A RESOLUTION OF THE CITY PLANNING COMMISSION OF~T6H~E CITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT BE GRANTED
WHEREAS, the City Plenning Commissior. of the City of Aneheim did receive a verified PetiLion for Can-
ditionalUsePermitfrom FOREST LAIJN CEMETERY ASSOCIATION, P. 0. Box 1151, Glendale, Calitornia,
g1209, Owner; and JAMES A. ARNERICH and HAROLD MGRRISON, P. O..Box 1151, Glendale,
California, 91209, Agents of certain real property situated,in.the City of Anaheim, CounYy
of Orange, State of California, as described in Exhibit "A" attached hereto and~referred
to herein as though set furth in full
; and
WHEFiEAS, the City Flanning Commission did hold o public hearieg at the City Hell in the City of Anaheim
on June 10, 197~s, at Z:00 o'clock P.M., notice of said puhlic hearing heving been duly given
as cequired by law and in accordance with the provisions of the Anaheim Municipel code, Chapter 18.64, to hear
end considec evidence Eor and against said proposed conditional use and to investigete and make findings and
recommendations in connection thecewith; and
RHEREAS, said Commission, e:ter due inspection, investigation, and study made by itself and in its be-
halE, end r.fter due consideretion of all evidence and cepocts offered at seid hearing, does find and determine the
Eollowing facts: '
~ 1, That the proposed use ic pmperly one for which a Conditior.al Use Permit is authorized by Code Sect i on
18.64.020(5) to wit:convert an existing medical-dental office complex into a planned unit
com;nercial development, with waivers of:
a. SEC710N 18.08.440(3) - Requirement that lots must ab~t a public street or alley
b. SECTION 18.40.070(4)l.c. - Minimum required number of parkina spaces (488 ~
required; 43$ proposed)
2. That Waiver 1-a, above-mentioned, is hereby granted on the basis that similar
waivers have been previously approved by the Commission to allow for d2velopment of the
small lot concept.
3, That Waiver 1-b, above-mentioned, is hereby granted on the basis that the request
is minimal for the use as proposed.
4. That the petitioner stipulated that ceparate electrical and water meters shalaib~e
located in the common areas or on each individual parcel end serve that oarcel only,
locations to be subJect to the approval of the Utilities D~,rector.
5, That the petitioner stipulated to submission of CC~R's for the City Attorney's
approval for concurrent recordation with the parcel map. ~
6, That the petitiarer stipulated to submission of a complete synopsis of the pro-
posed functioning of the operating corporation, including but'~,not limited to the articles
of i~corporation, bylaws, proposed methods of management, bonding to insure maintenance of
common property and buildings, and such other information as may be required by the City
Attorney prior to approval of a parcel map.
7, That it was determined that the owner(s) of subject property shall conditiona}}y
dedicate to the Gity of Anaheim a strip of land thirty-two feet (32') in width, or-such
other width determined io be satisfactory by the City Engineer, from the centerline of the
street from the north property line along Medical Center Drive (private street) for streei
widening purposes, conditioned upon the need for a public street as determined by the City
of Anaheim.
8. That the proposed use will not adversely affect the adjoining land uses and the
growth and cevelopment of the area in which lt is proposed to be located,

9. That the size and shape of the site proposed for the use is adequate to allow the
iull development of the proposed use in a manner not detrimental to the particular area nor
to the peace, health, sa,'ety, and general welfare of the Citizens of the City of Anaheim.
10. That the granting of the Conditior~al Use Permit under the conditions imposed, if
a~y, will not be de:rimental to the peace, health, safety, and general welfare of the

ENVIRONMENTAL IMPACT REPORT FINDING:
That the Pianning Commission recommends to the City Council that the subject project be
exempt from the requiremer,t to prepare an Environmental Impact Re~aort pursuant to the
provisions of the Lalifornia Environmental Quality Act. •
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission dnss hereby
grant subject Petition for Cond3Yio~a1 Use Permit, ~pon the rollowing conditions which are
hereby rourd ta be a necessary prerequisite to the proposed use of the subject property ?r,
order to preserve the sa~ety and general wel`are of tne Citizens or :.-`+: City of Anaheim:

of the Orange County Recorder.
(2) That Covenants, Conditions and Restriciions shall be submit*_ed to and approved
by tne C~ty Attorney's Office prior to City Council approval of the parcel map; and,
further, that the approved Covenants, Co~ditions, and Res:rictions shall be recorded con-
currently with the parcel map, as stipu'-" ~ to by tha pe'titio::er,
(3) That prior to approval of a p~, . map, the applica~t shall submit to the City
Attorney for approval or denial a compleLe; syiiopsis of the proFosed functio~ing of the
operating corporation, ircluding but not limited to the articles oT incor~oration, bylaws,

ings, and such other informatio~ as the City Attcrney may desire to protect the City, its
citizens, a~d the purchasers of the project, as stip~lated to by the petit3or,er.

(6) That separaL•e electrical and water meters shall be located ir the common area_ or
o~ each individuai parcel and serve :hat parcel or.ly, as a?proved by the Utilities Direc:or

(j) That subject prooerty shall be developed substantially in accordance with plans
ar.d specificatiors on file with the City of Anaheim marked Exhibit Nos. 1, 2(Revision i),
39 '+~ 5, 6, 7, 8 and 9.
(8) Thax the property shall be made to comply with the Uniform Building, Plumbing,
Mechanical and Electrical Codes in all respects, or satisfactory legal arrangements shall
be made which shall provide the same protection to all the property owners as would be
provided if the buildings did comply with said Codes for separate parcels, said legal
arrangemen~s being subject to approval of the Chief Building Inspector and the City
Attorney's Orrice.
(9) That Condi':ion Nos. 1, 2, 3. 4 and 6 shall be complied with within a period oS
nine:y (90) days or such i~rther time as the Planning Commission may grant.
(10) That the sewer system located on this Froperty and in the private street adjacent
to the south and the pump station located on thts property are pr~vate sewer systems owned,
operated anc maintained by the applicant or his successors in interest, and =_hall ro: be a
part of :he City sewer system nor shall it be a responsibility of the City to rnain~ai:~ any
portioz thereof.
