A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE IvO. 2491 BE DENIED
WHEREAS, the City Planning Cummission of the City of Maheim did receive a verified Petition for Variance from
ATLANTIC RICHFIELD, 1786 ~dest Lincoln Avenue, Anaheim, ~alifornia 92804, Lessee;
P B R COMPANY, 1C20 East Vermont, Anaheim, Ca7.ifornia 92a05, Agent of certain real
property situated in the City of Anaheim, County of Orange, State of California, dea-
cribed as The north 180.00 feet of the east 180.00 feet of the northeast quarter of
the northeast quarter o£ the northeast quarter of Section 8, in Township 4 south,
Range 10 west, in the Rancho Los Coyotes, as per map recorded in book 5]., page 10,
:',:scellaneous Maps, in the office of the county recorder of said county; and

WI~IEREAS, thc City Planning Commission did hold a public hearing at the City Hali in the City of Maheim on
April 16, 1973, at 2:00 o'clock p.m., notlce of sard public hearing having been duly given as required by law and
in accordance with the provisions af the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for and against said
proposcd variance and to investigate and make findings and recommendations in connection therewith; and
WHEREAS, said Commission, aftcr due inspection, investigation, and study made by itself and in its behalf, and after due
considcration of all evidence and reports offered at said hearing, does find and determinc the following facu:
1. That Uie petitioncr requests variances from ~he Anaheim MusticiQal Code as foilows:
a. SECTT.ON 18.62.090B(1) - Maximum number of free-standin~ signa. (One sign
permitted; f~ur signa propoaed)
b. SECTION 18.62.090B(1) - Minimum distance between free-sCanding si~na. (300
feet required; 20 feet proposed)
c. SECTION 18.62.090B(2) - Minimum heiqht of fr.ee-standing si~ns. (S feet re-
quired; 8 inches proposed)
2. That approving the requested waivers would establish an undesirable precedent since
oCher serva.ce stations would also request price signs.
3. That at the time "self-serve" signs were requested, they were approved for identi-
fication of the self-serve pumps, however, it was determined that the one price sign on the
corner pole would be adequate.
k. That the proposed "self-serve" signs with the large pr{ce sign$ atta:h~d tnerel•o
cons~itutes Coo large and tao many si&ns £or the property.
5. That the proposed signing is a poor way to advertise the oil companies' products
and it insults the intelligence of the motoring public.
6. That the petitioner had not proven a hardahip existed to warrant favorahle conaidera-
tion of the requested waivera.
7. That there are no exceptional or extraordinary circumatances or conditiona applicable
to the propert~~ involved or to the inten+.ied use of the property that do not apply generally
to the propertp or class of use in the same vicinity and zone.
8. That t~e requested ~ariance is not necessary fer the preservation and enjoyment of
a substantial property right posseased by other property in the same vicinity and zone, and
denied to the property in question,
9. That the requested variance will be materially detrimental to Che public welfare or
injurious Co the property or improvemenl•s in such vicinity and zone in which the property
is located.

ENVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Commission, in connection with an Exemption Declaration Status request,
finds and determines that the proposal would have no signifi.ant environmental impact:and,
therefore, recommends to the City Council that no Environment-al Impact Statement is neceasary
NOW, THEREFORE, BE IT RESOLVED that che Maheim City Planning Commission does hercby deny subject Petition for
Variance on the basis of thc aforementioned finds,
