Anaheim Hills Road, Anaheim, California 92807, Owner; AMERICAN AOUSING GUILD - LOS
ANGELES, 409 Westerly Place, No. 105, Newport Beach, California 92660, Agent of certain
real property situated in the City of Anaheim, County o£ Orange, State of California,
as described in Exhibit "A" attached liereto and referred to herein as though set forth
in full

WHEREAS, the CityPlenning Commission did hold a public hcaring at the CityHall in the City oE Anal~eim
on January 21, 1974, at 2:00 o'clock P.M., notice of said public hearing having been duly given
a; required by law and in accordence with the provisions of the Anaheim Municipel code, Chapter 18.64, to hear
and consider evidence for and against seid proposed conditional use end ta investigate and make findings and
recommendations in connection therewith; and
WHEREAS, seid Commission, eftec due inspection, investigation, and study mede by itselE and in its be-
helf, and atter due cansideration of a11 evidence and reports offered at seid hearing, does find and determine the

2. 'fhat Wai~vers 1-a, 1-S ar~ 1-c, abuve-mentioned, are hereby grante~ on tl;e basis
rha~ ~imitar o+aivers have been previously approved by the Commission Lo s1lnw development
oi the small lot concept oL townhouse projects,
3. That Waivers 1-d and 1-e, above-mentioned, are hereby gr2nted on the basis that
the request is minimal and alloc~s for more creative aite planning, as illustraced on the
plan of the site and the topography of the land.
4. That Wai.ver 1-f, above-mentioned, is hereby gr.anted on the basis chat the req4i~e-
ment normally to separate the two zones was applicable to flat land requirements; however',
because of the topography and exhibits, as submitted by the petitioner, said wall v~ould not
be effective in this separation.
5. That Waiver 1-g, above-mentioned, is hereby granted on the basis that the single-
family zone would be at a suUstantially lower elevation than the proposed development, as
illustrated on the plan of the site and the topography of the land; however, grenting of
this waiver shall not establish a precedent for similar waivers unless substantiating evi-
dence has been preaer+ted to justify waiver of the height limitation.
6. That the prop~sed use will not adversely a£fect the adjoini.n~ land uses and the
growth ana develcpment of the area in which it is proposed to be lucated.
7. That the size and shape of the site proposed for the use is adequate to allow the
full development of the proposed use in a manner not detrimental to the particular area
nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim,
8. That the granting of the Conditional Use Permit under the conditions imposed, if
any, will not be detrimental to the peace, health, safety, and general welfare of the Citi-
zens of the City of Anaheim..
9. That reprPSentati.ves of the Orange Unified School Distr.ict and Santa Ana Canyon
Homeowners Associal•ion appeared in opposition to subject petition and that a letter was
filed by the Orange Unified School District in opposition.
ENVTRONMENTAL IMPACT REPORT FINDING:
That the ?'lanning Coimnlssion in connection with the filing of Environmental Impact Report
No. 108, finds and determines that the EIR Review Commlttee determined that the Report is
adequate as an informative document and follows the City's estabiished guidelines and that
there wouZd be no significant adverse environmental impacts; and, there£ore, the Planning
Commission recomneads to t;~e Ci.ty Council that said Report be adopted as the Council°s
Environmental Impact Statement.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby
grant subject Petition for Conditional Use Permit, upon the following conditions which are
hereby found to be a necessary prerequisite to the proposed use of the subject property in
order to preserve the safety and general welfare of the Citizens of the City of Anaheim:
(1) Tliat this conditional use permit is granted sub;ect to the completion of Reclasst-
fication No. 71-7'L-44 and Ter~tative Map of Tract No. 8455 and 845fi.
(2) That a final tract map of aubject property shall be submitted to and approved by
the City Council and then be recorded in the office of the Oranee County Recorder.
(3) That the covenants, conditions, and restrictions shsll. be submitted to and ap-
proved by the City Attorney~s Office prior to Cit•y Council approval of the final tract maP,
and, further, that the appraved covenants, conditions, and restrictions shall he recorded
concurrently with the ~inal tr.act map.
(4) That prior to filin& the £inal cract map, the applicant sha11 submit to the City
Attorney for approval oz denia'L ,a complete synopsis of the proposed functioning of the op-
erating corporation.it~cluding, bu't not limited to, the articles of incorporation bylawa,
proposed methods oE management, honding to insure maintenance of common property and build-
ings, and such other inf•ormt+tion as the City ~lttorney may desire to proCect the Cfty, its
citizens, and the purchbsers of th~ project,
(5) That fire hydrar~ts sha11 be installed and charged as required and determined to
be necessary by the Chief of the Fire Department prior to commencement of aCructural f.raming.
(6) That subject property shall be served by underground utili.ties.
(7) That subject propertv sha11 be developed substantially in accordance with plans
and specifications on file with the City of Anaheim marked Exhibit Nos. 1(Revision 1) and
2 through 28.
(8) That Condition Nos. 1 and 2, above-mentioned, shall be complled with prior t~ the
commencement of the activity authorized under this resolution, or priur to the time that
the building permit is isaued, or within a period of one year from date hereof, whichever
occurs first, or such further time as the Planning Commiasion may grant.
(9) That Condition Nos. 6 and 7, above-mentioned, shall be complied with prior to
fiual building and zoning inspections.
