A RESOLUTION OF THE CIT'Y PLANNING COMMIS 260N~OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. BE GRANTED I N PART
WHEREAS, the City Planning Comm~ssion of the City of Anaheim did receive a verificd Petition for Variance from
WOODBINE CORPORATION,8383 W~lshire Boulevard, Suice 700, Beverly Hills, California 90211
(Owner) of cartain real property situated in the f.ity of Anaheim, County of Orange, State of
California, as described in Exhibit "A" attached hereto and referred to herein as though set
forth in full; and
WHEREAS, the City Planning Commission did ltold a public hearing at the City Hall in the City of Anaheim on
J u 1 y 8, 1974, at 2:00 o'clock p.m., notice of said public hearing having been duly given as required by law and
in accordance with the "provisi~ns of thc Maheim Municipal Code, Chapter 18.68, to hear and consider evidence for and against said
proposed variance and to investigate and make findings and recommendations in connection therewiUi; and
WHEREAS, said Commission, after due inspection, investigation, and study made by itsclf and in its behalf, and after due
consideration of ap evidence and reports offered at said heuing, does find and determine the following facts:
1. Thatthepetiti~nerrequests the following variances from the Anaheim Municipal Code, to
establish an 87-lot, R-1 subdivision: ~ •
a. SECTION 18.04.075 - Requirement that sinqle-ramily residential structures rear
on an arterial hiqhway (Prcposed lots to side on arterial
highway)
b. SECTION 18.08.550 - Minimum lot width on a cul-de-sac (60 feet required; 5 feet
proposed)
c. SECTION 18.24.030(4)(a) - Minimum lot width ( 0 feet required; 60 feet proposed)
d. SECTION 18.24.030(4)(a) - Minimum lot area (7 200 square feet required; 6.000
s~cuare feet proposed)
2. That Waiver 1-a, above-mentionec+, is hereby granted on the basis that t:he hillside
topography justified deviation from the "flat land" development standards as delineated in
the R-1 Zone, and the proposed deviation applies to a relatively small percentage of the total
number of lots.
3. That Waivers 1-b, 1-c, and 1-d, above-mentioned, were withdrawn by the petitioner
on the basis that the petitioner proposes to file a request for RS-5000 zoning, which is a
lesser intense zoning than the R-2 Zone for which the subject property has a resolution of
intent, and the develcpment proposal as submitted would be in conformance with the RS-5000
Zone site development standards.
4. Tii~t the Planning Commission reccmmends to the City Council that an ordinance be
read for R5-5000 zoning on the subject property,.instead of R-2 zoning for which there is a
resolution of intent or R-I zoning which the petitioner originally requested.
5. That there are exceptional or extraordinary circumstances or conditions applicable
to the property involved or to the intended use as granted of the property that do not apply
generally to the property or class of use in the same vicinity and zone.

• 6. That the requested va~~'iance as granted is necessary f~the preservation and enjoyment
of a s~bstantial prarerty right possessed by other property in the same vicinity and zone, and
denied Co the property in question.
7, That the requested variance as granted will not be materially detrimental to the
public welfare or injurious to the property or improvements in such vicinity and zone in which
the oroperty is located. .
S. That no o-e appeared at said public hearing in opposition and no correspondence
was received in opposition to subject petition.
ENVIRONMENTAL IMPACT REPORT FINDING:
That Environmental Impact Report No. 124, supplementing Master EIR No. 80, having been con-
sidered this date by the City Planning Commission and evidence both written and oral having
been presen[ed to supplement said draft E-f-R~No. 124, the City Plann mg Commisaion believes
that said draft EIR No. I'24 does conform [o the City and State Guidelines and the State of
Califorr.ia Environmental ~uality Act and, based upon such information, does hereby recommend
to the City Council that [hey certify said EIR No. 124 is in compliance with said Environ-
mental Quality Act.
NOll, THEREFORE, BE I~ RESOLUED that the Anaheim City Planning Commission does hereby granC
in par` s!.~bject Petition for Variar,ce, upon the following canditions which are hereby found
to be a necessary prerequisite to the proposed use of the subject property in order to pre-
serve tNe safety and ~ereral welfare of the Litizens of the City of Anaheim:
(1) That this Variance is granted subject to the completion of Reclassification ~o.
