BE GRANTED WHEREAS, the City Plenning Commission of the City of Anaheim did ceceive a veriSed Petition for Vsriance fcom BROOKHURST APT, FUND, LTD., Attn: CHARLES CLAYT~N, 16205 East Whittier Boulevard, Whittier, California 90607 (Owner); and HARBOR MP:NAGEMENT CO „ INC „ 601 Dover Drive, Newport Beach, California 92660 and WESTOVER, CURftEY & MATSEN, 500 Newport Center Drive, ~te. B., Newport Beach, California 92680 (Agents) of certain real property situated in the City of Anaheim, County of Orange, State of Cali~ornia, as described in Exhibit "A" attached hereto and referred to herein as though set forth in full ; and WHEREAS, the City Plenning Commission did hold a public hearing at tae City Hall in the City of Anaheim on July S, 1974, at 2:OD o'clock P.M., notice of said public hearing having been duly given as requiced by law end in accordence with the provisions of the Anaheim Municipal Code, Chapter 18.68, to near and consider evi- dence for and against said propased variance and to investigete and meke findings and rernmmendations in connection therewith; and WHEREAS, seid Commission, aiter due inspection, investigation, and study made by itself and in its behalf, und after due consideration of ell evidence and reports offered at said hearing, does find end deteanine the (ollowing facts: 1. Thet tne petitioner requests .the following variances . from the Anaheim Municipal Code, to continue the use of four existing signs: a. SEC. 18.62.050(c} - Maximum siRn area, (20 sq. ft, permitted; 40 and 61.4 sq. -" ft, proposed) b. SEC. 18.62.050(c) - Maximum number of siQns permitted. (2 signs permitted; 4 pruposed) 2. That Waivers 1-a, and 1-b, above-mentioned, are hereby granted on the basis that"• the Planning Commission determined that the signs were not offensivc or objectionable. 3. That there are exceptional or Pxti-.ardinary circumstances or conditions applicable to the property invotved or to the intended use of the property thet do not apply generall~ to the property or class of use in the same vicinity and zone. 4. That the requested veriance is necessery for the presecvation and enjoyment of a substantiel property right possessed by other property in the same vicinity and zone, end denied to the property in question. 5• That the requested veriance will not be materielly detrimental to the public welfare or injurious to the pcop- erty or impcovements in such vicinity and zone in which the pcopecty is loceted. 6. That no one appeared et said public hearing and no correspondence was receivediin opposition to subject petition. ENVIRONMENTAL It~II.'ACT REPORT FINDING: That the Director of Development Services has determined Chat the preposed activity falls within the definition of Section 3.01, Class 2 of the City of Anaheim GuideLines to the Requiremen*_s for an Environmental Impact Report and is, therefore, catpgorically exempt from the requirement to file an EIR.
