PC74-132 A RESOLUTION OF THE CITY PLANNING COMMISSiON OF THE CITY OF ANAHEIM ADOPTING AND RECOMMENDING TO THE CITY COUNLIL OF THE LITY OF ANAHEIM THE ADOPTIO~J OF AMENDMENTS'TO TITLE 18 PERTAINING TO SERVICE STATION REQUIREMENTS AND ADDITIONS WHEREAS, the City Council directed the Development Services Department to review the Ordinance which was adopted March 5, 1974, tore=evaluate the provisions relati~g to tFe ~ocation of new service stations and the abatement of vacant service stations which had been deleted from the ordinance prior to its adoption; and WNEREAS, the Lity Planning Commission did hold public hearing in the Lity Hali in the City of Anaheim on June 24, 1974.at 2:00 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisicns of the Anaheim Municipal Code, to hear and consider evidence for and against said proposed aR~endments and additions:and WHEREAS, said Conunission on June 24, 1974, after due inspection, investigation and study made by itself and ir its behalf, and after due consideration of ail evidence and reports offered at said hearing, does find and determine the following facts: (1) Under the provisions of the present zoning code, service stations are permitted in any location in industrial zones. They are permitted at the intersection of arterial highways in all cortmercial zones except C-0 and C-H, and permitted by Cond~tional Use Permit in the R-A Zone. (2) There is no provision in the zoning code relating to the abatement of vacant servi~~ stations. (3) That changes to the Zoning Code were necessary f~r the purpose of implementing the requirement of a Conditional Use Permit for automobile service stations, for limiti~g the number of stations at an intersection, and for requiring an agreement to remove a ctation which has been vacant for one year as a condition of granting a conditional use permit. NOW, THERE~ORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby adop: and recommend to the City Council of the City of Anaheim the adoption of amendrt!ents to Tit.le 18, Zoning of the Anaheim Municipal Code as follows: C-R (COMMERCIAL-RECREATION) ZONE Delete 18.37.020-A-7 which lists service stations as a permitted use. Add to 18.37.020 after "twenty-one years of age or older," No structure designed or intended for residential use may be used for commercial purposes within this zone. Add 18.37.020-C-15. Automobile service stations, subJect to the requlrements of Chapter 18.87. 2. C-1 (GENERAL COMMERCIAL) ZONE Delete 18.40.020(b)3 which lists automobile service stati~ons as a permitted use. Amend 18.40.060(c) which now reads "Au;omobile service station within seventy-fiv~ feet of a residential zone or a residential structure in an R-A Zone"; to read as foliows; 18.40.060(c) Automobile service station, subJect to the requirements of Chapter 18.87. 3. C-2 (GENERAL COMMERCIAL) ZONE Add 18.44.OlOB(3), Automobile service stations, subject oc che requirements of Chapter 18.87. 4. C-3 (HEAVY COMMERCIAL) ZONE Add 18.48.0106(3). Automobide service station, subject to the requirements of Chapter 18.87. 6, ADD TO SECTION '.8.87.030 .09 Minimum distance between service stations,• Any n~w or remodelled service station shall not be located within 500 feet of any other ser~ice station on the same sida of any arterial highway., This restriction shall not app~y to additions or remodelling totalling less than 5~% of the fair market value of said service station building at the time of remodelling. 7. AMEND 5ECTION 18.64.020(3)~e) TO READ AS FOLLOWS: (e) Automobile servioa stations. As a condition for the granting of a conditional use permit for an automobile service statitin, the applicant shall agree in writing to remove the structures i~ the event t~at the station is closed for a period of twelve consecutive months: A service station shall be considered closed during any month in which it is open for less than fifteen days.
