A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
RECOMMENDING TU THE CITY COUNCIL OF THE CITY OF ANAHEIM THAT
RESOLUTION N0. 72R-234 APPROVING REClASSIFICATION N0. 71-72-41
BE AMENDED
WHEREAS, the City Planning Coimnission approved Reclasaification No. 71-72-41 by
Resolution No, PC72-94 on May 15, 1972, following which the Anaheim City Council approved
said Reclassification by ResoluC.ion Nn. 72R-234 on June 13, 1972; and
WHEREAS, the above-mentioned Resolutions of approval of Reclassification No. 71-72-41
contained the following condition;
"3. T::.it a five-foot high earthen berm and five-foot to six-foot masonry
wall on top of the berm shall be constructed along the easterly property line provided,
however, that any berming proposed on the freeway right-of-way shall be subject to
the approval of the State Division of Highways."

WHEREAS, durins the public hearing for Variance No. 2596 on May 29, 1974, the
petitioner stipulated that rather than conatruct the five-foot high earthen berm and five-
foot to sir•.-foot masonry wall, as required ir, the approval of Reclassificntion No. 71-72-41
rezoning the subject property, that an eight-£oot offset masonry well, tan in color, was
proposed to be constructed to separate the Orange Freeway from the proposed twenty-foot wide
public alley along L•he easterly property line, in addition to a three-foot wide landscaped
area; and
WHEREAS, the petitioner further stipulated to construct the project in cnmpliance
with the noise insulation sr.andards appiicable to exterior walls, as adopted by the Department
of Houaing and Community Development; and
WHERGAS, the City Planning Commission determined that the stipulatione by the
petitioner, above-mentioned, would provide adequate visual and sound buffering irom the
adjacent freeway,
NOW, THEREFORE, IIE IT RESGLVED that the City Plannins Commission recommends to the
City Council that Resolution No. 72R-234 be amended to delete Condition No. 3, as outlined
abuve, and to add a new Condi.tion No. 3, as follows:
"3. That en eight-foot offaet masonry ~~all, tan in color, ahall be constructed
along the easterly property line in addition to a three-foot wide landscaped area to
separate the Orange Freewey from the proposed twenty-f.oot wide public alley; and that
an accoustical analysis shall be provided showing that the propoaed buildings are
designed to limit intruding noise to an interior noise level not to exceed 45 dBA in
any habitable room measured in accordance with khe U.B.C. Staudard No. 35-3 and that
a test report showing compliance with the allowable interior noise level be eubmitted
to the Buildin~ Division prior to occupancy, as stipulated Co by the petiCioner."
