THAT PETITION FOR CONDITIONAL USE PERMIT BE
~VHEREAS, the City Planning Commission of the City oE Anaheim did receive a vetified Petition for Con-
ditiona] Use Permit from ROBERT D. HAMPTON~ Jr. ~ 1524 Mable, Anaheim, California 92802,
(Owner); and DAVID '+1. CIIAPMAN, 905 South Euclid Street, Suite 108, Pullerton, California
92633 (Ageat) of certain real property situated in the City of Anaheim, County of Orange,
State of California, as described in Exhibit "A" attached hereto and referred to herein
as though set forth in full
; and
WHEREAS, the City Planning Commission did hold a public heacing at the City Hall in the City of Aneheim
on June 10, 1974 at 2:00 o'clock P.M., notice of said public hearing heving 6een duly given
as required by law and in accordence with the provisions of the Annheim Municipal code, Chapter 18.64,to hear
and consider evidence Eoc and against said proposed conditianal use and to investigate end make findings and
recommendations in connection therewith; and
WHEREAS, seid Commission, aEter due inspection, investigetion, end study mede by ifself and in its Ue-
half, and aEter due consideration ef ell evidence and ceports offered at said hearing, does find end determine the
Eol!awing fects:
1. Thet the proposed use is properly one for which a Conditicnel Use Permit is euthorized by Code
Section 18.44.010 B(1), to wit: establish a wine-tasting, retailing, and warehousing
facility, with waiver of:
SECTION 18.44.030(5)(c) - Minimum number of paricing spaces (37 spaces required;
19 sQacee proposed)
2. That the Waiver is hereby granted on the basis that the hou*s of operation for
ehe proposed use would be at hours other than the r.egular business hours of the otlier usea
at the subject location.
3. That the petitioner stipulated that the hours of operaCion for the proposed use
would be from 3:30 p.m, to 9:30 p.m. on Wednesday3, Thursday and Pridays, from 10:00 a.m.
to 5:00 p.m. on Saturdays, and from 1:00 p.m. to 5:00 p.m, on Sundays; with the wine-
tasting classes being held during the hours of 7:00 p.m. to 9:30 p.m. on 'fhursdays and
Fridays and during the regular business hours on Saturdays and Sundays.
4. That the Planning Commission determined that rhe proposed use should be granted
for a period of two (2) years, subject to review and consideration for extension by the
Commission and/or City Councii upon request by the petitioner.
5. That the proposed use will not adversely affect the adjoining land uses and the
growCh and development of the area in which it is proposed to be located.
6. That the size and shape of the site proposed for the uae is adequate to allow
the full development of the proposed use in a manner not detrimental to the parCicular area
nor to the peace, health, safety, and general welfare of the Citizens of the City of
Anaheim.
7. That the granting of the Conditional Use Permit under the conditiona imposed, if
any, will ttot be detrimental to the pe2ce, health, safety, and general welfare of the
Citizens of the City of Anaheim.
8. That one (1) person appeared at said public hearing in opposition to subject
petiCion.
ENVIRONMENT9L IMPACT REPORT FINDING:
'Phat the Director oE Development Services has determined that the proposed activity falls
within the definition o£ Section 3.01, Class 1 of the Ciey of Anaheim Guidelines to the
Requirements for an Environmental Impact Report and is, therefore, categorically exempt
from the requirement to fi7.e an EIR.

` NOW, THEREFC~RE, BE IT RESOLVED that the Anaheim City Planming Commission does hereby grant subject
Petition for Conditionel Use Permit, upon the fallowing conditions which ere hareby found to 6e a necessary prerequisite
to the proposed use oE the subject property in order to preserve the sefety end general welfece oE the Citizens of the
City of Anaheim:
1. That sidewalks sha11 be installed along Manchester Avenue as required by
the Ci~:y Engineer and in accordance with standard plans and specifications on file in the
Offi.ce of the City Engineer.
2. That•the owner(s) of subject property shall pay to the City of Anaheim the
sum of 60C per front foot along ManchESter Avenue for tree planting purposes,
3. That appropriate wate: assessment fees as darermined by the Director of Public
Util~ties shall be paid to the City of Anaheim prior to the issuance of a building permit
or within 90 days whichever occurs first.
4. That sub;~ect property shall be developed subst.antially in accordance with plans
and specificatit~ns on file with the City of Anaheim marked Exhibit Nos. 1 and 2.
5. That Condition No. 2, above-mentioned, shall be complied with prior to the
co~mnencement of the activity authoriaed under this resoluCion, or prior to the time that
the building pe~~mit is issued, or within a period of one year from date hereof, whichever
occurs first, oi~ such further L•ime as the Ylanning Commission may grant.
6. That Condi*_ion Nos. 1, 3, and 4, above-mentioned, shall be complied with prior
to commencement of the activity authorized under this resolutiun.
7. That the hours of operation for the proposed use ehall be from 3:30 p.m. to
7:30 p.m. on Wednesdays, Thursdays and Fridays; from 10;00
a.m, to 5:00 p.m. on Saturdays; and from 2:00 p.m: to 5:00 p.n. on Sundays; wiCh the
