BE GRAN'fED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Conditional Use Permit Irom DUNN PROPERTIES CORP., 2009 East Edinger, Santa Ana, California 92701, Owner, of certain real property situated in the City of Anaheim, County ef Orange, State of California, as described in Exhibit "A" attached hereto and referre~ to herein as though set forth in full ;and WHEREAS, the City Planning Commisslon did hold a public hearing in the City Sall in the City of Anaheim on Msy 29, 1974, at 2~ ~~ o'clock p.m., notice of said public hearing having been duly given as requiced by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.64, to hear and consider evidence for and against said proposed conditional use and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission; after due inspection, investigstion, and study made by itself and in its belialf, and after due consideration of all evidence and reports offered at sald hearing, does find and determine the following facts: 1. That the proposed use is proper!y one For which a Conditionai Use Pemiit is author.ized by Code Sections 18.40.060(g) and (i), to wit: establish an on-sale liquor establishment i.n each of four (4) restaurants and a 1;200-seat triple theatre in a portion of the proposed C-1 7.one, 2. That the Planning Commission recognized that at least one of the proposed ~ regtaurants would have a semi-enclosed eating area, and these were del•ermined to be a permitted use; provided, however, thnt said semi-enclosed eating area having not been. advertised for consideration at this public heering shall be advertised prior to City Council review. 3. That the petitioner expressed a desire to have on-sale beer and wine in the pro- posed delicatessen, and the'•Pianning Commission determined that this would be an appropriate application at the subject location. 4 That the proposed use will not adversely af!'ect the adjoining land uses and the growih and development of the arca in which it is proposed to be located. $. That the size and shape of the site proposed for the use is adequnte to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfarc of the Citizens of the City of Maheim. 6. That the granting of the Conditional Use Pecmit under the conditions imposed, if any, will not be detrimental to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 7. Tliat one person appeared in opposition to subject petition in relationship to the.proposed deveZopment of that portion of the subject property designated as Lot 3. ENVI~ONMENTAL IMPACT REFOIt'T FINDING: That Environmental Im?act Report No. 123, having teen considered this date by the City Planning Coffinission and evidence both w:itten and oral having been presented to supplement said draft EIR No. 123, the Planning Commission believes that said draft LIR No. 123 does conform to the City and State Guidelines and the State of California Environmental Quality Act and, based upon such information, does hereby recommend to the City Council that they certify sai~ EIR No. 123 is in compliance with said Ettvirc~nmental Q~:ality Act.
