A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
RECOMMENDING TO THE C1TY COUNCIL OF THE CITY OF ANAHEIM THAT
PETITION FOR RECLASSIFICATION N0. ~-~3~$_BE APPROVED '
WHEREAS, the City Planning Commission of the City of Maheim did ceceive e verified Petition for Re-
classification from HOWARD BUDLONG and JOE MAAG, 20046 Santa Ano Canyon Road, Anaheim,
California 92806 (Owner); and SCHMID CONSTRUCTIOP~ COMPANY, 1681 Langley Avenue,
Irvine, California 92705 (Ageat) of certain reai property situated in the City of
Anaheim, County of Orange, State of California, ay described in Exhibit "A" attached
hereto and referred to herein as though set forth in Eull

WHEREAS, !he City Plenning Commission did hold e public hearing et the City Hnll in the City of Aneheim
on June 10, 1974 ot 2:00 o'clock P.M. notlce of seid puhlic hearing having been duly given as required by
lew and in accordence with the provisions oE the Aneheim Municipal Code, Chapter 18.72, to heac and consider
evidence for end ngeinst said proposed reclessificetion and to investigete andmeke findings endrecommendet:ons
in connection therewith; and
VJHEREAS, seid Commission, after due inspection, investigetion, and study mede by itself and in its be-
helf, and after due consideretion oE all evidence and reports offered et snid hearing, does find end determine the
Eollowing fects:

1. Thet the petitioner ~roposes a ceclessificetion of the ebove described property fcom the R-A
(AGRICULTURAL) ZONE to the R-1 (ONE-FAMILY RESIi3~x1VTIAL) ZONE.
2. That the Anaheim General Plan designates the Qubject property for loa-density
residential uses.
3. That the proposal is in conformance with the Scenic Corridor (SC) Overlay Zone.
4. That the petitioner submitted revised plans and reduced the number of eingle-
family Tots to fifty-seven (57) rather than sixty (60), as originally proposed; and the
revised denaity of tte project proposes approximately 3,28 dwelling units per gross ecre
which is in conformance with the Anaheim 'General Plan for the area.
5. That it was determined that the owner(s) of subject property ehall conditionally
dedicate to the City a strip of land as required for the future exten~ion of a fifty-fout
foot (54') wide street from the intersectior of Leandr.o Street and "A" Street to the
south tract boundary, including necessary standerd property line radii; and said
conditional dedication shall be conditioned upon the need for a streeC as determined
by the City of Anaheim.
6. That the propoaed reclassification of subject property is necessary and/or
desirable for the orderly and proper development of the community.
7. That the proposed reclassification of sub~ect property doea properly relate to
the zones and their per.mitted uses locally established in close praximity to subject
praperty and to the zones and their pennitted uses generally established throughout the
community.
8. That the proposeJ reclassification of subject property requires the dedication
and improvement of abutting streets in accordance with the Circc:l<C.ion Element of the
General Plan, due to the anticipated increase in traffic which wi@`1 be generated by the
intensification of land use.
9. That seven (7) residents of the subject area were present, Five (5) of whom
appeared at the public hearing.
ENVIRONMENTAI. IMPACT RCPORT FINDING:
That Environmental Impact Report No. 126, having been considered this date by the City
Planning Cormiission and evidence both written and oral having been preseteted to supplement
said draft EIR No. 126, the Planning Commiasion belieyes that said draft EIR No. 126 does
conform to the City and State Guidelines and the StaEe of California Environmental Quality
Act aud, based upon such information, does hereby reco~nend to the City Council that they
certify said EIR No. 126 is in compliance with said ~;nvironmental Quality Act.

t!~at Title 1&Zoning of the Maheim Municipal Code be ammded to exdude the ebove fltscdbed propetty from the
R-A (AGRICULTURAL) ZONE and to incorporate said described property into the R-1 (ONE-FHMILX
f.ESIDE,IT~L) ZONE, upon the following condi:ions which are hereby found to be a nacessary
prerequisite to the proposed use of subject property in order to presPrve tfie safety and
general welfare of the Citizens of the City of Anaheim:
i. That a final tract map of subject property shail be submitted to and approved by the
City Council and then be recorded in the Office of the Orange County Recorder.
2. That the owner(s) of subject proper:.y shall conditionelly dedicate to the City of
Anaheim a strip of land as required for the future extension of a fifty-four f~ot (54')
wide street Erom the intersection of Leandro Street and "A" Street to the sout~: tract
boundary, including necessary standard property line radii; and said conditional dedication
sha7.1 be conditioned upon the need for a street as determined by the City of Anaheim.
3. That the owner(s) of subject property shall pay to the City of Anaheim the approprl~te
park and recreation in-lieu fees as detennined to be appropriate by the City Council, said
fees to be paid at the time the building permit is issued.
4. That fire hydrants shall be instal:ea and charged as required and determined to be
necessary by the Chief of the Fire Department prior to commencement ef structural framiag.
5. That all lots within this tract shall be served by underground utilities.
6. That all air-conditioning facilities shall be properly shielded from view and the
sound buffered from adjacent pr.operties.
7. Prior to the introduction of an ordinance rezoning subject property, Condition No, 1,
above-mentioned, sY~sll be completed. The provisions or rights gran:ed by this resolution
shaZl become null and void by action of the City Council unless said conditions are com-
plied with within one year from the date hereof, or such further time as the City Council
may grant,
8. That Conditions No. 2, 5, and 6, above-mentioned, shall be complied with prior Co
final building and zoning inspections.
9. That prior to issuance of building permits for sub~ect property, ex3sting structureo
shall be demolished and sewers capped under permit by the Suilding Division.
