RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIM.THAT

WHEREAS, the City Planning Commiss~on of the City o: Anehe?m did receive a veriEied Fetition for Re-
classificationfrom HENRY F, ANU ETHEL C. DEL GIORGIO, 2535 West La Palma Avr:.nue, Anaheim,
California, 928G1, Owners; and McCARTHY, Attn: E. R. FULLER, 2535 West La Palma Avenue,
Anaheim, California, 92801, Agent or certain real property situation in the City of
Anaheim, County of Orange, State of Cali~ornia, as described in Exhibit "A" aYtached
hereto and referred to herein as though sat forth in fuli
; and
WHLREAS, the CityPlenning Commission did hu:~ a public hearing et the CityHall in the City of Anaheim
on June 10, 1974, at 2:00 o'clock P.M. notice of said public heacing heving b'een duly given as requiced by
law and in eccordance with the provisions of the Maheim Municipel Code, Chapter 18.72, to hear and consider
evidence for and egainst seid proposed rec?assificetion and to investigate endmake findings endcecommendations
in connection therewith; end
WHEF2EA5, seid Commission, efter due inspection, investigation, and study made by itseif and in its be-
half, and after due consideration of ell evidence and ceports offe:ed at said hearing, does find and determine the
following fects:
1. That the petitioner proposes a reclassification of the above described ptoperty from the R-A (AGR I-
CULTURAL) ZONE to the R-H-10,000 (RESIDENTIAL HILLSIDE LOW DENSITY SINGLE FAMILY) [ONE.
2, That th~ subject property is designated on the Anaheim General Plan for low-
density residential development and is included under a ilohler Drive Ann~xation Area
resolu:ion of intent to the R-H-22,000 Zone.
3. That the official City alignmEnt of Fairmont Boulevard (Access Point No. 10,
desig;~ated by General Plan Amendment No. 125) to serve the needs ofi the sub~ect proparty
and the surrounding area to Santa Ana Canyon Road has not been finalized and the pro-
posed alignment, as shown on the petitioner's submitted plans, is subject to change
which may a`fect the proposed project.
4. That the Department of the Army, Corps of Engineer~ submitted a letter indicat-
ing thac failure of the dam on the existing reservoir would cause considerable damage
unless corrective actinn is taken to insure proper enginearina standards are met in-
corporating adequate preventative meas~res in the site drainage i:nprovements; and that
the questions posed by the Corps of Engineers are presently unanswered.
5. TFiat the proposed development of the subject property may limit the usabilitY
of the ex+sting and proposed equestrian trails in the subject area.
6. Tiiat the responsibility and mEthod or" handling the common areas included in the
proposal is not resolved.
7. That the proposal at the subject location would breakcbwn the R-H-22,000 zoning
in the area, and would set an undesirable precedent for other similar requests to further
break dow~the R-H-22,000 zoning.
$, That the proposed reclassification of subject property is not necessary and/or
desirable for the orderly and proper developnient of the community.
g, Tha*. the proposed reclassification of subject property does not properly relate
to the zones and their permitted uses locally established i~ close proximity to subject
property a~d to the zones a~d their permitted uses generally established throughout the

10. That approximately seven (7) persons were present and four (4) persons appeared
at said public hearing, and fourteen (14) telegrams and/or mailgrams were received, all
i n oppos i t ion to subject pet i t i on; and a petition signed by approR;mately 120 residents in the area
requesting no deviation from the present R•H 22,000 zoning, was received.
ENVIRONMENTAL IMPACT REPORT FINDING:
That at~their meeting on March 18, 1974, the Plannirg Commission recommended that the
City Council certify to hav~ng reviewed and considered the inform~ti~n contained in
Environmental Impact Report No. 120 and that the final EIR has been completed in com-
pliance with the California Environmental Quality Act and the State Guidelines.
NOW, THEREFORE, $E IT RESOLVED thet the Anaheim City Planning Commission does hereby cecommend
to the City Council of the City of Anaheim that subjecC Petition far Reclessificetion be denied on the besis of the
efocementioned findings.
THE FOREGOING RESOLUTION is signed and approved by me this 10th day af June, 1974.
