A RESOLUTION OF THE CITY PLANNING COMMISSIZ 60F BEEG~ EDANAHEIM
THAT PETITION FOR VARIANCE N0.
WHEREAS, the City Planning Commission of the City of Maheim did receive a verified Petition for Variance from • STATE
OP CALIFORNIA, Department of Transportation, District 7, Post Office Box 2304, Los Angeles,
California 90054; PRUDENCIO E. YORI3A, in care of Albert Yorba, 20911 Esperanza Road, Anaheim,
Cali£ornia 92806, Owners; WILLIAM F, LYON COMPANY, 366 San Miguel Drive, Suite 201, Newport
Beach, California 92660, Agent of certain real pfoperty situated in the City of Anaheim,
County af Orange, State of California, as described in ~xhibit "A" attached heretb'and re-
ferred to herein as though set forth in full; and
WHEREAS, the City Planning Commission did hold a public hearing at the City Hal! in the City of Anaheim on
January 21, 1974, at 2:00 o'clock p.m., notice of said public hearing having been duly given as requiced by law and
in accordance with the provisions of the Maheim Municipal Code, Chapter 18.68, to hear and consider evidence for and against said
proposed vaiiance and to investigate and make findings and recommendations in connection therewith; and
WHEREAS, said Commission, after due inspection, investigation, and study made; by itself and in its behalC, and after due
consideration of all evidence and reports offered at said hearing, does find and determine the following Pacu:
1. That the petitioner requests variances from.,the. Anaheim Municipal Code, as follows:
i
(a) SECTION 18.28.050(5)(b)_ - Maximum permitted height within 150 feet of an
R-A Zone. (One-sto~ permitted; two-story pro-
posed)
(b) SECTION 18.28.050(11) ; Required masonry wall abutting a single-family
r2si3entiel zone. (Wall required; none proposed)
2. That the petitioner proposes to subdivide subject property into seven R-2 zoned
lots and establish a 232-unit, multiple-residential development.
3. That Waiver 1-e, above-mentioned, is hereby granted on the Uasis that the existing
R-A property to the southeast of subject property is tentatively proposed for future devel-
opment of an R-3 apartment project and a C-1 c~mmercial site.
4. That Waiver 1-b, above-mentioned, is hereby granted on the basis Chat the placement
ot the proposed six-foot masonry wsll at the top of the slope abuttino RS+5009 properties,
in conjunction with an existing wood fence at the toe of the slope on the property line
abutting RS-5000 properties, will provide the besC possible screening for L•he RS-5000 prop-
erties.
5. That the petitioner demonstrated thaC the progosed use is the highest and est use
£or subject property,
6. That the petitioner submitted revised plans to conform to Planning Commission policy
regarding density and to parking standards, and subject propoe.al exceeds these requirements.
7. That the Planning Commission found same dissatisfaction with the continuation of
Cresthill Drive through the proposed development; however, it was determined that this streeC
continuation is imperative to the good living environment and the circulation element of the i
City.
8. That there are exceptional or extraordinary circumsCances or conditiopp ypglicable ~
to the property involved or to the intended use of the property that do not a 1 enerally
to thi; property or class of use in the same vicinity and zone.
9, That the requested variance is nothereLrofert`hinptheesamelvicinitynand zone,fand

~i:~:iR"uNMENTAL IMPACT REPOFT FINllING:
That the Ylanning Commission in connection with the filing of Environmental Impact Report
No. 107, the Addendum to which reflects changes in the revised exhibits as submitted and
has not been reviewed by the EIR Review Committee, finds and determines that the EIR Review
Co~mittee determir.ed that the Report is adequat•e as an informative document and follows the
City's established guidelines; that there would be no significant adverse environmental
impacts; and, therefore, the Planning Commission recommends to the City Council that said
Report and Addendum be adopted as the Council's Environmental Impact Statement.
NOW, THEREFORE, BE IT RESOLVED that tl~e An•eheim City Planning Commission does hereby
grant subject Petition for Variance, upon the following conditions which are hereby found
to be a necessary prerequisite to the proposed use of the subject property in order to pre-
serve the sAfery and general welfare of the Citizens of the City of Anaheim:
(1) That this variance is granted subject to the campletion of Reclassification No.
73-74-27, now pending.
(2) That subject propetty shall be developed subs~antia lly in accordai:ce with plans
and specifications on file with the City of Anaheim marked Exhibit Nos. 1(Revision No. 2)
2, 3, 4, 5, 6, 7, 8, 9, 10, 11, and 12.
