A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE v0. 2607 BE GRANTED
WHEREAS, the City Plenning Commission o[ the City of Anaheim did receive a verified Petition for Verience
from MARTHA K. SCHUMACHER, 213 North Helena Street, Anaheim, Californi~ 92805, Owner; and
LEUNARD SMITH, 125-D South Claudina Street, Anaheim, California 92805, Agent, of
certain real property situated in the City of Anaheim, County c~ Orange, State of California,
described as Lots 42 and 43 of Tract No. 6QI, in the City of Anaheim, as shown on a map
thereof recorded in book 19, pages 47 and 48, Miscellaneous Maps, records of said Orange
County
; end
WHEREAS, the City Planning Commission did hold e public hearing at the City Hnll in the City of AnuUeim
on May 29, 1974 et 2:00 o'clock P.M., notice of said public hea:ing having been duly given es required
by law end in ecrnrdence with the provisions of the Meheim Municipel Code, Chapter 18.68,to hear end consider evi-
dence for and ngainst said proposed variance end to investignte ond meke findings and rernmmendetions in connection
therewith; and
WHEREAS, said Commission, eEter due inspection, ir.vestigation, and study mede by itself nnd in its behelf,
an:'• ufter due consideration of ell evidence and reports oEEered at seid hearing, does find and detemine the following
fects:
1. That the petitioe~er reqs~ests e veriance frocn the Anaheim Municipel Code to construct a medical
and generai office buillding:
(a) Section 18.38,050(1)(A) - Minimum buildinR site .rea. (20.000 square feet
required; 9,716 square feet proposed)
(b) Sect2on 18.38.050~2)(E) - Minimum landscaped setUsck. (10 feet required;
~0 feet proposed)
2, That Waivery 1-a and 1-b, above-mentioned, are hereb•~ gr.ented on the basis that
t~_e petitioner demon~trated thet a hardship w~uld be creaCed if said waivers were not
granted.
3 Thet there ere exceptional or extreordinary circumstances or conditions epplicable to the pmperty involved
or to the intended use of the property that do not epply generelly to the properry or class of use in the seme vicinity end
zone.
4. That the requested varience is necessary for the preservation and enjoyment of a substential property right
possessed by other property in the same vicinity end zone, and denied to the property in question.
~ Thet the requested veriance will not be materially detrimentel to the public welfere or injurious to lhe prop-
erty or imprervements in such vicinity and zone ia which the pcoperty is located.
6. That five (5) interested property owne:s in the area appeared at said public
hearing in connection with subject petition and Area Development Plan No. 115.
ENVIRONMENTAL IMPACT REPORT FINDI~^G:
That the Planning Commfsaion recommends to the City Council that the subject project be
exempt from the requirement to pxepare an Environmental Impact Report pursuant L'o the pro-
visions•of the California En~vironmental Qualilty Act.

NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject
Petition for Varience, upon the following conditions which are heceby found to bc a neccssary prerequisite to the pro-
posed use of the subject propecty in order to preserve the sefaty and general welfece of the Citizens of the City of_
Anaheim: ~
1. That this varianc~ is granted subject to the completion of Reclassification
No. 73-74-54, now pending. .
2. That subject property shall be developed substantially in e~cordance with plans
and specifications on file with the City of Anaheim msrked Exhibit No. 1; provided, however,
that the access point on Harbor Boulevard shall be relocated to the north property line and
an easement executed to permit joint or mnltiple use of the access point by the adjoining
property to the north whenever the property to the north develops.
