A RESOLUTION OF THE CITY PLANNING COMMISSION QF THE C1TY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2498 BE GRANTED
WHEREAS, the City Planning Commission of the City of Anaheim did ceceive e verified Petition fer Verlence
fcom DAVID R. DOERING, 1203 West Lincoln Avenue, Anaheiw, California 92805, Owner of certa£n
real property situsted in the City of Anaheim, County of Orange, State of California, des-
cribed as Lot Nos. 20, 21, 22 of Iilock No. 3 of the Oppenheimer and Summerfield Subdivision
as recorded'in Mi::cel].aneous Records of Los Angeles County, Book 19, Page 44

WHEREAS, tha City Planning Commissicn did hold e public heering et the City Hall in the City of Anaheim
on April 30, 1973, at 2:00 o'clock P.M., notice of said public hearing having been duly given as cequired
by law and in eccordence with the pravisions of the Anaheim Municipol Code, Chepter 18.68,to hear end consider
evidence for ond egainst said proposed variance end to investigate and make findings and recommendations in connec-
tion therewith; and
WHER~AS, said Commission, after due inspection, investigetion, and stady mede by itselE end in Its behelf,
and efter due consideration of all evidence and reports ofEeced at seid hearing, does find and determine the followir.g

1. Thet the petitioner requests a•reciance from the Anaheim Municipal Code:
SECTION 18.44.010 - Per.mitted uses, (To allow a dance hall in conjunction
with an existing on-sale liquor establiahment.)
2. That there ace axceptional or extraordinary ciccumstences or conditions appliceble to the property involved
ar tc the intended use oE the property that do not epply generolly to the property or cless of use in thc same vicinity
and zone.
3. Thet the requested variancr, is necessery for the preservatian and enjoyment of a substenttel propedy right
possessed by other property in the seme vicinity end zone, ead denied to the property in question.
4. That the requested variance will not be materielly detrimentel to the public welEate or injurious to the pmp-
erty or impcovements in such vicinity ond zone in which the pcoperty is located.
5. That a petition signed by 69.persons, 31 of whom were Anaheim residents, was received
in favor of subject petition.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Planning Commiasion, in connection with an Exemption SL•atus request, finds and
determines that the proposal would have no signi£icant environmental impact and, ttierefore,
recommends to the City,Council that no Environmental Impact S~atement is necessary.

NOW, THEREFORE, BE IT RESOLVED that the Aneheim City Planning Commission does hereby grnnt subject
Petition for Verience, upon the following conditions which aee hereby found to be e necessary pcerequisite to the pm-
posed use of the subject property in order to preser+e the safety and generel welfere o£ the Citlzens of the Clty of
Anaheim:
(1) That the oWner(s) of subject property shall deed to the City of Anaheim a strip
of land ten feet in width from the alley for alley widening pucposes.
(2) That the owner(s) of subject properL•y shall pay to the City of Anaheim the sum of
$2.00 per front foot along Carleton Avenue for street lighting purposes.
(3) That trash storage are~a sha12 be provided in accordance with approved plans on
file with the office of the Director of Pubiic Works.
(4) T.hat all air-conditioning facilities shall be properly shielded from view, and
the ~ound buffered fxam adjacent properties.
(5) That the existing structure shall be brought up to the minimum standards of the
City of Anaheim, including the Uriiform Building, Plumbing, Electrical, Housing, Mechanical
and Fire Codes as adopted by the City of Anaheim.
(6) That the final parking plan shall be approved by the Development Services Depart-
ment and any landscaped areas in the park3ng area shall be protected with six-inch high
concrete curbs, and concrete aheel stops shall be provided for parking spaces as required.
(7) That subject property shall be developed substantially in accordance with plans
and apecifications on file with the CiCy of Anaheim marked ~xhibit No. 1,
(8) That Condition Nos. 1 and 2, above n~entioned, shall be complied with pr•iur to
the cormnencement af. the activity authorized under thia resolution, or prior to the ti,!~ie
thaL the building permit is issued, or within a period a£ one year €rom the date hereof,
whichever occurs first, or such further time as the Planning Coimnission may greZt,
(9) That Condition Nos. 3, 4, 5, 6, and 7, above mentfoned, shall be complied with
prior to final building and zoning inspections.
