DEL GIORGIO, 2535 West La Palma Avenue, Anaheim, Califarnia 92801, (Owners), and McCARTHY COMPANY, Attn: E. R.'FULL~R, 2535 West La Palma Avenue, Anaheim, Calif.ornia 92801, (Agent) of certain real property situated in the City of Anaheim, County of Orange, State of Cali.fornia, as described ir~ Exhibit "A" attached hereto and referred to herein as though set forl•h in full WHEREAS, the City Planning Commission did hold a p~ablic hearing at the Ci[y Hall in the City of Anaheim on June l0, 1974, at 2:00 o'clock p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Maheim Municipal Code, Chapter 18.68, to hear and consider evidence for and against said proposed variance znd to investigate and make findings and recoininendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and after duc consideration of all evidence and reports offered at said hearing, does find and determine the following facu: 1. That the petitioner requests a variance from the Anaheim Municipal Code, ~o percnit the keeping of horses on the subject property: SECTION 18.04.020(6)(a-1) - To permit the keeping of horses on 2i loes,_less than 1 acre ;n size• minimum l acre lot size required. 2, That since the Planning Commission has recomnended disnpproval of the reclassifi- cation of subject property, the proposed development could not be accomplished wiChln the site development standards of the zoning on subject properCy. 3, That the lots proposed for fhe keeping of hors~s are not accessiUle to the proposed horse trails except by use of public streets. 4. That there are no exceptional or extraordinary cir.cumstances or conditions applicable to the property involved or to the intended use of the'property that do not apply generally to the property or class of use in the same vicinity and zone. 5. That the requested variance is not necessary for the preservation and enjoyment of a.substantiai property right possessed hy other prop~rty in the same vicinity ar~d zor.e, and denied to the property in question. 6. That the requested variance will be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 7, Th2t approximately seven (7) per~ons were present and four (4) persons'appeared at said Pub'l.ic hearing, and fourteen (14) telegrams•and/or mailgratns were received, all in oppositi.on to subject petition; and a petitfon signed by approximately 120 residents in the area request- ing no deviation from the presec~t R-H 22,000 zoning, was r~:eived. ENVIRONMENTAL IMPACT REPORT FINDING: That• at their meeting on March 18, 1974, the Planning Cocmnission recommended t:hat the City Council certify to having reviewed and considered the information contained in Envirunmental Impact Rep~rt No. 120 and that the final EIR has been compieted in compliance with the California Environmental Quality Act and the State Guidelines.
