A RESOLUTION OF THE CITY PLANNING COMMISSION OF473 CITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL USE PERMIT BE GRANTED I N PART
WHEREAS, the City Planning Commission of the City of Anaheim did receive a veriEied Petition for Con-
ditionalUsePermitErom FRED and CELIA FLORES, 801 South Ramblewood Drive, Anaheim, California,
92804, Owners o` certain reai property described as follows:
The Southerly 150 feet of Original Town Lot 54 in the city of Anaheim, county
oT Orange, state of California, as per map recorded on a map of the Town oT
Anaheim, recorded in Book 4 pages 629 and 630 of Deeds, records of Los Angeles
County, California.
; and
WHEREAS, the CityPlenning Commission did'nold a public hearing at the CityHall in the City oE Anaheim
an June 10, 19]k, at 2:00 o'clock P.M., notice af seid public hearing having been duly given
as required by law and in accordance with the provisions of the Anaheim Municipal code, Chapter 18.64,to hear
b; ~1 consider evidence for and egainst said proposed conditional use end to investigate and make findings and
recommendatious in connection therewith; and
WHEREAS, seid Commi~sion, after due inspection, investigatian, and study made by itself and in its be-
half, ertd aEter due considecation of all evidence end reports offered at said hearing, does find and determine the
following factso
1. That the proposed use is properly one for which a Canditional Use Pecmit is euthorized by Code Sec*_ i on
18.52.Oy0(1)(a), to wit: permit a motoroycle repair and salvage yard with waivers of:
a, SECTION 18.52.060(3)~b) - Screenina of outdoor uses (6-foot biock wa11
required; 6-foot chainlink Yence proposed)
b. SECTION 15.52.060(4)(b) - Minimum number of parkinq sAaces (25 spaces re-
quired; 10 snaces proposed)
2. That waivers 1-a and 1-b, above-mentioned, were withdrawn by the petitioner.
3, That the petitioner stipulated to installing redwood slats in the chainiink
fence.
4. That the petitioner stipulated that no repairs or selling were intended to be
performed at the subject location and, further, that the proposed use would conform to the
requirement that the sound from the use would not exceed 65 dBAs at the property line.
5. That the petitioner stipulated there would be no more than 100 motorcycles stored
on the subject propert~'- at any one time.
6, That it was determined that if any of the offices on the subject property was
rented out in ihe future for other than an M-1 office use, a"seoarate application would be
required.
7, That the Planning Commission determined that the request was to permit an "in-
surance impound yard" and not a repair and salvage yard, since the petitioner indicated
that the motorcycles would be held at the subject property until sold by the various insur-
a~ce companies.
8. That the Pla~ning Commission determined that the use, as granted, should Ue for a
period of two (2) years, subject to review and consideration for extension by the Planni,^,g
Commission and/or City Council upon request by the petitioner.
9. That the proposed use as granted, will not adversely affect the adjoining land
uses and the growth and develupment of thz area in which i~ is proposed to be located.
10. That the size and shape of the site proposed for the use, as granted, is adequate
to allew the (ull developrnent of the proposed use in a manner not detrimental to the par-
ticular erea nor to the peace, health, safety, and general welfare of the Citizens of the

11. Tha: the Conditional Use Permit, as granted and urder the conditions impose~~y
will not be detrimental to the peace, health, sarety, and genetal welTare of the Citizen~
of the City of Anaheim.
12, That one (1) person appeared at said public hearing and two (2} letters were
received, all in opposition to subject petition.
ENVIRONMENTF+L IMPACT REPORT FINDIN6;
That the Planning Commission recommends to the City Co~ncil that tF~c subject project be
exempt from the requirement to prepare an Enviror+mental Impact Report pursuant to the
provisions of the California Environmental Quality Act.
NOIJ, THEREFORE, BE IT RESOLVED that the Anaheim City Plar.ning Coh~ission does hereby
grant subject Petition for Conditional Use Permit, u~on the rollowing conditions which are
hereby round to be a nece~sary prerequisite to the proposed use o~ the suEject r':'oaerty in
order to preserve thz safety and general welfa~e of the Citize~s o~ the City os Anaheir~:
(1) That subject Fro~e,-ty shall be developed substartially i:~ accorda~ce with plans
and specifications o~ rile with the City o` Anaheim marked Ext~ibit No. l; ,:rovided, how-
e•:er, that redwood slats shall be irstalled in the chairlink fe~ce, as stipulated to by the
petitioner.
(2) Tha*_ there snall be no ~epairs to or selling of m.otorcycles at the sLbject
location, as s~ipulated tc by the petitioner. ,
(3) That the sound emanating ~rom the use shall not exceed 65 ciBAs at the property
line.

(5) That this Conditional Use Permit is granted for an "ir.sura,~ce impound yard."
(6) That a time limitation or" Lwo (2) years shatl be gra~.ted for the use or' subject
property and upon request by tFe petitio~er, an additional period or ti;re may be granted
upon approval by the Planning Commissio~ and/or City Cou;tcil,
