Healey upon survey by him about 1870 for the Stearns Ranclios Company ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on February 21~ 1973~ at 2:00 dclock P.M., notice of said public hearing having been duly given as required by law and in accocdance with the provisions of the Anaheim Municipal code, Chapter 18.b4, to hear and consider evideace for and agair.sl said pcoposed conditional use and to investigate end rt:ake findings and recommendations in connection therewith; and WHEREAS, said Commission, aftet due inspection, investigation, and study made by itself and in its behalf, and after due considecation oE all evidence and reports offere d at said hearing, does find and detecmine the following facts: 1. That the pcoposed use is properly one for which a Conditional Use Permit is authorized by Code SecCion 18.64.020(1-f) to wit: establish a private educational institution for the blind in an exist- ing residential structure with waiver of: SECTION 18.04.090(2-a) - Minimum side setback. (15 feet required; 5 feet existing and propesed) 2. That the uetitioner stipulated there wuuld be no more than 20 additional students generated as a result of r.he proposed expansion, thereby establishing a maximum student load of 70 students for the entire faciZity. 3. That the petitioner stipulated that a minimum of 14 additional parking spaces would be provided on the south side of the existing facilities. 4. That the ptoposed use will not edversely afEect. the adjoining land uses and the ,qrowth and development o[ the erea in which it is proposed to be located. 5: That the size and shape of the site proposed for the use is adequate to allow the full development oflhe proposed use in e manner not detcimental to thc particular acea nor to the peace, health, safety, and general welfare of the Citizens ofthe City of Andheim. 6~ That the granting of the Conditional Use Petmit un~er the conditions imposed, if any, will not be dPtrimental to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. ENVIRONMENTAL IMPACT REPORT FINDING: That the Planning Commission, in connection with an Exemption Declaration Stetus requesL•, finds and determines that the proposal would have no significant environmentai impact and, therefore, recommends to the City Council that no Environmental Impact Statement is necessary. Cl-G ~ 1~ ~ _ - 1~ ~ NOW, THLREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant<subjett Petition for ~onditional Use Permit, upon the following conditions which are hereby f~und to be a necessary prerequisite to tae proposed use of the subject property in order to preserve the safety and generai welfare of the Citizens of the City of Anaheim: (1) That the owner(s) of subject property shall deed to the City of Anaheim a gtrip of land 45 feet in width from the centerline of th~ street a],ong Dalp l~venue for st:•rat widening purposes. (3) That tne owner(s) of subject property shall pay to the City of Anaheiin the sum of $2.00 per front foot along Dale Avenue for street lighting purposes. (4) That the owner(s) of subject property shall pay to the City of Anaheim the sum of 15 cents per front foot along Dale Avenue for tree planting purposes. (5) That trash sCorage areas shall be provided in accordance with approved plans on file with the office of the Director of Public ~dorks. (6) That fire hydrants ahall be installed and charged as required and determined to be necessary by the Chief oi the Fire Department prior Co co~nencement of structural framino. (7) That a six-foot masonry wall shall be constructed along the north and west prop- erty lines provided that said wall shall not extend closer than ten feet from the right-of- way along Dale Avenue. (8) That all air conditioning facilities shail Ue properly shieldec~ from view and the sound buffered from adjacent properties. (9) That subject property shall be served by underground utilities. (10) That the existing structure sha11 be brought up to the minimum standards of the City of Anaheim including the Uniform Building, Plumbing, Electrical, Housing, Mechaaical and Pire Codes as adopted by the City of Anaheim. (11) That drainage of sub3ect property shall be disposed of in a manner that is satis- factorp to ~he City Engineer. (12) ~hat appropriate water assessment fees as determined by the Director of Public Utilities shall be paid to the City of Anaheim prior to the issuance of a building permit. (13) That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2. (14) That Condition Nos. 1, 2, 3, and 4, above mentioned, shall be complied with prior to the commencement of the acL•ivity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from the date hereof, whichever occurs first, or such further time as the Planning Commission may grant. (15) That Condition Nos. 5, 7, 8, 9, 10, 11, and 13, above mentioned, shall be complied witt~ prior to ~inal building and zoning inspections. (16) That there shall be no more than 20 addiCional students permitted in the expansion of this private educational institution, as stipulated to by the petitioner. (17) That the petitioner shall provide no less than 14 additional parking spaces, n,s stipulated by the petitioner.
