A RESOLUTION OF THE CITY PLANNING COMMISSION OF 3R E ~BE D NIED HEIM
THAT PETITION FOR COND:TIO~IAL USE PERMIT _]
WHEREAS, :he City Planning Commission of the City of Anaheim iid receive a veriEied Petition for Con-
ditiannl Use Permit f:om OLIVER H. LABONTE, 1419 Evergreen, Fullerton, California -92635;
S1iIRLEY R. LABONT~, 1061 Avocado Way, Anaheim, California 92805, Ownexs of certain
real property situated in the City of Anaheim, County of Orange, State of California,
described as Lot 17 of Tract no. 4582, as shown on a Nap recorded in Book 163, pages
11 and 12 of Miscellaneous Maps, records of Orange County, California
; and
WHEREAS, the City Plenning Commission did hold e public nearing at the City Hall in the City oE Aneheim
on March 19, 1973, at 2:00 o'clock P.M., i~:t:ce oE said pubiic hearing having been duly given
as required by law and in accordance with the provisions of tne Anaheim Municipal code, Chepter 18.64, to hear
and consider evidence Eor end against said proposed conditionel use and to investigate and meke findings and
recoaimendations in connection therewith; and
WHEREAS, said Commission, efter due inspection, investigetion, and study made by itselE and in its br
half, and aEte: due consideration of ell evidence end reports offeced et said hearing, does find and determine the
following facts:
1. That the proposed ~se is pmperly one for which e Conditional Use Permit is euthorized by Code Section
18.64.020(1-g) to wit: legalize the existing use of a single family residence as a
boarding house for eight (8) women (plus•a'housemother) who are unable to care tatally
for their own needs.
2. That the proposed use in incompaL•ible with the single family residential char-
acter of the area.
3. That although the petitioner had contacted her neighbors several years ago when
she resided in the home as to their feelings regarding her giving special care eo several
persons, L•he petitioner has now left the home snd has hired another person to take care
of these wome~~ and has increased the number of paying boarders from a few to eight (8).
4. That a parking problem exists on weekends because of the church activities the
pelitioner conducts, even though the petiCioner indicated that mosC of the boarders did
not have their own Cransportation.
5. That the proposed use will adversely aEfect the adjoining land uses and the
gro~ath and development of the area in which it ia proposed to be located.
6. That four persons appeared representing eight persons present in the Council
Chanber in opposition, and that a ne:itio'n signed by 110 persons was received in opposition.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Commission, in connection with an Exemptian Declaration Sta~us request,
finds and determines that the proposal wo~ld have no significant environmental impact
and, therefore, racommends to tne City Council Chat no Environmental Impact SCatement
is necessary.
