A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT 1385 BE GRANTED
WHEREAS, the City Plannir.g Commission of the City of Aneheim did receive a verified Petition for Con-
ditional Use Permit from ROBERT LOUIS AND HELEN ALLGEYER CLAFIC, 1345-A Victoria Drive, Fullerton
California 92531, Owners; ROBERT SILBAUGH, S£andard Oii of California, 444 West Ocean
Boulevard, Long Beach, California 90802, Agent oE certain real property situated in
the City of Anaheim, County of Orange, State of California, described as The westerly
190.C0 feet of the southerly 200.00 Eeet of the southwest quarter of the southwest
quarter of the southwest quarter of Section 5, Township 4 South, Range 10 West, in
the RZncho San Juan Cajon de Santa Ana as per map recorded in Book 51 Page 10 of Mis-
cellaneuus Maps, •ln the office of the County Recorder of said county. EXCEPT that
portion thereof described as follows: Beginnina at a point in the southerly line of
said land distant 190.00 feet east of the southwest corner thereof; thence northerly
along the easterly line of eaid land 160.00 feet to the true point of beginning; thence
northerly along said easterly line 40,00 feet; thence westerly along the northerly line
of said land 40.00 feet; thence sautheasterly in a direct line to the Crue point of be-
ginning

NHEREAS, the l~ityPlenning Commission did hold e public hearing at the CityHall in the City of Anaheim
on April 30, 1973, et 2:00 o'clock P.M., notice of seid public hearing heving been duly given
as cequired by law and in accordance with the provisions of the Anaheim Municipel code, Chapter 18.64, to hear
and consider evidence for end ageinst said proposed conditionel use and to incestigate and make findings and
recommendations in connection therewith; and
WHEREAS, seid Commission, aftec due inspect9on, investigetion, and shidy mede by itselE and in its be-
helf, and after due consideration o£ all evidence and ceports ofEered at seid hearing, does find and determine the
following fects:
1. That the proposed use is properly,one for which e Conditional Use Permit is authorized by Code
Section 18.64.020(3-g) to wit: establish a mechanical carwash with wa3vers of:~
a. SF.CTION 18.04.070(4)(f)_ - Minimum number of r.equired parking spaces.
(Nine parking spaces required; fo_ur parking
spaces proposed)
b. SECTION 18.62.090(B)~ - Maximusa number of free-standing sig:.~s.
(One sign permitted; two signs proposed)
c. SECTION 18.62.090(B)(1) - Minimum distance between free-star.din~ si~ns.
(300 feet required; 58 feet proposed)
2. That Waiver 1-a, above mentioned, is hereby granted on the basis that the
petitioner stipulated there would be no more than four employees on the premises at
one time, and the petitioner stipulated that if it became necessary to have more
parking spaces, arrangements would be made to provide theae spaces on the property
to the east.
3. That Waivers 1-b'and 1-c, above mentioned, are hereby granted on the basi9 that
the City Council has determined that lighter boxes may be permitte~' in conjunction
with the sale of gasoline.
4. That the petitioner stipulated to submission of a common trash storage area
agreement to the City Attorney for approval and for recordation with the Orange County
Recorder.
5. That the petitioner stipulated ther.e would be no fascia si$ns.

6. That the proposed use will not adversely affect the adjoining land uses and
the growth and development of the area in which it is proposed to be located.
7. That the size and shape of the site proposed for the use is adequate to allow
the full development of the proposed use in a manner not detrimental to the particular
area nor to the peace, health, safety, and general welfare of the Citizens of the City
of Anaheim.
8. That khe grantir.g of the Condit3onal Use Permit under the conditions imposed,
if any, will not be detrimental to the peace, health, safety, and general welfare of
the Citizens of the City of Anaheim.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the peCitioner, in connection with the above request has submitted Environmental
Impact Report No. 91, which has been reviewed by the Environmental Impact Report Iteview
Committee, in which it was determined that the report conformed Co the required estab-
lished guidelines and that there would not be any significant environmental impact due
to noise since the petitioner has made provisions for mitigating any noiae associated
with car wash equipment; therefore, the Planning Commission recommends to the City Council
that Environmental Im~act Report No. 91 be adopted as the Council's Environmental Impact
Statement.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby
grant subject Petition for Conditional Use Permit, upon the following conditions which
are hereby found to be a necessary prerequisite to the proposed use of the subject prop-
erty in order to preserve the safety and general welfare of the Citizens oL the City of
Anaheim:
(1) That the owner(s) of subject property shall deed to the City of Anaheim a
strip of land 60 feet in width from the centerline of the sCreet alon~ Brookhurst Street
and a strip of land 53 feet in width from the centerline of the street along La Palma
Avenue for street widening purposes.
(2) That the owner(s) of subject property shall pay to the City of Anaheim the
sum of 15 cenCs per front foot along La Palma Avenue and Brookhurst Streee for tree
pienting purposes.
(3) That street lighting facilities along La Palma Avenue and Brookhurst Street
shall be installed as required by Che Director of Public Ut•ilities and in accordance with
standard plans and specifications on fLle in the'office of the Director of Public Utili-
ties; and that a bond in an amount and form satisfactory to the City of Anaheim shall be
posted with the City to guarantee the installation of the above mentioned requirementa,
(4) That trash storage areas ahall be provided in accordance with approved plans
on file with the office of the Director of ?ublic Works.
(5) That the owner(s) of subject groperty shall submit to the City Attorney for
approval an agreemen2 providing for common trash storage'area for the propoaed use and the
existing adjacent uses; after approval, sald agreement shall be filed and recorded in
the office of the Orange County Rem rder.
(6) ThaC fire hydrants shall be installed and charged as required and determined
to be necessary by the Chief of the Fire Department prior Co cammencement of structural
framing.
(7) That all air conditioning facilities ahall be properly shielded from view.
(8) ThaC subject property shall be served by underground utilities.
(9) That drainage of subject property shall be disposed of in s mann.r.r that is
satisfactory to the City Enginaer.
(10) That subject property shall be developed substantially in accordance with
plans and specifications on fi.le with the City of Anaheim marked Exhibit Nos. 1, 2, 3
and 4.
(11) That Condition Nos. 1, 2, 3t and 5, above mentioned, shall be complied with
pric~r to the commencement of the activity authorized under Chls resolution, or prior to
the time thaC Che building permit is issued, or withir a period of one year from date
here~of, whichever occurs first, or such fuxther time as the Planning Commission.may_

(12) That Condition Nos. 4, 7, 8, 9, and 10, above mentioned, shall be complied
with prior to fina.l building and zoning inspections.
