Pc74-138 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT ~~BE DENIED WHEREAS, the City Planning Commission of the City of Aneheim did receive a vecified Petition for Con- ditionalUse Permitfcom BURTON MORAN PROPERTIES, 2912 Colorado Avenue, Santa Monica, California 90404 (Owner); ON~EGA PRODUCTS CORPORAT~ON, 606 CFalynn Circle,.Orange, California 9266G (Agent) of certain real property situated in the City of Anaheim, County of Orange, State of California, des~ribed as The West 190.00 feet of the South half of Lot 3 of the Golden State Tract No. 2, as shown on a Map recorded in Book 4, page 68 of Miscellaneous Maps, records of Orange County, California. EXCEPTING THEREFROM the South 50.00 feet as described in the deed to the.State of California, rec;orded March 3, 1958 in Book 4214, Page 31~f of Official Records ; end WHEREAS, the City Planning Commission did hold a public hearing at tb.e City Hell in the City of Anaheim on July 8, 19]4, at 2:00 o'clock P•M., notice of said public hearing having been duly given as required by law and in accordance with the pcovisious of the Anaheim Municipal code, Chapter 18.64,to hear and consider evidence Eor and against said proposed conditionel use and to investigate end make findings and recommendetiuns in connection thecewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by it.self and in its be- half, and after due consideration of all evidence and reports offered at said hearing, does find a:d determine the Eollowing facts: 1. Thet the proposed use is pcoperly one foc which a Conditionel Use Permit is authorized by Code Sect i on 18.64.020(4-b), to wit: establish a stucco processing facility. 2. That the nature of the proposed business establishment would not be compatible with the existing uses in the area. 3. That the proposed use will adversely affect the adjoining land uses and the growth and develoFment of the area in wni~h i~ is proposed to be located. 4. That the size and shape of the site proposed for the use is not adequate to allow the full development of the proposed use in a manner not detrimental t~o the particular area , nor to the peace, health, safety, and general welfare of the Citizens of the C~ty of Anaheim„ 5. That the granting of the Conditional Use Permit will be detrimental to the pea.^.e, health, safety, and general welfare of the Citizens of the City of Anaheim. 6. That five (5) business establishments in the subject area submitted letters and four (4) perso~is appeared at said public hearing, all in opposition to subject petition. ENVIRONMENTAL IMPACT REPORT FINDING: That the Planning Commission recommends to the City Council that the request for negative declaration for exemption from the requirements to file an Environmental Impact Report-be denied on the basis that the nature of the proposed business establishment is such that an FIR should be required, said EIR to consider all of the possible environmental impacts. PC74-138 M ~~ ~ NOW, THEREFORE, BE IT RESOLVED lhat the Aneheim City Planning Commission does hereby deny subject Petition for Conditional Use Permit on the basis of the aforementionad findings.
