A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAElEIM
THAT PETITION FOR VARIANCE N0. 2485 BE : GRANTED
WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance Erom
IMPERIAL lAND AND INVEST.MENT COMPANY, attention of A, L. Roberts, 435 North State College
Boulevard, Anaheim, California 92806, Owner; MARVIN F. HOPKINS, U-Stow-It Development
Corporation, 9900 Lakewood Boulevar.d, Suite 109, Downey, California 90240, Agent of
certair...renl..pro~.erty situated in the City of Anaheim, County of Orange, State o£ Cali-
fornia, as described in Exhibit "A" attached hereto and referred Co herei.n•a's though set
forth.in full; and _
WHEREAS, thc City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on
April z, 1973, at 2:00 o'clock p.m., notice of said public hezring having been duly given as required by law and
in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and codsider evidence for and against said
proposed variance and to investigate and make findings and reccmmendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due
consideration of all evidence and reports offered at said hearing, docs find and deterr.iine the following facts:
1. That the petitioner requcsts: variances' froin the• Anaheim Municipal. Code as follows:
a. SECTION 18.52.060(2-a=1) - Minimum setback from an arterial highway.

property.

to the property invol~ed or to the intended use of the property that do not apply generally
to the property or class of use in the same vicinity and zone.
4. That the requested variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same viciniCy aad zone, and
denied to the property in question.
5. That the requested vaiiance wili not be materially detrimental to the public wel-
fare or injurious to the pr.operty or improvements in such vicinity and zone in which the
property is located.

6. That no one appeared in opposition.
7. That the petitioner stipulated that the concrete block to be used in the con-
stru~tion of the buildings would be beige colored block, not painted block.
8. That the petitioner stipulated sufficient landscaping would be installe3 along
the top of the slope to provide vit;ual screening from Miraloma Avenue.
9. That the petitioner stipulated that he would not have any sign3ng on the walls
adjacent to the freeway right-of-way.
g~ViRONMENTAL IMPACT REPORT FINDING:
ThaC the Planning Commisston, in connection with an Exemptian Declaration Status request,
finds and determines thaC Che proposal would have no significant environmental impact and,
therefore, recommends to the City Council that no Environmental Impact Statement is necessary
NOW, THEREFORE,BE IT RESOLVED that the Anaheim City Planning Commission does hereby
granC subject Petition for Variance, upon the fallowing conditions which are hereby found
to be a necessary prerequisite to the proposed use of the subject property in order to pre-
Serve the safety and general welfare of the Citizens of the City of Anaheim:
(1) That this variance is granted subject to the completion of Reclassification No.
61-62-69 (57).and 66-67=25~2)~ now pending.
(2) That the sidewalks shall be installed plong Miraloma Avenue as required by the
City Engineer and in accordance with standard plans and specific8tiona on file in the office
of the City Engineer.
(3) That the applicant shall, at his option, either (1). deed to the City of Ai:aheim,
sufficient right-of-way at the terminus of Sunshine Way for a modified cnl-.de-sac;'COmpiy
wiCft all:'-engineeiing requi=ements of'the City of Anaheim along Sunshine Way, souther7.y of
Miraloma Avenue, including Preparation of improvement plans and installation of all improve-
ments such as curb and gutter, street grading and paving or other appurtenant work in ac- •
cordance with standard plans and specificat~.ons on file in the office of the City Engineer;

facilities; or (2) process with the City of Anaheim a request for the abandonment uf the
existing right-of-way for Sunshine.Way south of Miraloma Avenue; enter into an agreement
with the City of Anaheim to purchase from the City the City's fee title to the propert•y
covered by said right-of-weY at a fair appraised ~arket value; and reconstruct the entrance

(5) That drairage of subject property shall be disposed of in a manner that is satis-
factory to the City Engineer.
(6) That trash storage areas shall be provided in accordance with approved plans on
file with the office of the Director of Public Works.
(7) 'Phat fire hydrants shall be installed and charged as required and determined to
be necessary by the Chief of the Fire Department prior Co commencement of structural framing.
(8) That all air conditioning facilities shall be properly shielded from view and the
Sound buffered from adjacent properties.
(9) That subject property shall be served by underground utilities.
(10) That the final parking plan shall be approved by the Development Services Depart-
ment, and any landscaped areas in the parking area shall be protected with six-inch high
~o:~crete curbs, and concrete wheel stops shall be provided for parking spaces.
(11). That appropriaCe water assessmenC fees, as determined by the Director of Public
Utilities, sha7.1 be paid to the City of Anaheim prior to the issuance oi a buiYding permit.
(12) That the embankment slopes of Miraloma Avenue fronting on subjecC property shall
be landrscaped and irrigation facilities shall be installed subject to approval of the Park-
Way Maintenance SuperinCendenr. Said landscaping shall consist of dense landscaping at the
top of the slopes in order ~o provide a visual screen from Miraloma Avenue.
(13) That subject praPerty shall be developed subctantially in accordance with plans
and specifications on file with the City of Aneheim marked Exhibit Nos. 1, 2, 3, 4, 5, 6, 7,
S, 9, 10, and 11 and in accordance with the above mentioned condittons provided, however,
Chat the concrete block material shall b~e colored and not painted, and Yhat no signs shall
be placed on the walls adjacent to the fYeeW~Y right-of-w~y, as stipulated to bj~ the peti-
tioner.

(14) That Condi.ti.on Nos, 1, 3, and 4, above mentioned, shall be complied with
prior to the commencement of the activity authorized under this resolu!:ion,or prior to
the time that the building permit is issued or within a period of one year from date
hereof, whichever occurs firsl:, or such further time as the Planning Commission may grant.
(15) That Condition Nos. 2, 5, 6, 7, 8, 9, 10, 12, and 13, above mentioned, shall
be complied with prior to f3na1 building and zoning inspections.
