WHEREA3, the City Plenning Commission of the City of Anaheim did rece~ve a vecified Petition fur ~onditional
Use PannitErom ANAHEIM HILLS, INCORPORATED, attention of James L. Berisic, 380 Anaheim Hills
Road, Araheim, California 92806, Owner of certain real property siCUSted in the City of
Anaheim, County of Orange, State of California, as described in Exhibit "A" ~ttached hereco
and referred to herein as though set forth in full; and

WHEREAS, the City Plenning Commission did hold a public hearing at the City Hall in the City of Aneheim on
April 2, 1973, at 2:00 o'clock P.M., notice of said public hearing heving been duly given as tequired by
law and in accocdance with the provisions of the Anaheim Municipal code, Chepter 18.64, to heer end considar evidence
Eor and agair.st said proposed conditionel use and to investigete end make Eindings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspectian, investigetior„ end s!udy mede by itself and in its behalE, and
aEter due consideretion of ell evidence end reports offered et said hearing, does find and determine the tollowing Eects:
1. Thet tha pcoposed use is propecly one for which e Connitional Use Petmlt is euth~rized by COde Section
18.64.020(1)(E) to establish a six-unit, planned residenCial development to be used as a
model home complex with salea office and home decorating sales center (Tract No. 8223).
2. That the proposed use v:ill not adversely afEect. the edjoining lend uses end the gcowth end development of
the area in which it is proposed to be located.
3, Thet the size and shape of the site proposed tor the uee is edequete to allow the full development of the
pmposed use in a menner not detrimental to the perticulur area nor to the peaca, health, sefety, end general welfece of
the Citizens oE the City oE Aneheim.
4. T}~et the granting ot the Conditional Use Peanit under the conditions imposed, if nny, will not be detrimental
W the peece, health, safety, end general welEare of the Citizenc oE the City of Anaheim.
5. That the granting of the Conditional Uae Permit will remain in effect until the
final map is recorded for Tract No. 8223 and final reading of the ordinaYice has been held.
6. That the homes within this model area may not be aold or occupied unCil final map
of Tract No. 8223 has been recorded and zoning completed.
7. That no one appeared in opposition.
8. That the petitioner stipulated no waivera would be required except the weiver
approved on Variance No. 2489 (Section 18.04.075 - F.equirement that single-family reaiden-
tial structures rear on arterial highways)
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Commission, in connection with Environmental Impact Report No. 90, has
reviewed the findings of the Environmental Impact RevieW Committee snd recommends to the
City Council that Environmental Impact Reporf No. 90 be accepted as the Council's Environ-
mental Impact Statement.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission doea hereby
grant subject Petition for Conditional Uce Permit, upon the following conditions which are
hereby found to be a necessary prerequisite to the uroposed use of the subject property in
order to preserve the safety and genersl welfare of the Citizens of the City of ~lnaheim:
(1) That trash storage areas shall be provided in accordance with approved plans on
iile with the office of the Director of Public Works.
(2) That fire hydrants shall be installed and charged as required and determined to be
necessary by the Chief of the Fire Department prior to commencement of structural framing.
(3) That subject property shall be served by underground utilities.
(4) That,drainage of said property shall be disposed of in a manner satisfactory to
the City Engineer and shaZl include construction of dr&inage facilities of a size and type
sufficient to carry runoff waters originating from higher properties south of Santa Ana Canyon
Road through said prope^ry to ultimate disposal as approved by the City Engineer. Reimburse-
ment agreements may be made available eo the developers of said property upon their request.
(5) That grading, excavacion, and all other construction activities shall be conducted
in such a manner so as to minimize the possibility of any silt originating frcm this project
being carried into the Santa Ana River by storm water originating from or flowing through
this project.
(6) That public utility easements shall be granted as required bp the Director of
Public Uti'lities. •
(7) That this conditional use permit shall remain in full force and effect until Final
Map of Tract No. 8223 has been recorded and final reading of the ordinance rezoning this
property has been accomp.lished.
(8) That the homes within.tliis model area may not be sold or occupied until Final Map
of Tract No. 8223 has been recorded and an ordinance has been read rezoning subject property
to the RS-5000 Zone.
(9) That a bond in an amount and form satisfactory to the City of Anaheim shall be
posted with the City to guarantee the removal of the models in the evenC Final Map of TracC
No. 8223 is not recorded. Said bond shall also include an amount suf•ficient to guarantee the
removal of landscaping and improvements within the future right-of-way of Grande Vista Street.
(10) That suUject property shall be developed substantially in conformance with plans
and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 18.
