THAT PETITION FOR CONDITIONAL USE PERMIT 1~E
WHEREAS, the ~City Plenning Commission of the City of A;eheim did receive e veriEied Petition for Con-
ditional Use Permit from JOSEPH C. TRUXAW, 1244 Eisner Place, Anaheic~, California 92801
(Owner); and FRAA'K ROS~, 887 South Anaheim Boulevard, Anaheim, California 92805 (Agent)
of certain real property situated in the City of Anaheim, County of Orange, State of
Celifornia, as described in Exhibit "A" attached hereto and referred to herein as though
set forth in full
; and
NHEREAS,tha CityPlenning Commission did hold e public hearing et the CityHell in the City oE Anaheim
on June 10, 1974, at Z:00 o'clock P.M., notice of seid public heering having been duly given
as required by law end in eccordance with the ptovisions of the Aneheim Municipal code, Chepter 1G.64, to hear
and consider evidence Eor end egeinst seid propused conditionel use and to investigete and meke Eindings end
recommendetions in connection therewith; end
WHEREAS, seid Commission, eEter due inspection, investigetion, and study made by itself end in its be-
helf, end atter due consideretion of ell evidence end ceports oEfered et seid ',~earing, does find and determine the
following fects:
1. Thet the proposed use is properly one for which a Conditionel Uce Pecmit is authorized by Code
Secl-ion 18.64.020(3)(k), to wit: continue operation of a board and care facility for the
treatment of alcoholics.
2, That the petitioner atipulated there would be a maximum of twenty (20) occupanta
in the facility at any one time.
3. That the petitioner sCipulated Chat none of the occupants at the facility would
occupy the attic or basement for living, sleeping, or other purposes.
4. That it was determined that l6is use should be conditioned upon the corrective
work to l~ring thE existing structure into conformance wiCh the building codes Ueing
cummenced immediately and that said corrective work should be completed within 180 days;
and thal• should said correCtive work not be completed wirhin the aforementioned time
schedule, the petitioner may request an extension of time to do so, and upon approval
by the Planning Commission and/or City Council, an ndditional period of time may be granted.
5. That it was determined that the proposed use should be granted for a period of
two (2) years, subject to review and consideration for extension by the Planning Commisaioii
and/or City Council.
6. That the proposed use will not adversely aff:ect the adjoining land uses and the
growth and development of the area in which it is proposed to be locat;d.
7. That the aize and shape of the site proposed for the use is adequate to a11ow
the full development of the proposed uee i.n a manner not detrimental to the particular ar.ea
nor to lhe peace, health, safety, and general welfare o' the Citizens of the City of
Anaheim. '
S. That the granting of the Conditionai Use Permit under the condit•Lons imposed,
if any, will nut be detrimental to the peace, health, safety, and general wzlfare of the
Citizens of the City of Anaheim.
9. That one (1) pereon appeared at s~id public hearing and also submitted a letter
in opposition to subject,petiticn.
ENVIRONMENTAL IMPACT REPORT FINDING:
That the Director of Development Services has determined that Che proposed ac~ivi*_y fells
within the definition of Section 3.01, Clasa 1 of the City of Anaheim Guidelines to the
Requirements for an Environmental Impact Report and is, therefore, categorically exempt
from Che requirement to file an EIR,

~.• NOW, THEREFORE, BE I~ESOLVED that the Anaheim City ~nning Comnission does hereby
;;rant subject Petition for Conditional Use Permit, upon the following conditions which are
hereby f.ound to be a necessary Frerequisite to the proposed use of the suoject property in
order to preserve the safety and general welfare of the Citizens of the City of Attaheim:
1. That the ,~wner(s) of subject property shall deed to the City of Anaheim a
strip of land 45 feet ir width from the centerline of the street alor.g Anaheim Boulevard
for street widening purposes, prior to the time that the building permit is issued or
with3n a period of 180 days,•whichever occurs first or such f.urther L•im~ a9 the Planning
Commission may grant.
2. That the owner(s) of subject properCy shall deed to the City of Anaheim a
strip of land 10 feet in width from the centerline of the alley for alley ~oideniiig purposea,
prior to the time that the building permit is issued or within a period of 180 deys, which-
ever occurs first or such further time as the Planning Coam~isaion ma~ grant.
3. That the owner(s) of subject property 3ha11 pay to the City of Anaheim Che aum
of 60C per front foot along Anaheim Boulevard for Cree planting purposes, ~rior to the
time that the building permit is issued or within a period of 180 days, whichever occura
first or such further time as the Planning Commission may grant.
4. That trash storage areas shall be provided in accordance with approved p:.ans
on file with the Office of the Director of Public Works,
5. That the existing structure shall be brought up to the minimum stand~rds of.
the Uniform Building, Plumbing, Electrical, Housing, Mechsnic<1 and Ftr~ Codes, as adopted
by the City of Anaheim for an H-occupancy, said corrective work ta be commenced immediately
and compleCed within one hundred and eighty (180) days; and Chat should seid corrective
work not be completed with3n the aforementioned time schedule, the petitior.er may request
an extension oP Cime to do so and, upon approval by the Flanning Commission and/or City
Council, an additional period of time may be granted to complete this condition.
6. That subject property shall be developed aubstantially in accordance wiCh plans
and specifications on file with the City of Anaheim marked Exhibit Yos. 1, 2, and 3.
7. That Condition Noa. 4 and 6, above-mentioned, shall be complied with prior to
final building and zoning inepectiana.
8. That there shall be a maximum of Cwenty (20) occupants in the facility at any ane
time, as atipulated to by the petitioner.
9. That none of the xcupanta of the facility shall occupy the attic or basemer.t
for living, sleeping, or other purposes, as stipulated to uy the petitioner.
10, That this Conditional Use Permit is granted for a period of two (2) years
followin~ which time upon request by Che petitioner, an eddirional period of time mey be
granted upon approval by the Planning Commission end/or Ci~y Council.
