A RESOLUTION OF THE CiTY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE NO. 2488 BE GRANTED
NHEREAS, the City Planning Commission o` the City of Aneheim did ceceive e verified Petition for Verience
from HIGHLAND PROPERTIES, INCORPORATtiD, 4885 East 52nd Place, Los Angelas, California 90040,
Owner; CHARLES C. STAMBACH, 4885 East 52nd Place, Los Angeles, California 90040, Agent of
certain real prcperty situated in the f:ity of Anaheim, County of Orange, State of California,
as described in Exhibit "A" attached hereto and refe=red to herein as though set forth in full
; and
WNEREAS, tiie City Planning Commission did hold a public heering at the City Hall in the City of Anaheim
on April 16, 1973, at 2:00 o'clock P.M., notice oE ~eid public hearing having been duly given as required
by 1aw and in eccocdance with the provis,ions oE the Ane~+eir, Municipal Code, Chaptar 18.68,to heac end consider
evidence for and egainst said proposed ve,riunce end to inve::igate end make findings end recommendations in connec-
tion therewith; and
WHEREAS, said Commission, eLter due inspection, investigation, and study made by itself end in its behalf,
and after due consideration of all evidence and repocts offered at said hearing, does find and determine the following
Eacts: ~ ~
1. That the petitioner reauests variances from ~the Anaheim'Municipal Code as follows:
a. SECTION 18.08.440 - Requirement that a lot have frontage on a public street_.
(Frontage required; loC wiC.hout frontage proposed)
b. S~CTION 18.52.060(1)(a) - Maximum buildinR he?.r~Y~t within 200 feet of a residential
zone boundary. (20 f<:et permitted; 23 feet proposed)
(Zero feet permitted; 26 feet proposed)
2. That Waiver 1-a, aUove nentioned, is hereby granted on the basis that an accesa ease-
ment already exists.
3. That there are exceptional or extraordins~ry ciccumstances or conditions appliceble to the property involved
or to the intended use of the property that do not apply generelly to the p~operty or cless of use in the same vicinity
and zone.
4. That the requested veriance is necessery tor the presesvation end enjoyment of e substentiel property right
possessed by other property in the sem~e vicinily end zone, end denied to the property in question.
5. That the requested variance will not be meYerially detrimentet to the public welfece or injurious to the pmp-
er'ty or improvements in such vicinity end zone in which the property is loceted. ~
EYVIP,ONMENTAL T.TSPACT 2EFOFT PINDING:
That the Pla.nning Commission, in connection with an Exemption Declaration Statua request,
finds and determines that the proposal would have no signiflcant en•~ironmzntal impact and,
therefore, recommends to the Cil•y Council Chat no Environmental Impact Statement is necessary.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Co~ission does hereby grant
siibject Petition for Variance, upon the following conditions which are hereby found to be a
necessary prerequisite to the proposed use of the subject property in order to preserve Y.he
safety and general welfare of the Citizens of the City of Anaheim:
(1) That trash storage areas shall be provided in accordance with approved plans on file
with the office of the Director of Public Works.
(2) That fire hydrants shall be installed and charged as required and determined to be
necessary by the Chief of the Fire DeparCment prior to commencement of structural framing.
(3) That a six-foot masonry wall shall be constructed along the west and south property
lines.
(4) Tlrat all air conditioning facilities shall be properly shielded from viev, and the
sound buffered from sdjacent properties.
(5) That a parcel map to record the approved division of subject property be submitted Co
and approved by the City of Anaheim and then be recorded in the office of the Orange County
Recorder.
(6) That any parking area lighting proposed shaJ.l be down-lighting of a maximum height
of six feet, which lighting shall be directed away fram the property lines to protect the reai-
dential integrity of the area.
(7) That subject property shall be served by underground utilities.
(8) That the final parking plan shall be flpproved by the Development Services Department
and any landscaped areas in the parking area shall be protected with six-inch high concrete
curbs, and concrete wheel stops shall be provided for parking spaces.
(9) That drainage of subject property shall be disposed of in a manner that is satisfactory
to the City $ngineer.
(10) That appropriate water assessment fees as determined by the DirecCor of Public Utilities
shall be paid co the City of Anatieim prior to the issuance of a building permit.
(11) That a perpetual easement agreement for a strip of land 30 feet in width for vehicular
ingress and egress to Manchester Avenue shall be submitted to and approved by the City Attorney's
office and then be filed and recorded in the office of the Orange County Recorder.
(12) That subject property shall be develaped substantially in accordance with plans and
specifications on file with the City of Anaheim marked Exhibi.t Nos. 1, 2, 3, and 4.
(13) That Condition Nos. 5.and 11, above mentioned, shall be complied with prior to the
commencement of the activity authorized under this resolution, or prior to the time that the
building permiC is issued,or within a period of one year frum date hereof, whichever occurs
first, or such further time as Che Planning Commission may grant.
(14) That Condition Nos. 1, 3, 4, 6, 7, S, 9, and 12, above mentioned, shall be complied
with prior to final building and zoning inspections:
