PC74-114 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF AN.4tiE?M THAT PETITION FOR CONDITIONAL USE PERMIT N0, t469 BE GRANTED IN PART WHEREAS, the City Planning Coimnission of the City of Anaheim did receive a verified Petition for Conditi~nal Use Permit from the GREEK ORTHODOX COMMUNITY OF ORANGE COUNTY, Owner, of certain real property situated in the City af Anaheim, County of Orange, State of California, as described in Exhibit "A" attached hereto and referred to herein as though set forth in full; and WHEREAS, the City Plann~.ng Comnission did hold a public hearing in the City Nall in the City of Anaheim on May 29, 1974, at 2:00 o'clock p.m., notice of said public hearing having been duly given as required by iaw and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.64, to hesr and consider evidence for and against said proposed conditional use and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does f.'ind and determfne the following facts: 1. That the proposed use is properxy one for which a Cnndicional Uae Permit is authorized by Code Section 18.16.040(5), to w.it: permit the conatruction of a churcli and fellowship hall and thecontinued use of exiating classroou~ facilities with waivers of: (a) SLCTION 18.04.030(b)(13) - Minimum number ofparkinQ spaces._ (486 spaces required; 137 spaces proposed)• (b) SECTION 18.16.050(4)(b) - Maxfmum building heit;ht adiacent to a residential zone. (35 and 49 Eeet required; 50 and 54 feet proposed) 2. That Weiver 1-a, above-mentioned, is determi.ned to be unnecessary sirce the minimum number of parking spaces is based upon t6e number of seats in the sanctuary only. 3. That Waiver 1-b, above-mentioned, is hereby granted on the besis that said waiver is not unreasonable for the proposed use. 4. That the petitioner stipulat~d to satisfying the conditions of approval for the previously approved Conditional Use Pecmit No. 786 on the subject property. 5. That the petitioner stipulated to the 3mmediete raising and/or lowering of the height of the fence along the north and south property lines to six feet (6°) from the higheat finished grade on either side of the fence, except that the fence shall be forty-two inches (42") in height in the twenty-five foot (25~) setback area from ttie property line on Dale Street. 6. That the petiCioner stipulated to ttie immediate lowering of the outside lighting, said lighting to be down-lighted from a heLy,ht not to exceed the height of the six-foot (6') fence. 7. That the petitioner signitied that he was aware that if the existing claseroom structure is retained Eor use, it shall te brought up to the appropriate building code, if required. 8. That the proposed use will not adversely affect the adjoining land uses and the growth and development of Lhe area in which it ls proposed to Ue located. 9. ThBt the size and ahape of the eite proposed tor the uae is adequatz to allow tne full development of the propoaed use in a manner nol• detrimentel to Che particular area nor to the peace, health, sefety, and general welfare of the Citizens of the City of Anaheim. 10. That the granting of khe Conditional Use Permit under the conditions imposed, ii any, will noL• be detrimental to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 11. That this conditional use permit is granted subject to the completion of Conditional Use Permit No. 786. . • 2, That tHe existing autside lighting shal.l be immediaf~ly lowered and down-7.ighted from a height not.to exceed the height of ttie six-Poot (6°) fence, as stipulated to by the petitioner. ~ 3. That the height of the fence along the north and south property.lines shali be immediately raised and/or lowered to six feet (6°) from the highest finished gra.de on either side of the fence, except that the fence sha1L be forty-tvo inches (42") in fieight in the twenty-five foot (25°) setback area from the property Iine on Dale Str.eet, as stipulated to by the petitioner. 4. That trash storage areas shall be provided in eccurdar.ce with apgroved plans on file witl~ the Office af the Director of Public Works. 5. That fire hydrants shall be installed and ci~arged as required and determined tfl be necessary by the Chief of the rire Department prior to commencemenC of.structural framing. 6. That i% the existing classroom structure is retained for use, it shall be brought up to the appropriate building code, if required. ~ 7. That subject property shall be developed substantially in accordance with plans I and specifications on file with the City of Anaheim marlced Exh36it Nos. 1, 2, and 3. 8. That Condition Nos. 1, 2,,.3, 4, and 6, above-mer.Eioned; shail be complied with prior to.final building and zoning inspect3ons.
