THAT PETITION FOR VARIANCE N0. 2495 BE GRANTE~
WHEREAS, the Citp i'lenning Commission of the City of Aneheim did receive n verified Peiition for Verience
from NEVILLE D. iIBBY, 1661 West Cerritos Avenue, Anaheim, California 92802, Owner of certain
real p~operty situated in the City of 9naheim, County of Orange, State of California, desccibad

on April 30, 1973 et 2:00 o'clock P.M., notice oE seid public hearing having been duly given es cequired
by lew and in eccordence with the provisions of tlie Aneheim Municipel Code, Chepter 18.68,to hear and consider
evidence Eor end egeinst seid proposed variance and to investigate and mnke findings end recommendetions in connec-

WHEREAS, said Commissi~m, atter due inspection, investigatlon, end study made by ltself and in its behelf,
and after due consideration of all evidence and reports offered at seid heering, daes find end determine the following
facts:
1. That the petitioner reauests e variance [rom the Anaheim Municipet Code as follows:

3. Thet the requested varience is nc:rssery for ttie preservation end enjoyment of t substuntial propetl;y tight
possessed by othec pcoperty in the seme vicinity and zone, end denied to the propedy in questioa.
4. That the reques;ed vorlance wlll not be meterially detrimentel to the public welfete or injuriou6 tr ihe pmp-
erty or impcevements in such vicinity ond zone in which the property is loceted.
5. That the peCitioner atipulated that the use of the mobilehome would hR'to huuse an
elderly parent, and that it would cease as a use when Raid parent no longer r,eaides at thie
location,
6. That the petitioner stipul.ated to connecting the mobil~eiiome to all appropriate C3tq
of Anaheim services and utilities, such es electric, water, sF~wer, 3nd g~s.
ENVIRONMENTAL IMPACT REPORT PINDING:
That the Planning Commission, in connection with an Exemption Declar~tion Statuo reqC:est, finds
and determines that the proposal would have no signfficant environmental impact an~ir t!!.w~reEore,
recommends to the City Council that no Environmental Impact Statement is necessary.

NON, THEREFORE, BE IT RESOLVED thet the Anaheim City Planning Commisslon does hereby grent subJect
Petition for Veriance, upon the (ollowing conditions which are hereby found to be a necessary precequisite to the pro-
posed use o[ the subject property in ocder to preserve the safety end general welfa:e o[ the Citizeas of the City of
Anaheim:
(1) That the owner(s) of subject property shall conditionally dedicate to t.he ~ity of
Anat.ieim a strip of lar~d 45 feeC in width from tha centerline of the street along Cerritos
Aven.ue for street widening purposes, conditioned upon the City initiating a street improve-
men'c project to •widen Cerritos Aver.ue which would include the frontage of sub~ect property.
(2) That the oHnar(s) of subject property shall pay to the City of Anaheim the sum of
$2,00 per. front toot along Cerritos Avenue for street lighting purposes.
(3) That the owner(s) of subject property shall pay to the City of Anaheim the sum of
J.5 cents per front foot along Cerritos AvenuP for tree planting purposes.
(4) That the owner(s) of subject property shall pay to the City of Anaheim appropriate
park and recreation in-lieu feas as determined to be appropriate by the City Council, safd
fzes to be oaid at~the time the building permit is issued.
(5) That the mobilehome snail be connected to all appropriate services and utilities.
(6) That subject property ahall be developed substantially in accordence with plana
and specifications on file with the Ciky of Anaheim marked Lxhibit No. 1,
(7) Thnt Condition Nos. 1, 2, and 3, abovc m:ntioned, shall be complied with prior
to the commencement of the activity authorized under this resoiution, or prior to the time
that the building permit is isaued or vithin a period of one year from date hereof, which-
ever occurs first, or such further time as the Planning Cos~iasion may grant,
(8) That Condition Nos. 5 and 6, above menttoned, shall 5e complied wi.th prior to
final building and zonir.g inspections.
(9) That this veriance is granted for a period of five (5) years, subject to annual
review thereafter provided, however, that if the use shall cease befoi~e L•he expiration of
the time limitation, it shal.l be terminated since the petitioner stipulated the use would
be for an aged parent anly.
