PC74-118 ~ _ A RE50LUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR ~'ARIANCE N0. 2603 RE GP.ANTED IN PART WHEREAS, the (iity Flanning Commission of the Ciry oC Maheim did receive a verified Pedtion for Variance from iiOWARD B'i1DLONG and JOE MAAG,20046 Santa Ana Canyon Ibad., Anaheim, California 92806, (~wners) and SCIL"1ID CONSTRUCTION COMPANY, 1681 Langley Avenue, Irvine, California 92705, (Ag~nt) of certain real property situated in the Ci.Cy of Anaheim, County of Orange, State of Califurnia, as described in Exhibit "A" aCtached hereto and referred to herein as though set forth in full WHEREAS, the City Planning Commission did hold u public heuring at thc City Hall in the City of Anaheim on June 10, 1974, at 2:00 o'clock p.m., +iotice of said public hcaring having been duly ~iven as required by law and in accordance with the provisio:is of thc Maheim Municipai Code, Chapter 18.68, to hcar and constder evidence for and against said proposed variancc and to investigatc and make findings and recommendations in connection therewith; and WHEREAS, said Commission, atter due inspection, investigation, and study made by itsclf and in its bchalf, and after due consideration of ali evidence and reports offered at said hearing, does find and determine the following facu: 1. That.,.the petitioner requests.the following pariances from the Anaheim Muncipal Code, to construct e aixty (60) lot single-family aubdivision: (a) SECTION 18.04.090(1)(h)(1) - Minimum side vard aeCback of a 6 foot hiRh block wall on reversed corner lot. (5 feet required; 0 £eet proposed) Lb) SECTION 18.08.550 - Minimum lot width on a cul-de-sac. 60 feet required; 55 and_56 feet proposed) (c) SECTION 18.24.030(4)(a)_ ~- Minimum lot width. (70 feet required; 55, 60, 63, 65, 68 end 69 feet proposed) 2. That Waiver 1-a, above-mentioned, is hereby granted on Che basis that Che petitimer demonetrated that a hardship would be created if said waiver was not granted. 3. That Waivere 1-b and 1-c were withdrawn by the petitioner, eince the revised plana indicated fifty-seven (57) lots rather than sixty (60), as originally propoaed, eliminating the need for the waivers. 4. That there are exceptional or extraordinary circumsCances or conditions applicable Co the property involved or to the intended use of the property that do nat apply generally to the property or clasa of use in the same vicinity and zone. 5. That the requested variance ie necessery for the preservation and eljoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 6. That the requested variance will noC be materially detrimentel to the public welfaze or injurious to the property or improvements in such vicinity and zone in which the prnperty is located. 7. That seven (7) reaidents of the subject area were present, five (5) of whom appeared at the public hearing. ENVIRONMENTP_L IMPACT REPORT FINDI,IG: That Environmental Impact Report No. 126, having been considered this date by the Ci.ty Planning Commission and evidence both written and oral liaving been preaented Co supplement said dra£t ETR No. 126, the Planning Commission believes that said draft EIR No. 126 does conform to the City and State Guidelines and the State of California Environmental Quality Act and, based upon such information, do es hereby recommend to the City Council that they certify said EIR No. 126 is in compliance with said EnvironmenCal Quality Act.
