A RESOLUTION OF THE CITY PLANNING COMMISSI06 OF BEE G~ OE ANAHEIM
THAT PETITION FOR VARiAIdCE N0.
WHEREAS, the City Planning Commission of the City uf Maheim did receive a verified Petition for Variance from
Mr. and Mrs. GILBERT SCHRODER, 18585 Los Leones, FounCain Valley, California 92708,
(Owner); and KENNETH OLSON, 527 South Harbor Boulevard, Anaheim, California 92805 (Agent)
of certain real property situated in the City of Anaheim, County of Orange, State of
Califoriiia, as described ir. Exhibit "A" attached hereto and referred to herein as though
set forth in fu11
WHEREAS, the City Planning Commission did hold a public hearing at lhe City Hall in the City of Anaheim on
July 8, 1974, at 2:00 o'clock p.m., no~ce af said public hearing having been duly ~iven as required by'law and
in accurdance with the provisians of the Maheim Municipal CQde, Ciiapter 18.68, to hear and conside,s ew'.ince for and against said
proposed variance and to investigate and make findings and recommendations in connection therewith; ar.d
WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due
consideration of all evidence and reports offered at said hearing, does find and determine the following facts:
1. That the petitioner rcqucsts .the folloWing variances from the Anaheim Municipal Code, to
expand an existing nonconforming phetographic studio:
a. SEC. 18.38.020 - Permitted uses in the C-0 Zonz. (Photographic studio
not permitted)
b. SEC. 18.38.050(2)(D)1 - Iiinimum ai.de vard setback. (10 feet required; 4 feet
proposed)
c. SEC. 18.38.050(4)(A)4 - ~~tinimum number of parkinrt spaces. (19 parkinQ space~
required; 12 parking spaces proposed)
d. SEC. 18.38.050(2)(E) - Maximum wall heit;ht. (2.5 feet permiteed; 3, 4, and 6
feet proposed)
2. That Wai.ver 1-a, above-mentioned, is hereUy granted on the basis that the use has
been In exisCence at the subject location for a period of approximatelp Cwelve (12) years,
and is a professional office in nbture.
3. That Waiver 1-b, above-mentioned, is hereby granted on the basis L•hat the exist•ing
structure has been in existence for longer than twelve (12) years.
4. That Waiver i-c, above-mentioned, is hereby granted on the basia that the propoaed
parking spaces are adequate for the use, as proposed, and since the petitioner indicated
that the photographic studio would not cater to the general publlc, but to buainessmen
and'advertising agencies.
5. That We3.ver 1-d, above-mentioned, is hereby graated on the basis of the aesthetic
value of the development proposal, as submitted.
6, That thert are exceptional or extraordinary circumatances or conditions applicable
to the property involved or lo the intended use of the property that do not apply generally
to the property or class of use in the same vicinity and zone.
7. That tl~e requested variance is necessary for the preservarion and enjuyment of a
substancial property right possessed by otl-~er pxoperty in the sEime vicinity and zone, and
denied co the property in quesCion.
8. That tt~e requested variance will not be materially det:rimental to the puhlic
welfare or injuxious to the property or improvementa in auch vicinity and zone in which the
property is located.

ENVIRONt1ENTAL IMPACT REPORT. FINDING:
~
That the Director of Development Services has determined that the proposed activiry falls
within the definition of Section 3.01, Class 3 of the City of Anaheim Guidelines to the
Requirements for an Environmental Impact Report and is, therefore, categorically exempt
from the requirement tn f:le an EIR.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby
grant subject Petition for Variance, upon the following conditions which are hereby found
to be a necessary prerequisite to the proposed use ef the suu~ect property in order to
preserve the safety and general welfare of the CiL•izens of the City of Ar.aheim:
1. That the owner(s) 'of subject property shall deed to the City of Anaheim the
westerly 5 feet of the northerly lot of sub3ect property for alley widening purposes.
2, That street lighting facilit~es along Harbor Boulevard shall be installed as
required by the Director of Public Utilities and in accordance with standard plana and
apecifications on file in the Cffice of the Director of Public Utilitiea; and that a bond
in an amount and form satisfactory to the City of Anaheim ahall be posted with the City to
guarantee the installation of ehe above-mentioned requirements.
3. That trash storage areas ehall be provided in accordance with approved pl.ans on
file with the Office of the Director of Public Works.
4. That all engineering requirementa o£ the City of Anaheim, along the alley, '
including preparation of improvement plans and installation of all improvemente, shall be
complied with as required by the City Engineer and in accordance with standard plana and
specificattons on file in the Office uf the City Eagineer and that a bond in an amount ancT
form satisfactory to the City of Anaheim shall be posted with the City to guarantee the
installation of the above-mentioned requirements.
5. That aubject property ahell be developed substantially in accordance with plans
and specifications on file With the City of Anaheim marked E~:hibit Nos, 1 through 3.
6. That Condition *1os. 1, 2, and 4, above-mentioned, sha11 be complied with prior
to the commencement of Che activity authorized under this reaolution, or prior to the time
that the building permit is issued, or within a period of one year from date hereof;
whichever occurs first, o: such further time as the Planning Commissian or City Council may
grant.
7. Tliat Condition Nos. 3 and 5, above-mentioned, ahall be comp'lied with prior to
final building end zoning inspections.
S. That this Variance is granted stsbject to the coopletion of Reclassification
No. 63-64-90, now pending.
